The meeting commenced with the recitation of Holy Quran.

Before routine transaction of business, Brig. Shahzad Tanveer (The Station Commander Relieving) welcomed Brig. Ijaz Qamar Kiani (new President Cantonment Board). Malik Munir Ahmad (Vice President Cantonment Board) on behalf of all the Members also warmly welcomed him, whereupon, the new PCB extended the vote of thanks to all the members of the Board on this memorable occasion. 2

Reference CBR No: 05 dated 31-07-2019

To re-consider notices under Section 185 & 256 of the Cantonments Act, 1924 served to the owner situated at St-No. 07 Hira School Road Afshan Colony.

The above said notices were placed before the Board and the Board vide CBR under reference resolved as under: -

“Considered. The Board after detailed discussion resolved that the properties where unauthorized change of purpose is involved shall be prioritized for sealing. Besides the properties falling within Non Commercialization Zone be demolished forthwith.” Now the same is required to demolish of 2nd floor and shops on ground floor cannot be regularized on residential building under the rule.

Item No. 31 AUCTION FOR TENANCY RIGHTS OF SHOP NO. 01, SITUATED AT KASHMIR ROAD, SADDAR, RAWALPINDI CANTT (ON PREMIUM BASIS).

To consider the open auction of Tenancy Rights of Shop No. 01, situated at Kashmir Road, Rawalpindi Cantt and augment the recovery, this Office vide letter bearing No.RCB/Advertisement/02, dated 04-07-2019 got published the “Notice” for auction of Tenancy Rights of Shop on rent basis @ Rs. 100/- per sft

The Auction Notice was published in the Daily “Express” Daily “Nawai Waqat” and daily “The News” Rawalpindi on 06th July 2019. Accordingly, the Auction was held on 26th July 2019 in the Board Room of RCB office.

In this regard it is stated that Mr. Syed Farhan Haider has offered highest bid amounting to Rs. 1, 01,25,786/- (10.125 M) and 1/4th amount @ Rs. 25,31,446/- has been deposited on account of Premium the case is put up before the Board and Board approved vide CBR No. 61, dated 31-07-2019. 38

It is further added that case is forwarded to Engineering Branch for construction of above said shop and Engineering Branch reported that contract of the construction of shop in question awarded to M/s Bashir & Sons @ Rs. 1.30 million vide work order No. RCB/Work/Order/CCE/9061, dated 17-05-2019. During starting / execution of work it has been observed that shop will only be constructed by covering the existing nullah at site. Therefore contractor requested and refused that he cannot start the work without covering of nullah as covering of nullah is not incorporated in sanctioned estimate. Later on Engineering Branch has again checked the site for fresh estimation for covering of nullah. It has been observed that covering of existing nullah is not feasible, because if nullah is blocked or chocked the storm water & sewerage water will be entered in the surrounding houses its cleanliness is not possible, therefore shop cannot be constructed on existing nullah. The Board after detailed discussion resolved that since the construction of subject shop is not feasible, as such, the proposal be dropped and amount received from the successful bidder (i.e. 1/4th of total bid amount viz. Item No: 56 AMENDMENT IN CBR NO: 27 DATED 29-08-2019.

Reference : CBR No: 27 Dated 29-08-2019. To consider the case for grant of exemption / waiver in payment of monthly rent in respect of Hall No. 02, Roomi Park, Rawalpindi Cantt due to vacation for the period upto August 2019. Although, the Board vide CBR under reference has approved the case.

It is pointed out that hall in question was auctioned in 2015 and a bid amounting to Rs. 31,00,000/- on account of premium and monthly rent at rate of Rs. 1,14,600/- P.M was received in open public auction held on 18th , 19th June, 2015. The original tenant / highest bidder i.e. Ch. Iftikhar Nazir S/O Haji Nazir Ahmad deposited said premium and cleared rent and thereafter transferred the tenancy rights in respect of Mr. Zahid Ahmad Rana (i.e. present tenant) on enhancement of 10% rent i.e. Rs. 1,26,060/- on the existing rent and payment of transfer fee. The premises in question was sub-let to M/S Cara Felz for establishment of Gloria Jeans Coffee outlet in 2016 with the permission of the Board and the rent stands cleared upto October, 2017. However, outlets of Roomi Park were got closed due to extreme security threats / closure of Roomi Road on the request of local police. Due to this very reason, M/S Gloria Jeans shifted their outlet at Saddar Road and premises in question is still vacant and unproductive of rent. 55

Therefore, the tenant requested the Board for remission in payment of monthly rent owing to stated circumstances. Since the waiver of amount of Rs. 27,73,320/- is involved in the case, as such, the matter requires to be referred to the Competent Authority for advice by amending the above referred CBR. All relevant papers along with file is placed on the table.

Resolution: Considered. The Board after due deliberation resolved to refer the matter to the Competent Authority.

Item No: 57 REGULARIZATION OF SERVICE OF LAZAR MASIH S/O MURAD MASIH, TEMPORARY SANITARY WORKER, SANITATION BRANCH.

To consider the case for regularization of service in respect of Mr. Lazar Masih S/O Murad Masih, Temporary Sanitary Worker, Sanitation Branch, RCB.

The incumbent has sufficient service at his credit and has been requesting for regularization. Although, the case was earlier placed before the Board in its meeting held on 05-07-2019, however, no clear decision was made in respect thereof.

All connected papers are placed on the table.

Resolution: Considered and approved the regularization of the above-named CB employee.

Item No: 58 CREATION OF POSTS FOR REGULARIZATION OF TEMPORARY SERVICES.

Reference : HQ ML&C, Rawalpindi letter No: 73/137/ADG(Est)/ML&C/87 Dated 17th May, 2019 received vide RHQ (ML&C) Rawalpindi letter No: 28/93/Conf/DRR/17/93 Dated 30th May, 2019.

To consider the creation of posts in various scales (details whereof alongwith the financial impact are attached as Annex-“A”) for adjustment / regularization of the services of incumbents as per directions of HQ ML&C Deptt conveyed vide letter under reference, in view of their prolonged satisfactory services since appointment.

In the backdrop of the issue, it is apprised that this Office vide letter No: RCB/Estab/Aptt/Rule-9/622 Dated 1st February, 2019 prepared / forwarded a list of temporary employees appointed in different categories (i.e. Rule-9, Daily Wages & 89 days basis) to the RHQ (ML&C) Rawalpindi. Moreover, the HQ ML&C vide letter under reference conveyed following directions :- i. Employees working on temporary basis on any status i.e. daily wages, contractual, 89 days & under Rule-9 of PCSR, 1954 etc. since 20 years should be made permanent. If posts are not available in the respective CBs, new posts to be got created. ii. Employees working on temporary basis on any status i.e. daily wages, contractual, 89 days & under Rule-9 of PCSR, 1954 etc. since 10 years should be made permanent if posts are available. 56

iii. The decision at Para (i)&(ii) above shall not be applicable on the temporary employees working for conservancy services being provided to Military Authorities by the CBs. iv. The necessary age relaxation cases may be forwarded to HQ ML&C.

In order to implement the afore-mentioned directions of the HQ ML&C in true letter and spirit, necessary approval of the Board is required for creation of posts.

Resolution : Considered and deliberated at length. The Board after detailed discussion resolved to approve the creation of posts as proposed on agenda side and refer the case to competent authority for sanction, Besides, age relaxation (wherever required) be also sought from the Competent Authority. ______
