The Free State of Bavaria is divided into 91 wards for the election to the Bavarian Landtag, of which 29 are allocated to Upper Bavaria, 9 each to Lower Bavaria, and , 12 to Middle Franconia, 10 to Lower Franconia and 13 to . The parties or organised groups of voters nominate one candidate for each ward. Then the voters in this ward can elect one of these candidates with their first vote. Whoever receives the majority of first votes in a ward moves into the Bavarian Landtag (prerequisite: the ward winner’s party or organised group of voters has to have received a total of at least five percent of all valid votes cast throughout Bavaria). For the sake of electoral fairness it is important that the total population is roughly the same in all wards. This is why it repeatedly happens that the ward boundaries have to be realigned as a result of altered population figures.

In addition to the wards, the constituencies are the second important electoral-geo- graphical variable for the Landtag election. Each of the seven Bavarian administrative districts then functions as a constituency. The parties or organised groups of voters form lists with their candidates for these constituencies. The constituents of a con- stituency give their second vote to a candidate from these lists. For instance, the constituents do not have to pay attention to the order on the lists specified by the parties or organised groups of voters, but they can also elect a candidate from a rear list position. The order of all constituency candidates ensues on the basis of the total number of votes compiled from first votes (if a candidate has also campaigned in a ward) and second votes. Every person who has achieved a place within the total number of seats to be allocated for the constituency can move into Parliament. A total of 89 representatives can be determined via the constituencies. What has already been said about the ward applies analogously to the constituency. The total number of seats to be allocated in a constituency depends on the total population: 29 for Upper Bavaria, 9 for Lower Bavaria, 8 each for Upper Palatinate and Upper Franconia, 12 for Middle Franconia, 10 for Lower Franconia and 13 for Swabia.

Overhang and compensatory mandates (see *)

A total of 187 representatives (2003: 180) are represented in the 16th Bavarian Landtag due to overhang and compensatory mandates. The CSU receives three over- hang mandates in Upper Bavaria and one in the Upper Palatinate. The SPD receives two compensatory mandates, and Alliance 90/The Greens receive one compensatory mandate in Upper Bavaria.
