(Irak), de nationalité irakienne, demeurant actuellement à L-….., tendant à la réformation de la décision du ministre de l’Immigration et de l’Asile du 12 mai 2017 portant refus de faire droit à sa demande en obtention d’une protection internationale et de la décision du même ministre du même jour portant ordre de quitter le territoire contenu dans le même acte ; Vu le mémoire en réponse du délégué du gouvernement déposé au greffe du tribunal administratif en date du 9 août 2017 ; Vu les pièces versées en cause et notamment les décisions critiquées ; Le juge rapporteur entendu en son rapport, ainsi que Maître Shirley Freyermuth, en remplacement de Maître Ardavan Fatholahzadeh et Madame le délégué du gouvernement Stéphanie Linster en leurs plaidoiries respectives à l’audience publique du 26 février 2018. Le 14 octobre 2015, Monsieur ..... introduisit auprès du service compétent du ministère des Affaires étrangères et européennes, direction de l’Immigration, ci-après désigné par « le ministère », une demande de protection internationale au sens de la loi modifiée du 5 mai 2006 relative au droit d’asile et à des formes complémentaires de protection, entretemps abrogée par la loi du 18 décembre 2015 relative à la protection internationale et à la protection temporaire, ci-après désignée par « la loi du 18 décembre 2015 ». Le même jour, Monsieur ..... fut entendu par un agent de la police grand-ducale, section police des étrangers et des jeux, sur son identité et l’itinéraire suivi pour venir au Luxembourg. Le 9 novembre 2015, Monsieur .... fut entendu par un agent du ministère en vue de déterminer l’Etat responsable de l’examen de sa demande de protection internationale en vertu du règlement (UE) 604/2013 du Parlement européen et du Conseil du 26 juin 2013 établissant les critères et mécanismes de détermination de l’Etat membre responsable de l’examen d’une demande de protection internationale introduite dans l’un des Etats membres par un ressortissant de pays tiers ou un apatride, dit « règlement Dublin III ». 1 Le 2 octobre 2016, Monsieur ..... fut encore entendu par un agent du ministère sur sa situation et sur les motifs se trouvant à la base de sa demande de protection internationale. Par décision du 12 mai 2017, le ministre de l’Immigration et de l’Asile, dénommé ci- après « le ministre », informa Monsieur ..... qu’il avait rejeté sa demande de protection internationale comme étant non fondée, tout en lui ordonnant de quitter le territoire dans un délai de trente jours. Ladite décision est libellée de la façon suivante : « (…) J'ai l'honneur de me référer à votre demande en obtention d'une protection internationale que vous avez déposée auprès du service compétent du Ministère des Affaires étrangères et européennes en date du 14 octobre 2015. I . Quant à vos déclarations auprès du Service de Police Judiciaire En mains le rapport du Service de Police Judiciaire du 14 octobre 2015. Il ressort dudit rapport que vous êtes entré de façon illégale dans l’Union européenne. Vous vous seriez rendu d’Arbil à Istanbul en avion. Sur place, vous auriez trouvé un passeur et vous lui auriez payer une somme de 2400 dollars. Ensuite vous auriez été amené à Izmir et de là, vous auriez été conduit sur une plage. Vous auriez navigué sur l’île de Kos à bord d'un bateau pneumatique. Arrivé en Grèce, vous auriez continué votre périple en passant par la Macédoine, la Serbie, la Croatie, la Hongrie, l'Autriche et l'Allemagne. Par la suite, vous vous seriez rendu au Luxembourg à bord d'un train. Vous énoncez en outre que vous auriez quitté votre pays d'origine, parce que vous auriez été enlevé par des milices et que la police vous aurait libéré. La raison de l’enlèvement serait que vous et votre père détiendriez une société et que vous auriez travaillé pour les Américains. Par conséquent, vous vous sentiriez menacé. Vous présentez une carte d'identité irakienne. II. Quant à vos déclarations auprès du Service des Réfugiés En mains le rapport d'entretien Dublin III du 9 novembre 2015 et le rapport d'entretien de l'agent du Ministère des Affaires étrangères et européennes du 2 octobre 2016 sur les motifs sous-tendant votre demande de protection internationale, ainsi les documents versés à l’appui de votre demande de protection internationale. Monsieur, il résulte de vos déclarations que vous auriez quitté votre pays d’origine pour des raisons bien précises, à savoir : Des prétendues menaces par une soi-disant milice : Vous énoncez que vous seriez de profession entrepreneur et que vous auriez travaillé au sein de deux entreprises « .....». Vous précisez que ces sociétés auraient été créées par votre père et votre oncle, mais que le capital serait au nom de votre père (p.4&5/12 du rapport d'entretien du 2 octobre 2016). 2 Vous poursuivez en invoquant que vous auriez travaillé pour le compte des Américains « Du jour où l'Etat a été déchu, jusqu'à fin 2012 » (p.5/12). Vous expliquez qu'après le départ des troupes américaines, vous auriez commencé à travailler pour le compte de l'Etat irakien. Vous auriez accepté plusieurs projets, mais après un certain temps l'Etat n'aurait plus été en mesure de financer ces derniers. Suite à l'arrêt des projets, vous n'auriez pas pu récupérer vos investissements et de plus, l’Etat aurait « commencé à nous réclamer des sommes d'argents » (p.4/12). Vous mettez en avant qu’« ils » auraient commencé à proférer des « menaces de mort et d'enlèvement » à votre encontre (p.4/12). Par la suite vous précisez qu'il s'agirait de l'armée du Mahdi, qui vous aurait « visé personnellement » (p.5/12). Vous mentionnez que votre père aurait pronostiqué les soucis futurs et vous aurait incité à quitter votre pays. Vous avancez que votre frère se serait marié afin de pouvoir partir aux Etats-Unis. Peu après, vous vous seriez rendu en Egypte pour « essayer la vie là-bas, voir s'il y avait moyen de travailler ». Vous y seriez allé en date du 2 août 2015 et vous ne seriez resté que jusqu'au 11 août 2015 (p.4/12). Après votre retour en Irak, en date du 25 août 2015, une voiture vous aurait coupé le chemin entre ..... et ...... Vous auriez refusé de vous arrêter et les individus dans la voiture en question auraient commencé à tirer sur la vôtre. Vous auriez pris la fuite en conduisant auprès de vos proches qui habiteraient « ..... ». Vous affirmez qu'il s'agirait d'une tribu et que par conséquent vos assaillants n'auraient pas pu vous suivre dans cette région (p.4/12). Suite à cet incident vous auriez décidé de quitter votre pays d'origine et vous vous seriez rendu en avion de Najaf à Istanbul en date du 19 septembre 2015 (p.4/12). Pour étayer vos dires, vous avez déposé les documents suivants : - 39 photos diverses - une copie du passeport de votre père - 5 copies contenant des bilans comptables - une copie du certificat de nationalité de votre père - des copies de l'acte de mariage de votre frère ..... - une copie de la carte d'identité de votre frère ..... - une copie d'un certificat d'appréciation pour la société « .....» - une copie d'un certificat d'appréciation pour la société « …. » - une copie d'un certificat de présence « Contracting With The U.S. Government » Enfin, il ressort du rapport d'entretien du 2 octobre 2016 qu'il n'y a plus d'autres faits à invoquer au sujet de votre demande de protection internationale et aux déclarations faites dans ce contexte. III. Analyse ministérielle en matière de Protection internationale En application de la loi précitée du 18 décembre 2015, votre demande de protection internationale est évaluée par rapport aux conditions d'obtention du statut de réfugié et de celles d'obtention du statut conféré par la protection subsidiaire. Soulignons dans ce contexte que l'examen et l’évaluation de votre situation personnelle ne se limitent pas à la pertinence des faits allégués, mais qu'il s'agit également d'apprécier la valeur des éléments de preuve et la crédibilité de vos déclarations. 3 1. Quant à la Convention de Genève Il y a d'abord lieu de relever que la reconnaissance du statut de réfugié n'est pas uniquement conditionnée par la situation générale du pays d'origine, mais aussi et surtout par la situation particulière du demandeur qui doit établir, concrètement, que sa situation individuelle est telle qu'elle laisse supposer une crainte fondée de persécution au sens de la Convention de Genève de 1951 relative au statut des Réfugiés. Rappelons à cet égard que l'octroi du statut de réfugié est soumis à la triple condition que les actes invoqués soient motivés par un des critères de fond définis à l'article 2 a) de la loi 18 décembre 2015, que ces actes soient d'une gravité suffisante au sens de l'article 42(1) de la prédite loi, et qu'ils émanent de personnes qualifiées comme acteurs aux termes de l'article 39 de la loi susmentionnée.

    Backgrounder #38 Asaib Ahl al‐Haq and the Khazali Special Groups Network By Marisa Cochrane, Research Manager, Institute for the Study of War January 13, 2008 Introduction Multi‐National Force‐Iraq has identified various Shia extremist groups operating in Iraq, often using the label Special Groups or Secret Cells (first described in a press conference on July 2, 2007). MNF‐I named Asaib Ahl al‐Haq (AAH, or the League of the Righteous) as an active group on August 19, 2008 and released information that AAH is “affiliated” with Special Groups. This paper evaluates how the two groups are affiliated by testing four hypotheses about the relationship between the Special Groups network, led at one time by Qais Khazali, and Asaib Ahl al‐Haq (League of the Righteous): 1) Asaib Ahl al‐Haq (AAH) is the same as the Khazali Special Groups Network (referred hereafter as Special Groups or SGs); 2) AAH was an affiliate of SGs in 2006 and its successor after Khazali’s arrest in early 2007; 3) AAH was an affiliate of SGs in 2006 and remains so today; and 4) AAH is not related to SGs. After a brief description of Special Groups and AAH, this paper will explore the evidence in support of each hypothesis. The first two hypotheses are most plausible given what is known about these two groups. Because the evidence is ample but indirect, the paper will list the assumptions or qualifications required for each of these hypotheses to be true. Since widespread violence erupted in 2003, they have been increasingly caught in the crossre, killed, wounded or driven from their homes. As their menfolk have been killed or taken way in large numbers, the entire burden of running the household has been suddenly thrust upon them. "Regardless of the circumstance of loss, the mere fact that there is no traditional breadwinner directly aects the family's nancial situation," says Caroline Douilliez, head of the ICRC's Women and War programme in Iraq. "The ICRC's observations across Iraq have led us to the distressing conclusion that the lack of regular and sucient income over the years has cast a huge number of families into severe poverty." According to ICRC estimates, between one and two million households in Iraq today are headed by women. This gure includes women whose husbands are either dead, missing (some since as far back as 1980) or detained. Divorced women are also taken into account. All these women were wives at one point in time, and today remain mothers to their children and daughters to their parents, and sometimes ultimately breadwinners and caregivers for all these people. Without a male relative, they lack economic, physical and social protection and support.

    The Biopolitics of Baghdad: Counterinsurgency and the counter-city Derek Gregory Department of Geography University of British Columbia at Vancouver The cultural turn and late modern war Many of the problems that the United States has faced since its invasion of Iraq in 2003 can be traced back to a reluctance by the Bush administration to use two words, and a failure to plan and prepare for either of them: occupation and insurgency. The two are of course connected; people don’t like living under military occupation. While American troops did not find the streets of Baghdad strewn with the promised rose petals, they did find them full of people. Yet prevailing models of urban warfare had visualized enemy cities as targets and as object-spaces – three-dimensional geometries of buildings, streets and utility networks – emptied of their populations. "The ICRC's observations across Iraq have led us to the distressing conclusion that the lack of regular and sucient income over the years has cast a huge number of families into severe poverty." According to ICRC estimates, between one and two million households in Iraq today are headed by women. This gure includes women whose husbands are either dead, missing (some since as far back as 1980) or detained. Divorced women are also taken into account. All these women were wives at one point in time, and today remain mothers to their children and daughters to their parents, and sometimes ultimately breadwinners and caregivers for all these people. Without a male relative, they lack economic, physical and social protection and support.

    Baghdad Governorate Profile November 2010 Overview Baghdad is home to the largest share of Iraq’s population, the vast majority of which live in the capital city of the same name. The city, whose name literally means “city of peace”, was the centre of the Islamic empire during the Abbasid period from 762 AD until its sacking by the Mongols in 1258 AD. Sadr City (Thawra 1 and 2), also in Baghdad city, became a hub for followers of Shi’ite leader Moqtada Al-Sadr’s Al Mehdi Army following the Multi National Forces (MNF-I) invasion in 2003. There was intense fighting between the Al Mehdi Army and joint Iraqi Security Force and MNF-I forces in Sadr City between March and May 2008. Numbers of security incidents in Baghdad decreased significantly during the second half of 2008, with an average of five security incidents occurring per day from October to December 2009, compared to 48 per day between August and October 2007. The improved security situation may provide a more conducive environment for foreign and domestic investment, but major improvements to dilapidated communications, electricity, tourism, industrial and transport infrastructure are required to facilitate economic growth and sustainable job creation. The unemployment rate (12%) in the governorate is below the national average of 15%, but there are large numbers of unemployed youth in urban areas. Baghdad governorate is the closest to meeting the nationalized set of Demographics Millennium Development Goals by 2015.
