The Secretariat has, as required by the Agreement establishing the Trade Policy Review Mechanism (Annex 3 of the Marrakesh Agreement Establishing the World Trade Organization), sought clarification from Mauritania on its trade policies and practices. (a) The different concepts associated with the term "ownership" and their interaction 660. As explained in the compilation (paragraphs 7-9, pages 220-221), in the professional and academic aviation literature the term "ownership" is indifferently used to refer to three distinct concepts: (i) The designation policy through which a country attributes the rights to operate, either domestically or under a bilateral Air Services Agreement, to a given airline(s) (e.g. the US Department of Transportation granting traffic rights to American Airlines but not to Continental Airlines on a non-open- skies destination). Designation policies were used in the past both at the national level (e.g. before the 1979 deregulation, the US Civil Aeronautics Board would attribute the right to operate on a given city-pair to a given airline) and at the international level. They seem now to be confined mainly to the international arena with the marginal exception of public services contracts. (ii) The national investment/establishment regime for airlines, whether operating only domestic flights, only international flights, or both. The investment regime may cover also non-scheduled carriers and, in certain instances, general aviation/business aviation carriers. In cases where there is only one, publicly-owned airline, there may be no investment regime since none is needed.

INTRODUCTION 1.1 This paper provides a global overview of regulatory and industry trends and developments of international air transport that have taken place since the mid-1990s, focussing on significant developments for the past five years. 1.2 The overview has two parts. The first part looks at major regulatory movements towards the liberalization of international air transport, including bilateral and regional liberalization, air service negotiations involving a group of States, multilateral initiatives, national liberalization policies, competition, and consumer protection policies. The second part reports on the airline industry’s responses to an ever changing and more competitive marketplace, including airline alliances, mergers and acquisitions, privatization, airline business models, and product distribution. 2. REGULATORY DEVELOPMENTS 2.1 The liberalization of international air transport regulation continued to evolve at various levels since the 1980s. It is estimated that, in 2008, this involved about 31 per cent of country-pairs with non-stop scheduled passenger air services and about 58 per cent of the frequencies offered, through either bilateral “open skies” air services agreements or regional/plurilateral liberalized agreements and arrangements (compared with about 7 per cent and 35 per cent, respectively, a decade ago, see Figure 1). 2.2 Bilateral liberalization.     WT/TPR/S/250 Trade Policy Review Page 52 IV. TRADE POLICIES BY SECTOR (1) INTRODUCTION 1. Mauritania's trade policy has not changed as regards the two key sectors of its international trade, namely, mining and fisheries products. Market access is not restricted in either of these sectors and there is a large international presence. Furthermore, in the mining sector, a law gives overseas service firms tax concessions that are not available to domestic firms. Since 2006, Mauritania has exported hydrocarbons, while the State continues to import all the refined petroleum products consumed. There is also a large trade in agricultural products because many of the country's food needs are covered by imports. Some dozen Mauritanian industrial groups and businesses dominate Mauritania's trade in services, especially wholesale distribution (of rice in particular), hotel and restaurant services and financial services. (2) AGRICULTURE AND LIVESTOCK (i) Overview 2. Although Mauritania's land is mostly desert, the rural sector plays an important role in the country's economy, with over 62 per cent of the population living mainly from rural activities. Because there is little rainfall or investment in production, the total surface area farmed each year is around 240,000 hectares, i.e. less than half its potential, and only 20,000 hectares are irrigated. There is a chronic shortfall in food crops and 70 per cent of staple food needs are imported with sizeable budget subsidies. A handful of private operators controls the import market. During the period 2007-2008, Mauritania saw sharp increases in its food import bill, and then again in 2010-2011 following the rise in global prices.
