Resolution: The Board considered and noted arrears statement for the months of May & June 2019.The efforts made by Revenue Branch for the recovery of current amount were appreciated. However, the PCB directed to make every possible effort to maximize recovery of arrears through staff & U/S 259.

3 SANITARY DIARY

To consider & note Sanitary condition of Abbottabad Cantt Board for the period of May, June & July 2019.

Resolution: The Board considered and noted and showed satisfaction on overall sanitary condition of Abbottabad Cantt. The Board also appreciated the efforts of cleanliness campaign launched during Eid ul Azha. The general public & media also lauded the efforts of this office. The Board also appreciated purchase of rubbish compactor & Bins as the enclusion of same in Sanitation Branch will make the difference in disposal of rubbish & cleanliness of area.

4 ANNUAL ACCOUNTS OF RECEIPTS & EXPENDITURE FOR THE YEAR 2018-19

To consider & note Annual Account of Receipts & Expenditure for the Fiscal year 2018-19. In this context it is apprised that annual accounts of Receipt and Expenditure in respect of Cantt Board Abbottabad for the year 2018-19 as required under Rule, 41 of the Pakistan Cantonment Accounts Code, 1955 are placed before the Board for noting. The same will be forwarded to the Headquarter ML&C for information and necessary scrutiny at their end.

Case file is place on table for consideration of the Board.

Resolution: The Board considered and noted annual accounts of receipts & expenditure for the year 2018-19. The Board further allowed to forward the same to the HQ ML&C for information & necessary action.

5 RE-APPROPRIATION FROM MAJOR TO MAJOR HEAD OF BUDGET ESTIMATES 2019-20

To consider and approve re-appropriation from Major to Major Head of Budget Estimates 2019-20under Rule – 20 (20) of Accounts Code, 1955 as per re-appropriation statement attached. In this context it is apprised that upon the direction of Garrison Commander conveyed in the meeting with the PCB & CEO Cantt Board desiring that focus on CB shall be on providing services to the Cantt Board residents, and a detailed survey regarding the height of School building viz a viz upon area available to children for playing etc, the Board Members unanimously decided to drop the construction of 3rd floor of school building as the same at present is not required according to the strength of students. The anticipated saving Rs. 25.00 (M) against the said head will be utilized as follows:-

6 CONSIDERATION OF PURCHASE OF 4 NOS. CONSERVANCY VEHICLES (ESTIMATED COST RS.20.00 (M)SANCTIONED IN THE BUDGET ESTIMATES 2019-20

To consider purchase of 04 Nos. conservancy vehicles already sanctioned under Head F- 4(b)of the Budget Estimates 2019-20.

In this context it is apprised that 04x Nos. conservancy vehicles are already sanctioned in the budget estimates of 2019-20, vide RHQ Rwp letter No.32/22/DRR/2019-20/5 dated 14th June 2019. The Board now with the consent of all members desires to elaborate the sanctioned conservancy vehicles as follows:-

The HQ ML&C vide letter No 101/696/ADG/Est/ML&C/2015 dated 31-07-2019 issued instructions of the Cabinet Decision as follows: “Any building, park, road, bridge or structure, constructed with public money should not be named after anyone other than a national hero.”

25 RENEWAL OF LEASE IN RESPECT OF SVY NO.203 MANSEHRA ROAD (KKH) ABBOTTABAD CANTT

To consider renewal of lease of survey 203 situated at Mansehra Road Abbottabad Cantt.

In this context it is apprised that the survey is held by M/s Saeed Akhter etc on Schedule VIII of the CLA Rules 1937 for a period of 30 years renewable upto 90 years. The first term of the lease has expired on 22/07/2009 and the second term for 30 years for the period w.e.f 23/07/2009 to 22/07/2039 is required to be renewed.

The Board is apprised that this office leased out a commercial piece of land measuring 880 Sq Yds out of Survey No. 203 Mansehra road, Abbottabad Cantt for commercial complex (excluding petrol pump, cinema and Star Hotel) through open public auction held on 31/03/1979. MOD accorded the sanction of said commercial piece of land vide letter dated 12/06/1979. While executing the lease deed this office mentioned the purpose of said land as dwelling house / shop instead of shopping complex in the lease deed. The lessee constructed the Hotel / Restaurant on the site after due approval of Building plan by the Board. Case for execution of amendment deed was forwarded to RHQ Rawalpindi vide letter No. 4/3/190/II/194-A dated 10/03/2010. The DML&C Rawalpindi accorded sanction vide letter dated 16/03/2010 for execution of amending deed in accordance with the Government sanction issued vide letter dated 12/06/1979 subject to fulfillment of all codal / legal formalities. Amending deed was executed on 22/03/2012 and words Dwelling House / Shops were amended with commercial complex. The lease was not renewed due to objection that the lessee has constructed a hotel on the site. The matter was again submitted to DML&C for advice on the matter. The DML&C with his recommendation for renewal of lease as the hotel is not a star hotel forwarded the case to the HQ ML&C Rawalpindi. HQ ML&C advised

In this context, it is apprised that Engr. ARIFULLAH is requesting vide application dated 26-08-2019 for registration of his firm “EAGLE VIEW DESIGNS & ARCHITECTURE CONSULTANT” as approved architect with Cantonment Board Abbottabad. The said firm is registered with Pakistan Engineering Council under PEC registration No. Civil / 43216.

27 RECONSIDERATION OF APPROVAL OF BUILDING PLAN IN RESPECT OF HOUSE IN REHMATABAD ABBOTTABAD

To re-consider approval of building plan approved by the Board vide CBR No.24 dated 28/02/1962. In this context it is apprised that the building plan of land measuring 68x60 = 4080 sft (15 marals) in Rehmatabad was approved in the name of Mr. Abdul Aziz S/o Samadar Khan vide above referred CBR. In 2017 one Mr. Babar Malik S/o FazalurRehman applied for provision of record and this office asked him to show his concern with the said property. On further scrutiny of records it was found that no land documents of land are available in relevant file. In August, 2018 Muhammad Zafran S/o Abdul Aziz started repair work of the house. Mr. Babar Malik Submitted application against the Construction / repair of house. Mr. Zafran was asked to submit revised plan alongwith title documents of land for approval / regularization of construction vide letter dated 14/08/2018. Mr. Babar Malik was also asked to provide the owner ship documents of land vide this office letter dated 25/09/2018 & again vide letter dated 01/10/2018. Mr. Zafran Khan has also been asked to provide ownership record of land vide letter dated 03/06/2019. However, no one has provided the same as yet.

The case was recommended by the Building & Sanitation Committee & accordingly approved by the Board vide CBR No. 05 (16) “B” dated 12-08-2016. The Building plan of boundary wall was issued to the owner vide this office letter No. 4/4/10551/1505 dated 22-09-2016. Later on Mr. Bilal Shah S/o Yaqoob Shah submitted 02 building plans of 05 Marlas each on Khasra No. 4316 & 4317 with kawat No. 734/1121, in this office for approval vide diary No. 513 & 514 dated 18-05-2017. The said building plans were recommended by the Building & Sanitation Committee & accordingly approved by the Board vide CBR No. 13 (iii) 3-A & 13 (iii) 4-A dated 05-06-2018. The approval of said building plans was conveyed to the owner vide this office letter No. 4/4/11023/13 & 4/4/11024/14 dated 29-06-2018. Mst: Urooj Fatima & Gazia Waheed d’s/o Abdul Waheed Khan submitted an application to IGP with the copy to CEO Abbottabad Cantt regarding encroachment & grabbing of their land by Mr. Bilal Shah. In the light of said application this office informed to Mr. Bilal Shah vide this office letter No. 4/4/11023/2599 dated 23-11-2018 for stoppage of construction at site. Moreover, a letter was also forwarded to the Tehsildar Abbottabad for demarcation of land vide this office letter No. 4/4/1055/2745 dated 10-12-2018. In this context it is apprised that auction of Building material of old Cantt Board Office was held on 03/01/2019. The applicant offered highest bid of Rs. 27,20,000/- which was approved by the Board vide above referred resolution.

The case for demolition of old Cantt Board Building was placed before the Board & the Board vide its resolution No. 16 dated 19/02/2019 decided as under:-

“The Board considered at length and unanimously decided that old Cantt Board office Building is property of the Board being class ‘C’ land and rules and regulations of archaeology department of Khyber Pakhtunkhwa does not apply on Cantonment Board, Abbottabad. The Board further decided to take up the case with ML&C department for the concern over the notice issued by archaeology department Khyber Pakhtunkhwa and requested the CEO to move in accordance with CPR 1957 & safeguard the interests of the Board. The case was taken up with ML&C Deptt vide CBA letter No. 30/62/213 dated 28/01/2019. The ML&C Deptt vide letter No. 1/2/FCB/ML&C/2019 dated 04/03/2019 considered the case & directed as under. “The case has been considered in this HQ and the undersigned is directed to request you to please deal with the subject matter at your own level being a local matter under the provision of relevant rules / regulations.

The case was taken up with Gar HQ through Sta HQ Abbottabad vide CBA letter No. 30/62/CB office /5314 dated 22/04/2019, for demolition of old Cantt Board office building on the verbal instructions received from PCB. The Sta HQ Atd forwarded the case to Gar HQ Atd vide letter No. 205/10/Gar HQ/CB dated 18/06/2019, response of which is still awaited.

Now the bidder is requesting for refund of 1/4th Bid amount, of Rs. 6,82,500/-

36 EXEMPTION IN CONTRACTUAL AMMOUNT

To consider and approve the application of Mr. Zabta Khan, contractor for collection rights of hoarding charges/ shop board fee for the year 2018-19 regarding exemption of Rs. 2.116 M. In this context it is apprised that the contract for collection rights of hoarding charges/ shop board fee for the year 2018-19 was auctioned in June, 2018 and Mr. Zabta Khan offered the highest bid amounting Rs. 12.5 M, which was approved by the Board vide CBR No. 40 (i) dated 30th June, 2018. The Honorable Supreme Court of Pakistan in SuoMoto case No. 27 of 2018 dated 17th Oct, 2018 passed directions on 17/10/2018 for removal of hoarding boards from the Public Properties. Resultantly Cantt Board, Atd removed 43 hoarding boards from Road berms & from Cantt Board properties in Nov, 2018. Total amount of hoarding charges of these boards comes to Rs. 2.116 M. Now the said contractor has submitted application in this office for exemption of an amount of Rs. 2.116 M.

After detailed discussion and deliberation the Board resolved that the Hawkers who were given licence by this office and have gone to the court shall be accommodated and further resolved to allow to the Civil Members headed by Chairman Bazar Committee to grant stalls to the deserving residence of Abottabad Cantonment as per detail given below:- i) 35 to 40 x stalls to Hawkers possessing old CB licences ii) 13 x stalls to each Civil Member for poor people in their respective wards iii) 05 x stalls to nominated Members for minorities etc iv) 05 x stall to be allotted by the Cantt Board to the deserving people as recommended for chairman Bazar committee. The site being remainants of nullahs is under encroachment by civul & Govt authorities & must immediately be secure to safeguard the interest of the Board. It is brought to notice of the Board that an amount of Rs. 1503151/- was adjusted/transferred from rent controller account against the Property tax of Property No. 435 to 467, Mansehra Road vide Cantt 4B No. 32/192 dated 03/09/2014, for the period w.e.f 01/07/2002 to 30/06/2015.

After adjustment of property tax the property owner submitted applications stating therein that he has leased out his land to M/s Shell Company for establishment of Petrol Pump on monthly rent of Rs. 5000/- PM and M/s Shell Company has obtained the approval of Building plan from CB Abbottabad in the name of M/s Shell Company and he is not bound to pay the House tax as per agreement clause No. II (d) executed between property owner & Shell Company. The matter of payment of House tax was taken up with M/s Shell Company vide CB letter No. CB 4/4/5115/3044 dated 16/04/2005, No. 4/4/5115/4402 dated 14/02/2019, NO. 4/4/5115/2953 dated 26/03/2007 & No. 4/4/5115/3119 dated 24/12/2018. In response of above said correspondence the Shell Pump admitted the liability of property tax vide letter dated 09/05/2019 & also paid Rs. 18,98,626/- on account of Property tax for the period w.e.f 01/07/2002 to 30/06/2019 vide Cantt 4B No. 100/308 dated 23/03/2019. In this context it is apprised that Cantonment Board Abbottabad have no electric hydraulic bucket for Engineering Branch. Due to non-availability of the said vehicle, this office has to make requests to the Garrison Commander Abbottabad for provision of said vehicle for rectification of street lights which causes delay in resolution of complaints by the resident lodge in this office as well as on Prime Minister Portal Complaint Cell.
