Landesregierung, Direktion für Landesplanung, wirtschaftliche und ländliche Entwicklung Abteilung Naturschutz Bahnhofplatz 1 4021 LInz 2 V o r w o r t „Naturschutz“ umfasst sämtliche Maßnahmen zum Erhalt und der Wiederher- stellung der Natur. Dabei sind insbesondere drei Zielsetzungen zu unterscheiden: Die Erhaltung der Vielfalt, Eigenart und Schönheit von Natur und Landschaft, die Erhaltung der Leistungsfähigkeit des Naturhaushaltes sowie die Erhaltung der Biodiversität bezogen auf die Ebene der Tier- und Pflanzenarten. Das Oö. Naturschutzrecht regelt diese Bereiche und ist daher eine Rechtsmaterie von grundlegender Bedeutung für unsere Umwelt. Das Oö. Natur- und Landschaftsschutzgesetz 1995 (Oö. NSchG 1995), LGBl. Nr. 37, in der Fassung des Landesgesetzes LGBl. Nr. 92/2014, war zuletzt im Jahre 2006 Gegenstand einer kommentierten Ausgabe. Die Rechtsentwicklung, die Rechtsprechung, die Erfahrungen aus der Vollzugs- praxis und nicht zuletzt die erforderliche Anpassung an gemeinschaftsrechtliche Vorgaben, insbesondere die Umsetzung der Richtlinie über die Erhaltung der wildlebenden Vogelarten (sog. "Vogelschutz-Richtlinie") und der Richtlinie zur Erhaltung der natürlichen Lebensräume sowie der wildlebenden Tiere und Pflanzen (sog. "Fauna-Flora-Habitat-Richtlinie") haben erhebliche Änderungen der landesgesetzlichen Rechtslage erfordert und bereits zur Erlassung von 12 Novellen des Oö. Natur- und Landschaftsschutzgesetzes 2001 (Oö. NSchG 2001) geführt. Dabei wurde neben zahlreichen inhaltlichen Änderungen des Oö. NSchG 2001 im Interesse der Rechtssicherheit und Übersichtlichkeit auch die Systematik der bestehenden Regelungen überarbeitet. Dies wurde zum Anlass genommen, eine neue kommentierte Ausgabe des Oö. Naturschutzrechtes zu verfassen. Dem Interessenten soll wiederum ein Arbeits- behelf zur Verfügung gestellt werden, der ihm einerseits neben der einschlä- gigen Rechtsprechung vor allem die Erlässe der Naturschutzabteilung des Amtes der Oö. Landesregierung zugänglich macht und ihm andererseits wertvolle Informationen für die Gesetzesanwendung und die Auslegung einzelner Bestimmungen des Oö. NSchG 2001 liefert. Das vorliegende Werk enthält neben dem Oö. NSchG 2001 und dessen Kommentar auch die zwei wichtigsten europäischen Richtlinien, nämlich die Fauna-Flora-Habitat-Richtlinie (FFH-Richtlinie) und die Vogelschutz- Richtlinie. In diesem Buch sind die auf Grund des Oö. Natur- und Landschafts- schutzgesetzes erlassenen Durchführungsverordnungen aus Platzgründen nicht abgedruckt. Sie finden diese Verordnungen, das Nationalparkgesetz samt Nebenbestimmungen sowie das Oö. Umweltschutzgesetz auf der Homepage des 3 Landes Oberösterreich unter http://www.land-oberoesterreich.gv.at zum kosten- losen Download. Ein ausführliches Stichwortverzeichnis soll das Auffinden erleichtern. Durch den hohen Praxisbezug richtet sich der Kommentar an alle, die mit dem Naturschutz in Berührung kommen bzw. jene, die daran Interesse zeigen. Abschließend danken die Autoren allen jenen, die sie durch Fachgespräche, Hinweise, Ratschläge oder die Bereitstellung von Unterlagen unterstützt haben. Opening of the meeting by a representative of the Secretary General of the Council of Europe Mr Fernandez-Galiano, from the Secretariat, welcomed participants (see Appendix 1) and recalled that the Group was to develop its work within the programme of the Convention on the Conservation of European Wildlife and Natural Habitats (Bern Convention). This implied that decisions on future activities had to be reported to the Standing Committee of the Convention for final adoption. He thanked the European Invertebrate Survey (EIS) for its suggestion for launching a group on invertebrate conservation within the Bern Convention (see document T-PVS (89) 34 revised). At the request of some delegates, the Secretariat explained the differences between the work to be developed by the Group and other activities in the field of invertebrate conservation, such as those of the European Communities. The Bern Convention counts at present 22 Contracting Parties, including the EEC. Ten of these Contracting Parties are states which do not belong to the European Community. Other states, such as Burkina Faso, Morocco, Poland, the Soviet Union and Tunisia have been invited to adhere to the Convention and they are likely to do so in the near future.
