1 LOS ÚLTIMOS OBISPOS DE LA MONARQUÍA (1922-1931) Primera 1 LOS ÚLTIMOS OBISPOS DE LA MONARQUÍA (1922-1931) Primera parte: Cuestiones generales y nombramientos conflictivos Por Vicente CÁRCEL ORTÍ 1. Introducción Analizo y documento en este estudio algunas cuestiones relacionadas con los nombramientos episcopales hechos en España durante la última década de la Monarquía de Alfonso XIII, desde 1922 hasta 19311, que coincidió con la primera del pontificado de Pío XI. Es la primera parte de un trabajo más amplio, que verá la luz en estas mismas páginas, ya que la segunda estará dedicada a Los nombramientos de obispos en España desde 1922 hasta 1931, centrada en las provisiones episcopales de dicha década que se realizaron de forma normal, es decir, tras una negociación normal, sin provocar conflictos o tensiones entre el Gobierno y la Santa Sede. Vendrá después la tercera parte, sobre Los nombramientos de obispos durante la Segunda República y la Guerra Civil (1931-1938). Se completará, de este modo, una investigación inciada hace ya muchos años sobre los nombramientos episcopales desde mediados del siglo XIX, que cubre los treinta largos años del pontificado de Pío IX, con un amplio analisis documentado de cada nombramiento, dividido en tres partes, a causa de su notable extensión2; siguieron después los referentes a los veinticinco años de León XIII, divididos en dos partes y completados con una aportación particular sobre el influjo que tuvo en dicho nombramientos el cardenal Mariano Rampolla, secretario de Estado, que había sido nuncio en España3; a continuación, la década correspondiente a san Pío X, en la que fue decisiva la intervención del cardenal español Rafael Merry del Val, secretario de Estado, que fijo la última palabra en las negociaciones previas a los nombramientos hehos formalmente por el Papa4; y, por último, los siete años del pontificado de Benedicto XV5. En el presente trabajo sigo el mismo método de los anteriores, que consiste en reproducir íntegramente los despachos de la nunciatura referentes a cada nombramiento y a las actuaciones de los obispos respectivos, entrante y saliente, según los casos. Todo ello precedido de una amplia introducción, en la que comento lo que considero más importante, remitiendo al documento correspondiente publicado en el apéndice. Creo que de este modo facilito la labor a los investigadores diocesanos o a los interados por las biografías de obispos en particular, y, al mismo tiempo, aporto unos textos que tienen gran valor para comprender cada situación, en su momento y lugar, ya que no podemos mirar al pasado con los ojos de hoy. Este principio, que vale para todo historiador, tiene hoy más actualidad que nunca porque estamos condicionados por una confusión ideológica y una manipulación de la historia que no nos permite estudiarla con la serenidad debida. No digo con imparcialidad, por ésta prácticamente no existe, ya que todos, en mayor o menor medida nos dejamos influir por múltiples factores, unidos a nuestras propias ideas y a las conclusiones a que hemos llegado en nuestros estudios7. Aunque los procesos episcopales redactados tras 1922 y conservados en el Archivo Secreto Vaticano (ASV) - Archivo de la Nunciatura de Madrid (Arch. Nunz. Tampoco son consultables los documentos relativos a candidatos al episcopado, cuya relación nominal he publicado en «Documentos del pontificado de Pío XI sobre España (1922- 1939). Primera parte: Nunciatura de Madrid»: Analecta Sacra Tarraconensia 80 (2007) 231-496. 3 embargo podemos conocer, a través del archivo de la Sagrada Congregación de Asuntos Eclesiásticos Extraordinarios (AES) la correspondencia diplomática entre la Nunciatura de Madid y la Secretaría de Estado relativa a cada nombramiento, y también una parte importante de dicho archivo, sin duda la más interesante, pues se refiere a las reuniones plenarias de los cardenales, con las ponencias impresas y las actas de cada reunión, en algunas de las cuales se trataron las provisiones de sedes episcopales9. Los nombramientos del pontificado de Pío XI, hasta 1931, fueron gestionados por el nuncio Federico Tedeschini, con la ayuda de sus colaboradores de la nunciatura, en particular los auditores Antonio Guerinoni y Tito Crespi. Mientras que por parte vaticana, la competencia fue de la S.C. de Asuntos Eclesiásticos Extraordinarios, cuyo máximos responsables fueron los cardenales Gasparri y Pacelli, ayudados por los secretarios Borgongini Duca y Pizzardo, y con la colaboración de varios minutantes: Valeri, Ottaviani, Tardini y Malusardi. 2. Cuestiones generales a) Contrastes entre la Santa Sede y el Gobierno En sus conversaciones con el Gobierno defendió siempre Tedeschini que el criterio general seguido por la Santa Sede en los nombramientos de obispos era el bien espiritual de las diócesis. Este exigía que los obispos conocieran la lengua de sus fieles y estuvieran dispuesto a trabajar con todas sus energías y siempre y exclusivamente por la santificación de las almas. Por ello, la Santa Sede estaba de acuerdo con el Gobierno en excluir a los candidatos considerados politicantes, por muy santo y docto que fuera o pudiera parecer el candidato, y, por la misma razón, no podría aceptar que el Gobierno presentara por razones políticas a quienes no pudieran comunicarse con sus fieles, viéndose obligados a servirse de interpretes y tampoco a los que fueran a una diócesis pensando en un rápido traslado a otra más importante y rica para ir ascendiendo hacia el cardenalato, si era posible10 Tedeschini defendió en varias ocasiones la necesidad de destinar a Cataluña obispos catalanes. Comentando en agosto de 1925 la candidatura de Juan Francisco Morán Ramos para obispo de Jaca y la de Tomás Muniz Pablos para obispo de Vich, denunció los problemas provocados por el Gobierno, que se oponía a los candidatos catalanes para las diócesis de aquella región. Defendía el nuncio la necesidad de que los obispos destinados a las sedes catalanas conocieran la lengua del lugar, y así lo explicó al cardenal Gasparri11. 9 En mi libro Pío XI entre la República y Franco. Después que el Gobierno y la Nunciatura se ponían de acuerdo sobre una persona y la Nunciatura enviaba al Gobierno la correspondiente notificación oficial y el relativo proceso canónico, pasaban todavía varios meses y a veces años, antes de que el elegido pudiera recibir las bulas pontificias y tomar posesión de su diócesis.

    The School of Salamanca: A Case of Global Knowledge Production Max Planck Studies in Global Legal History of the Iberian Worlds Editor Thomas Duve The book volumes in the Max Planck Studies in Global Legal History of the Iberian Worlds publish research on legal history of areas which have been in contact with the Iberian empires during the early Modern and Modern period, in Europe, the Americas, Asia and Africa. Its focus is global in the sense that it is not limited to the imperial spaces as such but rather looks at the globalization of normativities within the space related to these imperial formations. It is global also in another sense: The volumes in the series pay special attention to the coexistence of a variety of normativities and their cultural translations in different places and moments, decentring classical research perspectives and opening up for different modes of normativity. Newman and Escrivá: Two Distinguished Educators The encyclical letter, Faith and Reason, explains the complementary nature of two forms of knowledge, philosophy and theology based on their shared source of truth. Almost from the inception of Christianity this notion was sustained by noted Catholic thinkers. Among the authors that the encyclical credits for this understanding of knowledge and truth are Clement of Alexandria, Origen, the Cappadocian Fathers, Dionysius, St. Augustine, St. Anselm, St. Albert the Great and St. Thomas Aquinas. The latter two recognized the rightful autonomy that philosophy has, but from the late medieval period onward the legitimate distinction between philosophy and theology became “more and more a fateful separation”1. During the 19th century, the exaggerated rationalism of some thinkers made philosophy and natural sciences almost completely independent from the contents of faith. In turn some theologians reacted with fideism, a mistrust of reason and man’s natural capacity to know God2. At the turn of the 19th century, a deep separation between faith and reason was readily perceptible in the poor religious instruction of the undergraduates at Oxford and in their perfunctory practices of piety. Secularization increased at this university, and by mid-century, its colleges widely adopted philosophical idealism and an unchecked acceptance of the historical-critical method of biblical criticism3. John Henry Newman, then a young tutor at Oriel College, advocated a spiritual and moral renewal that later became a doctrinal reform movement.

I. The Historical Development of Law in the Church. There are basically 5 historical periods in the history of the development of law in the Church. These are as follows: 1. The Early Christian Community (1-8 centuries). The early Christian Church, at least in Jewish sectors, incorporated the laws of the Old Testament into its life and practices. In the Old Testament, there were laws, which focused on the worship of the Jewish people, laws concerned with dietary regulations, and moral laws given by God for his people. In the earliest writings of the New Testament, laws appear. St. Paul, the first writer of the New Testament, presents lists of moral and disciplinary directives to be observed by all believers. He speaks at some length on marriage, the giving of directives for the moral life, and on amending the Jewish ritual practices of the early Christians, so that Christianity would not simply remain a Jewish sect. The early Church councils made determinations that were fairly specific and localized. They sought to offer specific solutions to specific problems now being faced by the growing Church. Many early canonical decisions and legislation was made from local, regional and provincial councils, such as the Synod of Elvira (in about the year 300). After the Edict of Constantine (313), the Church began another stage of development, since it was now free to grow and expand beyond the borders of the Roman Empire, without fear of persecution.
