After emerging in 1976 with an era-defining self-titled debut LP and the smoldering hit “More Than a Feeling,” the group became notorious for taking years between albums. This penchant for sonic perfectionism comes from band architect and guitarist Tom Scholz, a gear enthusiast and classically trained pianist who earned a master’s degree in mechanical engineering from MIT before pursuing rock ’n’ roll. In the early ’70s, Scholz’s ambitious musical vision found an equal in Brad Delp, whose octave-jumping, operatic vocal delivery provided dramatic tension on the riff-heavy “Rock & Roll Band” and the bluesy “Smokin’.” Boston followed up their smash debut two years later with Don’t Look Back, which amplified Scholz’s power-pop tendencies and gift for gorgeous melodies; the band’s biggest hit came in 1986 with the chart-topping, tender power ballad “Amanda.” In the ’90s and 2000s, the group experienced multiple lineup changes, including in the vocalist spot upon Delp’s 2007 death. However, Scholz continued on, releasing 2013’s Life, Love & Hope in collaboration with various singers and finding a new audience thanks to frequent tours. And although Boston’s sound is singular, the band’s pristine production values and studio soundscapes have proved to be a model for countless bands across a range of genres, including New Wave icons Tears for Fears, robo-funk duo Daft Punk, and indie-electro stars Tame Impala..

All the smart money was chasing new disco acts based on the success of tunes like The Hustle, and Jive Talkin’ by the Bee Gees. Rock was dead, they all said, and this before Saturday Night Fever brought disco to middle America. But then a band out of Boston (named for the city itself) turned that wisdom on its head. Boston founder Tom Scholz struggled to get a record deal. And even after he signed with Epic, he got nothing but hassle from the label as he fought to release the band’s eponymous debut. Eventually, Scholz prevailed and Boston was released, and it was a massive success. It remains one of the best-selling debut albums in U.S. history, with over 17 million copies sold. Of course, the bandwagon ensued. Boston spawned an entire industry genre (poetically known as Corporate Rock) as music marketing executives scrambled to produce loads of radio-friendly rock for the masses. The corporate rock trend continued throughout the 80s and into the 90s, reaching ridiculous extremes with packaged metal “hair bands.” Then in 1991, 15 years after Boston, history repeated itself. MEMORANDUM OF LAW IN SUPPORT OF DEFENDANT BARRY GOUDREAU’S MOTION FOR COSTS AND ATTORNEY’S FEES PURSUANT TO 15 U.S.C. § 1117(a) Pursuant to the Court’s order (D. 269), defendant BARRY GOUDREAU (“Goudreau”) hereby submits his memorandum of law in support of the above-referenced motion as prevailing party on the Lanham Act claims of plaintiff DONALD THOMAS SCHOLZ (“Scholz”). I. INTRODUCTION This case was never about violation of the Lanham Act. To say otherwise constitutes a failure in honesty to the Court. Putting it bluntly, Scholz’s Lanham Act claims were a sham. The Court disposed of most of those bogus claims on summary judgment, finding a complete lack of evidence. As for the remaining “indirect” infringement claims, ginned up in an amended pleading, there was never any consumer confusion, or even the remotest likelihood of such, in referring to Goudreau’s past participation (whether as “former” or “original” member) in the band BOSTON. There was never any harm to Scholz or his trademarks in doing so. The parties’ goods and services weren’t in competition, and were never likely to be. Lanham Act cases are difficult and complex. That Act has a fee-shifting provision for “exceptional” cases. The Supreme Court has recently provided guidance to the lower courts on how and when that provision should apply.
