The entire Gainesville music scene was built around songs: Top Forty songs on the radio, songs on albums, original songs performed on stage by bands and other musical ensembles. The late sixties was a golden age of rock and pop music and the rise of the rock band as a musical entity. As the counterculture marched for equal rights and against the war in Vietnam, a sonic revolution was occurring in the recording studio and on the concert stage. New sounds were being created through multitrack recording techniques, and record producers such as Phil Spector and George Martin became integral parts of the creative process. Musicians expanded their sonic palette by experimenting with the sounds of sitar, and through sound-modifying electronic ef- fects such as the wah-wah pedal, fuzz tone, and the Echoplex tape-de- lay unit, as well as a variety of new electronic keyboard instruments and synthesizers. The sound of every musical instrument contributed toward the overall sound of a performance or recording, and bands were begin- ning to expand beyond the core of drums, bass, and a couple guitars. -

Brown, Advisor Between 1984 and 1991, heavy metal became one of the most publicly popular and commercially successful rock music subgenres. The focus of this dissertation is to explore the following research questions: How did the subculture of heavy metal music between 1984 and 1991 evolve and what meanings can be derived from this ongoing process? How did the contextual circumstances surrounding heavy metal music during this period impact the performative choices exhibited by artists, and from a position of retrospection, what lasting significance does this particular era of heavy metal merit today? A textual analysis of metal- related materials fostered the development of themes relating to the selective choices made and performances enacted by metal artists. These themes were then considered in terms of gender, sexuality, race, and age constructions as well as the ongoing negotiations of the metal artist within multiple performative realms. Occurring at the juncture of art and commerce, heavy metal music is a purposeful construction. Metal musicians made performative choices for serving particular aims, be it fame, wealth, or art. These same individuals worked within a greater system of influence. Metal bands were the contracted employees of record labels whose own corporate aims needed to be recognized. -

Having played the instru- ment for, then, almost two decades, I thought that a novelist would not, could not, feature specialty instruments such as the C-melody sax if he did not play the horn himself. Once the saxophone had caught my attention, I noticed all sorts of uncommon references that seemed to confirm my hunch that Thomas Pynchon himself played the instrument: McClintic Sphere’s 4½ reed, the contra- bass sax of Against the Day, Gravity’s Rainbow’s Charlie Parker passage. -

MEMORANDUM OF LAW IN SUPPORT OF DEFENDANT BARRY GOUDREAU’S MOTION FOR COSTS AND ATTORNEY’S FEES PURSUANT TO 15 U.S.C. § 1117(a) Pursuant to the Court’s order (D. 269), defendant BARRY GOUDREAU (“Goudreau”) hereby submits his memorandum of law in support of the above-referenced motion as prevailing party on the Lanham Act claims of plaintiff DONALD THOMAS SCHOLZ (“Scholz”). I. INTRODUCTION This case was never about violation of the Lanham Act. To say otherwise constitutes a failure in honesty to the Court. Putting it bluntly, Scholz’s Lanham Act claims were a sham. The Court disposed of most of those bogus claims on summary judgment, finding a complete lack of evidence. As for the remaining “indirect” infringement claims, ginned up in an amended pleading, there was never any consumer confusion, or even the remotest likelihood of such, in referring to Goudreau’s past participation (whether as “former” or “original” member) in the band BOSTON. There was never any harm to Scholz or his trademarks in doing so. The parties’ goods and services weren’t in competition, and were never likely to be. Lanham Act cases are difficult and complex. That Act has a fee-shifting provision for “exceptional” cases. The Supreme Court has recently provided guidance to the lower courts on how and when that provision should apply. -

Tight leather pants, lots of mascara, black (definitely not blond) hair, and she would have to play guitar like Chuck Berry’s long-lost daughter. She wouldn’t look like Madonna or Taylor Swift. Maybe she would look something like Ronnie Spector, a little formidable and dangerous, definitely - androgynous, for sure. In fact, if you close your eyes and think about it, she would be the spitting image of Joan Jett. ^ Jett has always brought danger, defiance, and fierceness to rock & roll. Along with the Blackhearts - Jamaican slang for loner - she has never been afraid to explore her own vulnerabilities or her darker sides, or to speak her mind. It wouldn’t be going too far to call Joan Jett the last American rock star, pursuing her considerable craft for the right reason: a devo tion to the true spirit of the music. UNIVERSITY OF CALIFORNIA Los Angeles Masks in Disguise: Exposing Minstrelsy and Racial Representation within American Tap Dance Performances of the Stage, Screen, and Sound Cartoon, 1900-1950 A dissertation submitted in partial satisfaction of the requirements for the degree Doctor of Philosophy in Culture and Performance by Brynn Wein Shiovitz 2016 © Copyright by Brynn Wein Shiovitz 2016 ABSTRACT OF THE DISSERTATION Masks in Disguise: Exposing Minstrelsy and Racial Representation within American Tap Dance Performances of the Stage, Screen, and Sound Cartoon, 1900-1950 by Brynn Wein Shiovitz Doctor of Philosophy in Culture and Performance University of California, Los Angeles, 2016 Professor Susan Leigh Foster, Chair Masks in Disguise: Exposing Minstrelsy and Racial Representation within American Tap Dance Performances of the Stage, Screen, and Sound Cartoon, 1900-1950, looks at the many forms of masking at play in three pivotal, yet untheorized, tap dance performances of the twentieth century in order to expose how minstrelsy operates through various forms of masking. The three performances that I examine are: George M. Cohan’s production of Little Johnny ii Jones (1904), Eleanor Powell’s “Tribute to Bill Robinson” in Honolulu (1939), and Terry- Toons’ cartoon, “The Dancing Shoes” (1949). These performances share an obvious move away from the use of blackface makeup within a minstrel context, and a move towards the masked enjoyment in “black culture” as it contributes to the development of a uniquely American form of entertainment. In bringing these three disparate performances into dialogue I illuminate the many ways in which American entertainment has been built upon an Africanist aesthetic at the same time it has generally disparaged the black body.
