Sejurus penubuhan MAVCOM pada 1 Mac 2016, kawalan selia aspek ekonomi industri penerbangan awam Malaysia dan perlindungan hak-hak pengguna penerbangan diletakkan di bawah bidang kuasa Suruhanjaya. Sebelum penubuhan MAVCOM, aspek ekonomi dikendalikan oleh Kementerian Pengangkutan Malaysia (MoT) dan Jabatan Penerbangan Awam Malaysia (DCA). Melalui Akta 771, Suruhanjaya diberikan kuasa untuk membuat keputusan secara bebas. Ia juga berfungsi sebagai penasihat bebas kepada MoT berhubung perihal ekonomi yang berkaitan dengan industri penerbangan awam. Peranan MAVCOM adalah berbeza daripada peranan MoT dan DCA. MoT bertanggungjawab untuk menggubal dasar utama serta mengendalikan hubungan antara kerajaan dengan kerajaan lain yang termasuklah untuk menerajui rundingan dua hala atau pelbagai hala berhubung hak trafik udara, manakala DCA pula akan terus mengawal selia aspek teknikal dan keselamatan industri penerbangan awam di Malaysia. Mulai 1 Mac 2016, sebarang isu yang berkaitan dengan persaingan berhubung perkhidmatan Menyediakan satu mekanisme perlindungan penerbangan di Malaysia adalah berada di bawah bagi semua pengguna di dalam industri kawal selia MAVCOM [ditadbir secara eksklusif di penerbangan awam di Malaysia bawah Akta 771, khususnya Bahagian 7 - VII Salah satu objektif utama MAVCOM ialah (Persaingan)]. perlindungan hak-hak dan kepentingan pengguna penerbangan untuk memastikan hak-hak tersebut Mentadbir, memperuntuk dan menguruskan sentiasa dilindungi dan berkembang. Kesaksamaan Kami melaksanakan tugas kami secara adil, bebas dan saksama tanpa berpihak kepada mana-mana pihak. 07 LOGO KAMI Warna biru sebagai warna utama mewakili langit yang dikawal selia oleh MAVCOM dan gradien biru melambangkan perbezaan ketinggian penerbangan pesawat-pesawat. Warna biru juga dipilih kerana warna ini menggambarkan amanah, martabat dan kekuatan, yang merupakan semua nilai yang dipegang oleh MAVCOM. Elemen utama logo ialah rombus putih yang menggambarkan ekor pesawat dan landasan kapal terbang, masing-masing mewakili peranan kritikal oleh syarikat penerbangan dan lapangan terbang dalam industri penerbangan. One of MAVCOM’s principal objectives contained in the Malaysian Aviation Commission Act 2015 Part X under Consumer Protection is to safeguard the rights of consumers in the aviation industry. A survey conducted by MAVCOM in 2016 revealed that 69% of respondents have a misconception of what their rights entail versus what their rights actually are. Many were also under the incorrect assumption that the terms and conditions set by aviation service providers is a representation of their ‘rights’. This emphasises the importance of the Malaysian Aviation Consumer Protection Code 2016 (MACPC), the first in the history of Malaysia’s aviation industry. The MACPC provides for more transparency and clearer guidance on consumer rights and how to exercise these rights relating to flight delays, flight cancellation, mishandled baggage and other flight incidents.

It can be seen in the establishing two aviation companies namely PT. Indonesia Air Asia and Ma- lindo which both are low-cost carrier. These aviation industries are categorized as low-cost car- rier, however safety and security are absolute factors because these are rights for consumers. This article will describe further about safety and security standard; protecting the rights for consumers in connection with safety aviation in Indonesia and Malaysia from the Consumer Protection Law and the Aviation Law. As a result of the research shows that safety standard passenger for air transportation in airport covers information and safety facility in the shape of availability of the emergency safety tools (fires, accidents and natural disasters); information, area and health facility; and healthcare workers. Moreover, safety standards for passenger in an aircraft include information and safety facility in the shape of availability information and the emergency safety tools for passenger in an aircraft. The protection for consumer rights for safe- ty flight in Indonesia as follows: aviation industry has obligation to fulfill minimum standard of safety and security; consumers must be safety from false information which raises concern; air- craft operation which endanger of the passenger; and consumer protection in operating the elec- tronic device which endanger flight.
