GAY RIGHTS THROUGH THE LOOKING GLASS: POLITICS, MORALITY AND THE TRIAL OF COLORADO'S AMENDMENT 2 Suzanne B. Goldberg* Courts have long struggled to resolve the question of how far a community may go in exercising its power to treat minority mem- bers differently. Popular prejudice, "community morality" and in- vidious stereotypes repeatedly have had their day in court as judges work to reconcile equal protection and privacy rights with their own attitudes about the place of people of color, women and gay people in society.1 In the early 1990s, the tension between the American ideal of equality and the reality of human diversity starkly emerged. A national wave of citizen-sponsored initiatives seeking to amend state constitutions and local charters to prohibit governments from protecting lesbian, gay and bisexual citizens from discrimination spread across the country. -

Mulé York University ABSTRACT Registered charities are restricted when engaging in advocacy, whereas Canadian nonprofits face a far more difficult time when fundraising. The impact of such limitations on Canadian gender and sexually diverse1 activist organizations is one example of the implications on Canada’s democratization process. Despite the efforts of the Voluntary Sector Initiative (VSI), and updated political activity policies, Canada lags behind both the U.K. and U.S. in recognizing and legitimizing advocacy as an important contribution to its democratic process. An organized challenge of the system at the political and legal level is called for to address this issue. RÉSUMÉ Les organismes de bienfaisance enregistrés font face à des contraintes lorsqu’ils défendent une cause, tandis que les organismes sans but lucratif rencontrent de nombreuses difficultés pour amasser des fonds. L’impact de ces contraintes sur les organisations militantes de genre et de sexualité diversifiés n’est qu’un exemple de répercussion sur le procédé de démocratisation du Canada. Sexual Orientation – Protections for Gay, Lesbian, Bisexual, and Transgender Employees. A. Has LGBT Discrimination Ended in the Workplace? 1. A 2014 report by the Center for American Progress1 compiled the following data on LGBT employment discrimination: i. 11 to 28% of lesbian, gay, and bisexual, or LGB workers are denied or passed over for a promotion because of the sexual orientation. ii. 47% of transgender people reported being fired, not hired, or denied a promotion because of their gender identity. Of the 47% discriminated against, roughly 26% report being fired from a job they already had simply because of their gender identity. iii. Gay and bisexual men make 10 to 32 percent less than straight men working similar jobs. iv. 7 to 41% of LGB workers were verbally or physically harassed or had their workplace vandalized. 2. Only 18 states and the District of Columbia have laws explicitly protecting LGBT workers from being fired because of their sexual orientation or gender identity.2 Ohio, Kentucky, Michigan, and Tennessee offer no protections. i. Will employers provide more employment benefits to same sex couples after Obergefell? Many Fortune 500 corporations already do. Check out the Human Rights Campaign’s Corporate Equality Index,3 where 13 Ohio corporations, including law firms, earned a 100% rating.
