To note and confirm the action taken by the CEO with the prior approval of the PCB under Section 25 of Cantonment Act, 1924 (II of 1924) vide following Office Note, which is mandatory to carry out the purposes of Cantonment Act, 1924 :-

In view of the above, it is proposed that these sites may be declared as Adopted and Sponsored Property for the installation of outdoor media / hoardings etc.

d. Engineering Branch i. Approved. ii. Approved. Besides, manholes at Qalma Chowk & Dhamial Camp area shall also be covered. Cantt Engineer shall coordinate with the concerned Contractors for needful action by 15th July, 2019. For this very purpose, Mr. Qaiser Mehmood, Asstt Secretary is tasked to take notice of the completion of the said work within stipulated period and thereafter put up report / site pictures before the Board to proceed further in the matter. In case of non execution of work, the concerned Contractors shall be declared as “Black-listed”. iii. Approved. The concerned Contractors shall be issued instructions to accomplish the job forthwith. In case of non compliance the Contractors be black-listed as per law.

Item No: 6 REMOVAL OF ENCROACHMENT FROM STREET NO: 20/5, NASEERABAD.

To consider the complaints of residents of the area received through PMDU No. 030119-0903811, Station Headquarters regarding encroachment at Naseerabad Street No.20/5, Muhallah Naseerabad which encroachment is lying pending for decision since long. In this regard, it is apprised that Notice U/s 187 has already been served upon the offenders to remove the encroachment on 14.11.2017 & 26.03.2019 but they did not comply with the instructions contained therein. In to proceed further in the matter, CPO Rawalpindi has already been requested a number of times to provide a Police force to maintain law & order situation at site but no Police force has since been provided by the concerned quarter.

All connected papers are put up. Resolution: Considered. The Board after detailed discussion resolved that SCE / Cantt Engineer shall visit the site and shall upload the on ground factual position on the PMDU Portal after taking necessary action in respect thereof.

Item No: 7 MUTATION OF PROPERTY / LAND SITUATED NEAR BUNGALOW NO: 304-D, PESHAWAR ROAD, RAWALPINDI. To consider an application dated 11-06-2019 submitted by Mr. Faisal Rehman Khan requesting therein for mutation of property / land situated near Bungalow No: 304-D, Peshawar Road Rawalpindi in his favour by way of registered sale deed.

As per record of this office, the property /land in-question near Bungalow No: 304-D, Peshawar Road Rawalpindi measuring 07 Kanal & 01 Marlas is situated outside Bazar area under the management of RCB and held on lease for a term of 30 years renewable at option of lessee upto 90 years for the purpose of workshop, service station and showroom etc in the name of M/s Western Motors (Pvt) Ltd through Sardar Karim Hayat Khan. The lessee applied for change of company’s name as M/s New Western Motors (Pvt) Ltd instead of M/s Western Motor (Pvt) Ltd through Mr. Saleem Hayat Khan, Managing Director in respect of the above said property. After completion of all legal formalities i.e publication of notice in daily News papers Daily Dawn & Daily Nawa-e-Waqt dated 21-10-2003, the said case was forwarded to PCB for approval and the PCB vide order dated 15-12-2003 under Section 25 of the Cantonments Act, 1924 approved the same. 30

After that Mr. Saleem Hayat Khan S/o Karim Hayat Khan, Chief Executive of New Western Motors (Pvt) Ltd transferred the lease hold rights of the above said property / land to Malik Muhammad Masood S/o Malik Muhammad Abdullah Khan by way of registered sale deed bearing No: 5466/1 dated 01-09-2004 without payment of TIP Tax & mutation. Malik Muhammad Masood further transferred the lease hold rights of the said property / land through attorney (Muhammad Khalil S/o Muhammad Ismail) to applicant Mr. Faisal Rehman Khan through registered sale deed bearing No: 3165/1 dated 06-06-2017 without payment of TIP Tax.

During scrutiny of record it has also been revealed that no original correspondence record / documents i.e. Board resolution, proposal letter & sanction letter of Ministry of Defence dated 12-09-1961 etc regarding grant of lease in respect of the above said property / land to M/s Western Motors (Pvt) Ltd are available in this office record / file. However, the applicant has provided certified copies of registered lease deed & renewal lease upto 14-09-2021. As per condition No: 8 of lease deed, which is reproduced as under: -

“Upon every assignment transfer or sub - lease of the premises hereby demised or any part thereof or within one calendar month thereafter to deliver a notice of such assignment transfer or sub - lease to the Cantonment Board setting forth the names and description of the parties to every such assignment transfer or sub - lease and the particulars and effect thereof.” Relevant file is placed on the table.

In this regard, rules / regulations for grant of honorarium are as under: - “The provision of Rule 40, 41 of Pakistan Cantonment Servants Rules 1954 explicitly narrates the conditions for award of honorarium to cantonment servants for performing within and the outside course of duty, work of such exceptional merit or of such arduous or unusual nature as to justify grant of honorarium. The rule in question further depicts that such honorarium should be given on the instance / recommendation of Executive Officer to the cantonment servants for display of conspicuous energy, intelligence or pluck in detection of fraud or evasion of payment of taxes or other service usually of recognition by the Board subject to concurrence of the Director.

It is worthy to apprise that the mandatory recommendation of CEO and DML&C has been skipped, besides ignoring the acute financial crises.

It is also pertinent to mention here that during the year 2016 – 17, this office seek guidance from HQ ML&C Department on the subject vide this office letter dated 16.06.2017, but no advise / guidance has so far been received. During the year 2017–18 no such letter for grant of honorarium received from the department. Now again HQ ML&C Department has asked for grant of honorarium of one month basic pay, which amount to Rs. 4,11,700/-.

FOR READ 160 DIA PE water supply pipeline from QIH to “Laying of 160 mm dia PE water supply Naseerabad Street No.3 at an estimated cost of pipeline from Qasim Market to link Rs.3.50 M newly constructed overhead / In the backdrop of the issue, it is apprised underground water tanks at Cobb that an estimate amounting to Rs.3.50 (M) for Laneat an estimated cost of Rs.3.50 M”. To overcome the sewer water the work “160 mm dia PE water supply shortage issue at Azizabad, Mughalabad pipeline from QIH to Naseerabad Street and surrounding areas. No.3” was approved in the budget estimates 2018-19 and carried over in budget estimate 2019-20 to CFA but work could not be executed due to already resolved the problem through management of local staff and M&R works. The problem is now resolved and acute shortage of water issue addressed. To consider the open auction of collection rights of Group Latrine and augment the recovery, this Office vide letter bearing No.RCB/Advertisement/8944, dated 09-05-2019 got published the “Notice” for auction of collection rights of Group Latrine Fee Rawalpindi Cantt for the year 2019-2020 (one year) @Rs. 10/- per user. The Auction Notice was published in the Daily “Jang” Daily “Nai Baat” and daily “Pakistan Observer” Rawalpindi on 14th May’ 2019. Accordingly, the Auction was held on 30th May 2019 in the Board Room of RCB office. In this response, 04 Nos: of bidders offered their rates. To consider the matter of Collection Rights of Car / Motorcycle Parking fee from Saddar Area (Bank Road, Adam Jee Road, Hospital Road, Kashmir Road, Canning Road) vide CBR No. 29 dated 21-02-2019 and amendment vide CBR No. 35 dated 18-3-2019 and advertisement duly vetted / approved by the DML&C Rawalpindi vide letter No. 27/1238/DRR/52, dated 15th Jan, 2019., after the approval by the DML&C Rawalpindi Region Rawalpindi. After vide publicity in the press in the conference room of RCB and Haji Sher Muhammad has offered highest bid of Rs.1,10,00,000/- for one year i.e. 01-5-2019 to 30-04-2020 (without Singapur Plaza parking fee) and Highest Bidder also submitted and requested through an application dated 26-04-2019 on the following conditions: -

a. To continue the contract for 02 years i.e 1st May 2019 to 31st April 2021. b. Rate be revised @ per hours instead of per trip. The case was referred to the Board vide CBR N o. 47, Dated 29-04-2019 Board Considered and resolved as under:

a. Considered an unanimously rejected being on lower side. The case on agenda side be put to re-auction.

b. Considered and deliberated at length. In order to attract the bidders so as to fetch handsome bid, the Board agreed n the enhancement of contract period for 02 years instead of one year and revision of rates of parking fee on per hour instead of per trip basis on the analogy of Singapore Plaza Parking Fee Contract.

As per direction of the Board the contract put up to re-auction held on 08-05-2019 and Mr. Muhammad Riaz, offered Highest bid amounting to Rs. 42.1 (M) and Mr. Zain ul Abiden offered highest bid amounting to Rs. 42.0 (M). Accordingly this office vide letter No. RCB/LRB/ 8912-A Dated 02-05-2019 intimated to Mr. Muhammad Riaz that his bid has been cancelled and CDR amounting to Rs.5,00,000/- is fortified and this office has asked to the 2nd highest bidder Mr. Zain ul Abiden vide letter No. RCB/LRB/ 9066, dated 20-05-2019 for pay the above said amount within 02 days, but he did not pay the same. 47

The case was referred to Board vide CBR No. 32, dated 28th May 2019 Board Considered and resolved as under:- Considered and held forth. The Board after due deliberation resolved to approve the proposal for re-auction of collection rights of Parking Fee from Saddar area (including Singapore Plaza Plaza Parking ). All codal / PPRA formalities be got complete priory. Besides, the call deposit of Rs. 5,00,000/- deposited by pervious highest bidder Mr. Muhammad Riaz S/o Allah Ditta) be forfeited.

Accordingly the contract was put to re-auction on 13-06-2019. In response Malik Aamir Shehzad offered highest bid amounting to Rs. 26.0 (M) for two years 2019-2021. and highest bidder submitted application dated 12-06-2019 therein he requested that he may please be allowed to deposit the payment of 1/4th bid amount for one Year payable amount (i. Rs. 32,50,000/- instead of two year bid amount Rs. 65,00,000/-) and he also provided a cheque as grantee for amount of Rs. 32,50,000/- bearing No. 10045662, dated 20-06-2019 Bank Al Habib Ltd Hassan Abdal Branch. Distt Attock. It is pertinent to mention that the auction condition as per CBR No. 47 Dated 29-4-2019 had not been submitted to DML&C for vetting.

To consider the fixation of monthly charges on water boring, since the tendency of private boring is increasing day by day in the public street / within boundary wall of the premises without valid permission of Board. This tendency will not only reduce water underneath but will create hurdle in the smooth municipal function of water supply in the peak months of summer i.e May, June, July and August.

Therefore, in order to arrest this tendency as a pre-emptive measure, it is suggested, reasonable charges may please be fixed on monthly basis, which will not only reduce this unauthorized activity but also will generate revenue for the Board :-

To consider Assessment ((ARV) finalized by the Assessment Committee for the period w.e.f 01-01-2013 to 30-06-2017 @ Rs.1,92,40,000/- P.A and w.e.f 0107-2017 to 30-06- 2020 @ Rs.2,50,12,000/- P.A

It is apprised that Ghakhar Plaza was burnt on 20-12-2008, and re-constructed in 2012, the assessment at time of burnt was Rs.82,86,800/- P.A. After re-construction of the plaza (6 Floors) the plaza was Proposed to assessment@ Rs.17,23,20,000/-P.A the owner filed objection in which mentioned that, all the old tenants were accommodated at the existing rent, he furnished all the agreements duly registered and requested to assess the properties as per rent, he also mentioned that back sides shops of L.G.F , Ground Floor, 2nd Floor are vacant and 4rth , 5th and 6th Floor are not yet occupied. The objection/matter was placed before the Assessment Committee meeting, about 6th time, but assessment has could not finalized.

Lastly in Assessment Committee meeting held on 26-06-2019 the Assessment Committee finalized the ARV as per Section 64(a) of the Cantt Act,1924 for the occupied floor, which was duly agreed by the owner, the detail of which is as under:-

“ The Assessment Committee has gone through the record and heard the point of view / objection of the owner. The owner requested to finalize the assessment as per rent being received from the occupant of the Shops as most of shops are closed, and Floor No. 4, 5, 6 are lying un occupied and requested not to assess these floors till occupation.

Keeping in view the ground reality and fact of the objections raised by the owner the assessment committee finalized the ARV of the building u/s 64 (a) of the Cantt Act, 1924 which is higher than the rent being received by the owner. Mr. Raja Haseeb and Mr. Manzoor Ellahi on behalf of owner attended the meeting.”

To consider the request of the Administrator regarding engagement of certain staff in the different departments e.g. CSSD, Laundry, Electro Medical Deptt, Incinerators & Boiler (as per list attached).

The Administrator, CGH has contended that the afore-mentioned engagement of staff is imperative for smooth operation of all the newly inducted equipment, as the CGH is now well-equipped with state of the are Electro-Medical Equipment.

Item No: 45 PERMISSION FOR LAYING OF GAS PIPELINE (OPERATIONAL PHASE) TO CARTER LOW PRESSURE PROBLEM IN STREET NO: 2, ALLIED BANK, RANGE ROAD TO JAMIA MASJID HAIDER ALI, LANE NO: 4, PESHAWAR ROAD.

To consider the laying of Gas Pipeline (Operational Phase) in the subject area as contemplated in the letter received from Mr. Umer Tanveer Butt Advocate, Member Provincial Assembly of Punjab (PP-15) whereby, he has contended that funds have already been allocated for re-instatement of Street No: 2, Allied Bank, Range Road to Jamia Masjid Haider Ali, Lane No: 4, Peshawar Road. After laying of gas pipeline by SNGPL (NOC already applied) the said street will be re-instated with the funds allocated therefor, as such, necessary “NOC” be granted in respect thereof accordingly.
