William Henry Ramsbottom, 'Rammie', as we affectionately knew him, is no more. A man has passed away who has sat on the Transvaal Bench for more than twenty years, and who has graced this Court with his noble personality, his innate goodness, his brilliant mind and his untiring energy. There is not one of the brotherhood of the Law, be he attorney, advocate or judge who did not have the highest regard and respect for his outstanding qualities. In all those long years he never once swerved from the path of duty and justice, or from any task that presented itself on that difficult road. When the guilt or innocence of a fellow human being was at stake he would with infinite patience and care explore every possible relevant fact and feature of the case. No sentence was ever imposed by him without anxious and solicitous consideration. In civil disputes he painstakingly investigated every issue and applied a superb reasoning power to the solution of every problem. He knew no exhaustion or weariness, the hours of the day merging with the hours of night to produce that long array of sound decisions reported in the Law Reports and many more, hidden away in the records of this Court. He was a man completely dedicated to the Law irresistably compelled to discover what is true and possessing the fortitude to practice what is good. His elevation to the Appeal Court was inevitable, although regrettably delayed. 4 And now his death has deprived the Appeal Court, and South Africa, of a great judge whose period of office in Bloemfontein was all too short. To his widow and children we extend our very sincere sympathy in their grievous loss. Ramsbottom J will live on in our legal system and his voice will speak to us through his reported decisions. 'Rammie' will live in our hearts for as long as we shall live. 5 HULDEBLYK - DOK BEYERS 1973 Ons het vanoggend hier byeengekom om die laaste hulde te bring aan ‘n oud-kollega van ons, David Otto Kellner Beyers, algemeen bekend as Otto Beyers. In Januarie van hierdie jaar het hy liggaamlik finaal heengegaan. Liggaamlik, omdat hy ons reeds meer as ses jaar gelede, in 1967, geestelik moes verlaat. Hoewel hy destyds ‘n operasie na ‘n swaar breinbloeding oorleef het, was daar ongelukkig geen sinvolle kommunikasie met hom meer moontlik nie en dit het ook ‘n swaar taak van verpleging en versorging op sy vrou Jean geplaas. By die uitvoering van hierdie taak, wat sy tuis sonder murmerering en met blymoedige oorgawe vervul het, het sy die essens van die ewig-vroulike, nl dienswilligheid, lydingsaanvaarding en stille optimisme, soos ‘n blinkende ster laat uitstraal. Vir ons wat Otto Beyers soms besoek het, het die aanskouing van hom soos ‘n pyl deur ons harte geboor en daarom kan ons nie nalaat nie om vir dit, wat sy vrou oor die jare vir hom gedoen het, ook aan haar hulde te bring met die nugtere wete dat sy finale heengaan ‘n verlies sowel as ‘n verlossing was. Otto Beyers is in 1909 in die Oranje-Vrystaat gebore. Hy was ‘n kleinseun van dr B O Kellner, ‘n bekende gewese burgemeester van Bloemfontein, en hy was ook verwant aan etlike bekende gewese regters. Hy het aan die Rondebosch Hoërskool gematrikuleer en in Kaapstad in die regte gestudeer. In 1932 het hy in Pretoria as advokaat begin praktiseer, in die donker depressiejare, toe heelwat advokate die Balie verlaat het. Met geduld en kalme objektiwiteit het hy ‘n bestendige praktyk verwerf en in 1949 KC geword. In 1951 is hy aangestel tot regter in die destydse Griekwaland-Wes Plaaslike Afdeling. In 1952 was hy lid van die Tiende Afbakeningskommissie en in 1955 het hy Regter-President geword van die Oranje-Vrystaatse Provinsiale Afdeling. Hierdie amp het hy nie lank beklee nie, want in 1956 is hy tot Appèlregter aangestel. In die ry van karakters op die regbank het hy weens sy persoonlikheid ‘n eiesoortige plek ingeneem wat reeds in sy jonger jare in die vooruitsig gestel is. As sportman het hy uitgeblink in 6 die robuuste spel van Rugby, maar nie as vuisslanerige voorspeler of laagduikerige senter nie maar meer as ‘n veilige heelagter, met sekure stelskoppe waarvoor hy bekend was. Hy het sowel vir die Westelike Provinsie as vir die Transvaal, as provinsie, gespeel – ‘n nie geringe prestasie nie. In heel ander verband roep die naam Beyers onbewus enkele persone in herinnering wat kampvegters was. So was daar die onsterflike Boeregeneraal, Christiaan Beyers, vegter vir sy ideaal tot die bitter einde, toe hy gedurende die rebellie verdrink het. Daar was ook die eerste Beyers wat appèlregter was, en wat ‘n kampvegter was vir die Afrikaanse taal wat in sy tyd in die hooggeregshowe met afwesigheid van enige agting bejeën is. Otto Beyers was geen kampvegter nie. Hy was ‘n man van vrede, maar tog, vir dié wat hom geken het, ‘n man met diepliggende vaste beginsels. Kampvegters op velerlei gebied sal en moet daar altyd wees maar daar moet ook mense wees wat salf op die wonde lê. Daarom word daar oa in die Bergpredikasie gesê: ‘Salig is die vredemakers.’ Otto Beyers het die mensheid liefgehad en daarom verdraagsaam deur die lewe gegaan, sonder vyand, met gulle gasvryheid en omring van vriende waar hy ookal gewoon het. Sy sin vir humor het hom ‘n gesogte geleentheidsspreker gemaak, selfs buite die kring van sy regsvriende.
