The arena rock band behind one of the fastest-selling debut albums in history, Boston was essentially the vehicle of guitarist and studio wizard Tom Scholz, born March 10, 1947 in Toledo, Ohio. A rock fan throughout his teen years, he began writing songs while earning a master’s degree at the Massachusetts Institute of Technology. After graduation, he began work for Polaroid, and set about constructing his own 12-track recording studio in the basement of his home, where Scholz and vocalist Brad Delp recorded demos that earned them a contract with Epic in 1975. Although some recording and overdubs were later done in Los Angeles, the 1976 release of Boston consisted largely of tapes recorded in Scholz’s basement. (By then, the lineup had coalesced around Scholz, Delp, guitarist Barry Goudreau, bassist Fran Sheehan, and drummer John “Sib” Hashian.) Boston spawned three hit singles (“More Than a Feeling,” “Long Time,” and “Peace of Mind”), and shot immediately to the top of the charts, remaining the best-selling pop debut effort in history before it was supplanted by Whitney Houston’s first album in 1986. ― Allmusic. All the smart money was chasing new disco acts based on the success of tunes like The Hustle, and Jive Talkin’ by the Bee Gees. Rock was dead, they all said, and this before Saturday Night Fever brought disco to middle America. But then a band out of Boston (named for the city itself) turned that wisdom on its head. Boston founder Tom Scholz struggled to get a record deal. And even after he signed with Epic, he got nothing but hassle from the label as he fought to release the band’s eponymous debut. Eventually, Scholz prevailed and Boston was released, and it was a massive success. It remains one of the best-selling debut albums in U.S. history, with over 17 million copies sold. Of course, the bandwagon ensued. Boston spawned an entire industry genre (poetically known as Corporate Rock) as music marketing executives scrambled to produce loads of radio-friendly rock for the masses. The corporate rock trend continued throughout the 80s and into the 90s, reaching ridiculous extremes with packaged metal “hair bands.” Then in 1991, 15 years after Boston, history repeated itself. A band from Seattle did something that wasn’t supposed to work. 2 THE NEW RAINMAKER: WHY THE KEY TO BUSINESS SUCCESS IS MEDIA, NOT MARKETING If you owned Nirvana’s first album Bleach, and someone told you this act would become the biggest band in the word and dominate the radio waves with their next work, you’d have laughed.

MEMORANDUM OF LAW IN SUPPORT OF DEFENDANT BARRY GOUDREAU’S MOTION FOR COSTS AND ATTORNEY’S FEES PURSUANT TO 15 U.S.C. § 1117(a) Pursuant to the Court’s order (D. 269), defendant BARRY GOUDREAU (“Goudreau”) hereby submits his memorandum of law in support of the above-referenced motion as prevailing party on the Lanham Act claims of plaintiff DONALD THOMAS SCHOLZ (“Scholz”). I. INTRODUCTION This case was never about violation of the Lanham Act. To say otherwise constitutes a failure in honesty to the Court. Putting it bluntly, Scholz’s Lanham Act claims were a sham. The Court disposed of most of those bogus claims on summary judgment, finding a complete lack of evidence. As for the remaining “indirect” infringement claims, ginned up in an amended pleading, there was never any consumer confusion, or even the remotest likelihood of such, in referring to Goudreau’s past participation (whether as “former” or “original” member) in the band BOSTON. There was never any harm to Scholz or his trademarks in doing so. The parties’ goods and services weren’t in competition, and were never likely to be. Lanham Act cases are difficult and complex. That Act has a fee-shifting provision for “exceptional” cases. The Supreme Court has recently provided guidance to the lower courts on how and when that provision should apply.

CHP systems are more complex involving increased attention to atmospheric emissions and electric grid interconnection and sophisticated control logic. This study focuses on four specific buildings: a San Francisco hotel retrofitted with a “packaged” microturbine generator/double-effect chiller plant; a Los Angeles casino retrofitted with an advanced reciprocating engine, hot water heat recovery and a single-effect absorption chiller; a Brooklyn laundry retrofitted with two reciprocating engine generators and a hot water heat recovery system; and finally a state-of-the-art hospital in Austin, TX with a combustion turbine, heat recovery steam generator, absorption and electric chillers and thermal storage. These case studies provide design insight, identify commissioning issues and lessons learned from the initial operation. The author’s takeaway from this brief study is that there is a need to establish a set of commissioning best practices for CHP systems. INTRODUCTION Commissioning CHP systems in commercial and institutional buildings requires broad experience covering small power plant systems (less than 25 MW), heat recovery, thermally activated technologies, electric switchgear, grid interconnection operation and safety, sound and vibration, emissions control as well as building, mechanical and electrical systems integration.

Tickets go on sale to the public on Tuesday, May 24. In his younger days, Randall Hall attended the infamous Monkees tour where the legendary Jimi Hendrix was the opening act. While most attendees were busy booing Hendrix off stage, the former Monkees fan was entranced and decided heavy riffing was the way to go. Adding in the Southern flavor of the Allman Brothers, Randall formed his first band, Running Easy, in 1971. In 1987, Randall was asked to take the place of Allen Collins in Lynyrd Skynyrd after Collins’ paralyzing car accident. He remained a member of the band until 1994. Fran Cosmo exploded onto the rock scene when he took over for Brad Delp as the lead singer of Boston in 1992. Fran was featured as the lead vocalist on the “Walk On” album, which sold over one million copies worldwide. Prior to his success as the lead singer of Boston, he was the lead singer and song co-writer for both “Orion the Hunter” and Barry Goundreau albums. Fran Cosmo is known for his high-energy and outstanding vocal range on Boston songs that very few, if any, can perform.
