III IV DANKSAGUNG Im Rahmen der Fertigstellung meiner Dissertationsschrift möchte ich mich nochmals bei all denjenigen bedanken, die mich bei deren Umsetzung unterstützt und begleitet haben. Besonderer Dank gilt zunächst meinem Doktorvater, Herrn Prof. Dr. Thomas Mohrs, der für mich nicht nur ein vorbildlicher Professor, sondern mittlerweile auch ein guter Freund geworden ist. Ohne ihn hätte es diese Arbeit nie gegeben, denn durch ihn wurde ich auf eine mögliche wissenschaftliche Auseinandersetzung mit dem Thema Tierethik erst aufmerksam. Leider habe ich im Laufe meiner Studiengänge die Erfahrung machen müssen, dass es viel zu wenige wirklich gute Hochschullehrer an den Universitäten gibt, welche dazu fähig sind, ihre Studenten tatsächlich zu geistigen Eigenleistungen zu motivieren und ihnen dabei nicht nur die eigene Meinung überzustülpen. Die Leidenschaft, mit der er seine Tätigkeit als Hochschullehrer ausübt sowie sein Engagement für die Dinge, die er lehrt und für die er eintritt, als auch der Einsatz für seine Studenten sind dabei wirklich einzigartig. Herr Mohrs ist für mich der lebende Beweis dafür, dass Philosophie nicht nur bloße Theorie ist, sondern in jeder Hinsicht auch wirklich gelebt werden kann. Auch Herrn Prof. Dr. Christian Thies gebührt an dieser Stelle Dank für die bereitwillige Übernahme des Zweitgutachtens. One might argue that these are big ideas, with big ramifications. Although it would be perfectly possible to make good logical arguments against any of them, one wouldn’t want to do that, because if people were to take those arguments seriously and hence stop believing in the desirability or even the existence of liberty, equality and fraternity, the world would change for the worse.

This is evidenced by the rapid growth of journals on the question of the animal within the fields of the humanities and social sciences worldwide.1 Yet also outside the academy animals now seem to preoccupy the popular mindset more than ever before. In 2002, the Netherlands was the first country in the world where a political party was established (the so-called “Partij voor de Dieren” or PvdD: Party for the Animals) that focused predominantly on animal issues. Heated discussions about factory-farming, the related spread of diseases (BSE/Q Fever), hunting and fishing practices, the inbreeding of domestic animals, are now commonplace. Animals, as we tend to call a large range of incredibly diverse creatures, come to us in many different ways. We encounter them as our pets and on our plates, animation movies dominate the charts and artists in sometimes rather experimental genres engage in the question of the animal.2 Globally speaking, animals might be considered key players in the climate debate insofar as the alarming rate of extinction of certain species is often taken to be indicative of our feeble efforts at preserving what is commonly referred to as “nature.” At the same time, these rates serve, albeit indirectly, as a grim reminder of the possible end of human existence itself.

    2. Animal ethics It was started to provide animal welfare and stop cruel practices on animals, for example factory farming, animal testing, using animals for experimentation or for entertainment. In the most of Western philosophy animals were considered as beings without moral standing, namely those that do not have to be included into our moral choices. The very typical example of this approach is the Cartesian one, according to Rene Descartes (1596-1650), animals are just simple machines that cannot experience pain. The philosopher was known for making vivisections on living animals and claiming that none of the animals could feel the pain during this. In consequence of this approach until modern times there were conducted many unnecessary and cruel experiments with animal usage, also animal’s condition at factory farms or in entrainment were terrible. All these practices caused a huge amount of suffering of animals. The approach to animals was changed with Peter Singer’s influential book on Animal Liberation (1975). Singer raised the issue that animals can suffer and amount of suffering that they experience is not worth what we gain from these cruel practices. His argumentation was utilitarian, which is one of the approaches of normative ethics. Deontological and utilitarian argumentation in animal ethics Normative ethics aims at providing moral standards that regulate right and wrong conduct. This may involve articulating the good habits that we should acquire, the duties that we should follow, or the consequences of our behavior on others. The most popular approaches to normative theory are: deonotology and conseqentialism. The word deontology derives from the Greek words for duty (deon) and science (or study) of (logos).

The phrase exactly describes the current status of nonhuman animals. Human slavery therefore presents an enlightening parallel to this situation. We shall explore this parallel in order to single out a past response to human slavery that may suggest a suitable way of responding to present-day animal slavery. Not long ago such a parallel would have been considered outrageous. Recently, however, there has been growing recognition of the claim that a sound ethic must be free of bias or arbitrary discrimination based in favour of our own species. This recognition makes possible a more impartial appraisal of the exploitative practices that mark our civilisation. Slavery in the ancient world has been the subject of a lively debate among historians. How did it arise? Why did it end? Was there a characteristic 'slave mode of production'? We do not need to go into all these disputes. We shall focus instead on the distinctive element of slavery: the fact that the human being becomes property in the strict sense of the term. This is sometimes referred to as 'chattel slavery' - a term that stresses the parallel between the human institution, and the ownership of animals, for the term 'cattle' is derived from 'chattel'. Slave societies are those societies of which chattel slavery is a major feature. They are relatively rare in human history. The best known examples existed in the ancient world, and in North and Central America after European colonisation.

Today they form the theoretical backbone of the animal welfare movement to such an extent that the very subject matter of the ethical-legal status of animals often is referred to using Regan's central concept ‘animal rights’. 2 A significant segment of contemporary academic texts on the ethical-legal status of animals is concerned, however, that the potential of the rights discourse has been exhausted, or at least that a sufficient level of protection of animals cannot be attained solely on this basis. 3 This reflects the fact that the increased use of terms associated with rights appears to have led, at the most, to only moderate changes with regard to the actual level of protection and the underlying ethical-legal status of animals.
