The Concept of Extraordinary Crime in Indonesia Legal System: Is the Concept an Effective Criminal Policy?
THE CONCEPT OF EXTRAORDINARY CRIME IN INDONESIA LEGAL SYSTEM: IS THE CONCEPT AN EFFECTIVE CRIMINAL POLICY? Vidya Prahassacitta Faculty Humanity, Major Business Law, Bina Nusantara University, Jl. Kemanggisan Ilir III No. 45. Kemanggisan, Palmerah, Jakarta Barat, 11480 [email protected] ABSTRACT The concept of extraordinary crime was a common concept in Indonesia. Adopts from the concept of the most serious crime in Rome Statute and adjusted with the Indonesian legal system. Then it developed wider and introduced into terrorism, corruption, drug abuse offenses, and child sexual abuse in legislations and Constitutional Court verdicts. The implementation of this concept generated some consequences in drafting and formulating the legislation as part of penal policy. This leads to two legal problems; first, what was the categorization of the concept of extraordinary crime? and second, what were the consequences of the concept extraordinary crime in accordance with penal policy?. Normative law research with literature study method, This was a conducted as the response of both legal problems. Using secondary data from legislation, Constitutional Court verdicts, book and journal, this research concludes that; the concept of extraordinary crime parts of criminal policy does not have any standard for the categorization. Then, as consequences of the implementation of the concept of extraordinary crime in several penal efforts are formulating in legislations. The penalty effort is not limited to criminalization and sentencing aspects but wider and shall be in line with the strategy of crime eradication and welfare protection purposes. To reach the effectiveness of the criminal policy of the concept of extraordinary crime, the penalty effort shall be in line with criminal law principles and human right basic principles. -

T h e E c o n o m ic F o u n d a t io n s o f P o l it ic a l C o n f l ic t in B a l i , 1950-1965 Geoffrey Robinson Introduction Surveys of modem Balinese history are curiously silent on the dramatic economic changes which occurred in the period 1950 to 1965.* 1 They provide virtually no detailed de scription or analysis of the poverty, hunger, and spiralling inflation which gripped Bali during these years. Moreover, in contrast to the scholarly energy devoted to such issues in Java, we do not yet have any meaningful analysis of changing rural relations of production in Bali, of the dynamics of land reform, or their implications for political conflict there.2 The gap in our knowledge is, in part, the result of the continued dominance of a tradition in the study of Bali which emphasizes the significance of culturally specific bases of affiliation rather than those of class. This approach has, I think, helped to obscure the nature of politi cal conflict in this period, and has seriously impaired attempts to understand the internecine violence of 1965/66.3 This article is a revised version of a chapter from my PhD dissertation, 'The Politics of Violence in Modern Bali, 1882-1966," PhD dissertation, Cornell University, 1992. Efektivitas Koalisi Gemuk Parpol Pilkada DKI Jakarta 2012 Achmad Syarkowi Jazuli. Abstrak Pertarungan Jokowi-Ahok dan figur incumbent Fauzi Bowo-Nachrowi dalam pilkada DKI Jakarta tahun 2012 lalu dianggap sebagai toggak penting dalam pemilihan kepala daerah di Indonesia. Kekalahan koalisi gemuk Fauzi Bowo menjadi bukti bahwa oligarki partai dapat dikalahkan sosok Joko Widodo. Dengan menggunakan teori Arennd Ljiphart, dapat diketahui bahwa koalisi gemuk yang dibentuk Fauzi Bowo tidak sekuat koalisi yang diciptakan Joko Widodo. Mesin Partai dalam koalisi gemuk tidak berjalan karena sikap pragmatis partai yang berakiibat keputusan elit partai tidak diikuti kader dan simpatisan. Hasilnya Fauzi Bowo dengan koalisi gemuknya gagal meraup suara diputaran kedua. Kekalahan Fauzi Bowo dapat dilihat bahwa pemilih di Jakarta semakin cerdas karena pudarnya kekuatan partai dalam mempengaruhi pemilih dalam pilkada. Kata kunci : Pilkada, koalisi gemuk, partai politik, oligarki partai Abstract The previous election race between Jokowi-Ahok and the incumbent Fauzi Bowo-Nachrowi on Jakarta governor election on 2012 has made significant turning point on Indonesia’s local election. The failure of the big coalition of Fauzi Bowo has proven that party’s oligharcy system may not work against the the figure of Joko Widodo. Applying Arennd Ljiphard , it is shown that big coalition established by Fauzi Bowo were not as strong as Joko Widodo’s. The political machines within the coalition has not worked as expected due to pragmatic behaviour shown by party elites which in turn has not managed to draw many support among the party loyal followers. The result were the the lost of Fauzi Bowo to win voters on the second round of the election. -

Edited by Edward Aspinall and Gerry van Klinken The state and illegality in Indonesia THE STATE AND ILLEGALITY IN INDONESIA The popular 1998 reformasi movement that brought down President Suharto’s regime demanded an end to illegal practices by state offi cials, from human rights abuse to nepotistic investments. Yet today, such practices have proven more resistant to reform than people had hoped. Many have said corruption in Indonesia is “entrenched”. We argue it is precisely this entrenched character that requires attention. What is state illegality entrenched in and how does it become entrenched? This involves studying actual cases. Our observations led us to rethink fundamental ideas about the nature of the state in Indonesia, especially regarding its socially embedded character. We conclude that illegal practices by state offi cials are not just aberrations to the state, they are the state. Almost invariably, illegality occurs as part of collective, patterned, organized and collaborative acts, linked to the competition for political power and access to state resources. While obviously excluding many without connections, corrupt behaviour also plays integrative and stabilizing functions. Especially at the lower end of the social ladder, it gets a lot of things done and is often considered legitimate. This book may be read as a defence of area studies approaches. Without the insights that grew from applying our area studies skills, we would still be constrained by highly stylized notions of the state, which bear little resemblance to the state’s actual workings. The struggle against corruption is a long-term political process. Instead of trying to depoliticize it, we believe the key to progress is greater popular participation. -

Wieringa (chair) Ms Sri Tunruang (treasurer) Mr Andreas Sungkono (member) General coordinator Ms Nursyahbani Katjasungkana Email addresses [email protected] [email protected] 1 Profile of IPT 1965 The Foundation IPT 1965 was founded by Indonesian exiles living in Europe, Indonesian human rights activists and international researchers and focuses on the crimes against humanity committed in Indonesia after the kidnapping and murder of six generals and one lieutenant in the morning of October 1 1965. None of the perpetrators of these crimes have been brought to justice and the victims of those crimes are still blamed for their own suffering, faced with heavy stigma and social, political and economic deprivations. Meetings of victims’ organizations are routinely disturbed by militias. The Foundation established the People’s Tribunal of the 1965 Crimes Against Humanity which held its hearings on November 10-13 2015 in The Hague, The Netherlands. The final report of the panel of judges was presented in Jakarta and in four other locations worldwide on July 20 2016. The judges concluded that the State of Indonesia was guilty of the crimes against humanity as charged by the team of prosecutors and additionally found that the mass killings fall within the acts enumerated in the 1948 Genocide Convention. -

Published in The European Review of History, 2007, 14 (2), 235-262 The silences and myths of a ‘dirty war’; Coming to terms with the Dutch-Indonesian decolonization war (1945– 1949)1 Stef Scagliola - Erasmus University Rotterdam Listening to discussions about the current ‘wars on terror’ that are being fought in Afghanistan and Iraq, we can hear echoes from the era of our painful European decolonization wars. In the United States too, the legacy of the lost war in Vietnam is recurrent in the discourse of opponents of today’s ‘war on terror’. 2 Just as in the past, the moral legitimacy of a military intervention that is supposed to bring ‘peace and order’ to a country, is today a hotly debated issue. In France and the Netherlands, especially, the memories of the wars that were fought against their former colonies have resulted in an understandable distrust of the words ‘peace and order’.3 Many elderly men and their families know all too well that they are a euphemism for a nerve-racking war which, when compared to conventional wars, has been difficult to represent and remember in a public and coherent way. Another feature familiar from the decolonialization wars is the disagreement between those who believe that military force is the only way to stabilize a country in turmoil and others who see military intervention merely as an aggravation of political unrest. The analogy even relates to the disparity between the warring parties: on the one side the combination of Western imperialism, questionable noble intentions and military might, on the other side an alliance of rebellious parties in a non-Western setting, who, being militarily weak but large in numbers, resort to unconventional warfare. -
