PERFORMED IDENTITIES: HEAVY METAL MUSICIANS BETWEEN 1984 AND 1991 Bradley C. Klypchak A Dissertation Submitted to the Graduate College of Bowling Green State University in partial fulfillment of the requirements for the degree of DOCTOR OF PHILOSOPHY May 2007 Committee: Dr. Jeffrey A. Brown, Advisor Dr. John Makay Graduate Faculty Representative Dr. Ron E. Shields Dr. Don McQuarie © 2007 Bradley C. Klypchak All Rights Reserved iii ABSTRACT Dr. Jeffrey A. Brown, Advisor Between 1984 and 1991, heavy metal became one of the most publicly popular and commercially successful rock music subgenres. The focus of this dissertation is to explore the following research questions: How did the subculture of heavy metal music between 1984 and 1991 evolve and what meanings can be derived from this ongoing process? How did the contextual circumstances surrounding heavy metal music during this period impact the performative choices exhibited by artists, and from a position of retrospection, what lasting significance does this particular era of heavy metal merit today? A textual analysis of metal- related materials fostered the development of themes relating to the selective choices made and performances enacted by metal artists. These themes were then considered in terms of gender, sexuality, race, and age constructions as well as the ongoing negotiations of the metal artist within multiple performative realms. Occurring at the juncture of art and commerce, heavy metal music is a purposeful construction. Metal musicians made performative choices for serving particular aims, be it fame, wealth, or art. These same individuals worked within a greater system of influence. Metal bands were the contracted employees of record labels whose own corporate aims needed to be recognized.

The CD is compiled from at least 3 different performances and while I found the sound to be adequate to mediocre, the quality of their material does seem to shine through. While I wouldn’t put the band in my own personal Top 10 of 1970’s rockers, they are pretty good. I think it is a shame I wasn’t musically aware in the 70’s because I probably would have liked the band. They’ve got a lively and energetic sound tied to that particular era and it does keep the ears engaged, even during the first half of the disc where the quality of the recording isn’t even as good as some bootlegs I’ve listened to over the years. The audio quality is the biggest problem I had with the entire disc. I think if you are going to reissue this type of album, you really need to make the sound more Official Site presentable than what a typical bootlegger could accomplish. You want to check out tracks like “Detroit Girls”, “Any Way That You Want It”, and “Cherry Baby” in particular, but surprisingly at least to me, each song is pretty good. Search Amazon: If you like the 70’s rock era, you probably know of the band. You’ll definitely like this release.

Honestly. with Dave Rose and Doug Van Pelt © 2014 Big3 Records ONE I drink. Occasionally I smoke. If you ask my wife, my kids, my tech, my agent or my manager they'll all tell you that I curse more than I should. I've fooled around with women on tour buses. I’ve been arrested for indecent exposure. I've been reckless with money to the point of bankruptcy. My favorite bands are The Beatles, Van Halen and Judas Priest. I was pissed at God when my wife died of cancer and I despise religion. I am a Christian. I'm Michael Sweet. I’m a singer, guitarist, songwriter, producer and a founding member of the pioneering Christian rock band Stryper. We've sold almost 10 million records to date and were the first Christian band to air on MTV, and to have four #1 videos. We even had two top-10 videos at the same time, back when MTV actually played music videos. We've played soccer stadiums and biker bars, sometimes in the same week. Despite having done all of that, I'm still often known as the Bible-Tossing- Yellow & Black-Bumble-Bee guy. The Jesus guy. The 80's hair/glam Christian metal guy. An irrelevant joke. Or, even worse-- sometimes I'm not known at all. So who am I? I'm a guy that grew up in Southern California – sort of a surf punk kind of guy who absolutely loved music.

Having played the instru- ment for, then, almost two decades, I thought that a novelist would not, could not, feature specialty instruments such as the C-melody sax if he did not play the horn himself. Once the saxophone had caught my attention, I noticed all sorts of uncommon references that seemed to confirm my hunch that Thomas Pynchon himself played the instrument: McClintic Sphere’s 4½ reed, the contra- bass sax of Against the Day, Gravity’s Rainbow’s Charlie Parker passage.

  • We Are Very Proud to Have You on Greek Rebels, We Believe That You
We are very proud to have you on Greek Rebels, we believe that you are actually one of the 'hot' names out there in the European hard rock scene nowadays, so thank you very much for your time. We also have recently reviewed your new project, under the name Nordic Union, which is a really cool album. What is the reception so far, from the media, the fans? Are you satisfied with it? I would say, the reception has been fantastic, its phenomenal to be honest. The reviews are great, it's even getting airplay on the radio, it's getting on the charts, even the mainstream medias in Sweden are picking it up and writing about it. I never ever experienced that they write about something like this. Yes, I just saw that you posted that you are on nu. 4 or nu. 5 on the Swedish hard rock charts today, which is really good. You never had any prior success on the charts with your other bands or projects? Yes, with Eclipse and with W.E.T. we actually went to nu.1, a couple of years ago. If it wasn't, well I mean, that almost the same day Dream Theater released their album, just one week earlier Megadeth and Avantasia the same day, there are so many good bands and big names. If we would have released it a month later, maybe the competition would not have been so big, maybe we could have landed on nu. 1 Yes, so I wanted to ask you, you have collaborated for Nordic Union with a very big singer, Ronnie Atkins.

Case 1:13-cv-10951-DJC Document 275 Filed 12/15/16 Page 1 of 22 UNITED STATES DISTRICT COURT DISTRICT OF MASSACHUSETTS DONALD THOMAS SCHOLZ, Plaintiff and Defendant-in-Counterclaim, v. Civil Action No. 1:13-cv-10951-DJC BARRY GOUDREAU, Defendant and Plaintiff-in-Counterclaim. MEMORANDUM OF LAW IN SUPPORT OF DEFENDANT BARRY GOUDREAU’S MOTION FOR COSTS AND ATTORNEY’S FEES PURSUANT TO 15 U.S.C. § 1117(a) Pursuant to the Court’s order (D. 269), defendant BARRY GOUDREAU (“Goudreau”) hereby submits his memorandum of law in support of the above-referenced motion as prevailing party on the Lanham Act claims of plaintiff DONALD THOMAS SCHOLZ (“Scholz”). I. INTRODUCTION This case was never about violation of the Lanham Act. To say otherwise constitutes a failure in honesty to the Court. Putting it bluntly, Scholz’s Lanham Act claims were a sham. The Court disposed of most of those bogus claims on summary judgment, finding a complete lack of evidence. As for the remaining “indirect” infringement claims, ginned up in an amended pleading, there was never any consumer confusion, or even the remotest likelihood of such, in referring to Goudreau’s past participation (whether as “former” or “original” member) in the band BOSTON. There was never any harm to Scholz or his trademarks in doing so. The parties’ goods and services weren’t in competition, and were never likely to be. Lanham Act cases are difficult and complex. That Act has a fee-shifting provision for “exceptional” cases. The Supreme Court has recently provided guidance to the lower courts on how and when that provision should apply.
