LOCAL GOVERNMENT ENHANCEMENT SECTOR PROJECT – Additional Financing (ADB Loan No. 3431 SRI)

1) EXECUTIVE SUMMARY

This Semi-Annual Social Safeguards Monitoring Report for the Local Government Enhancement Sector Project - (Additional Financing) of Sri Lanka covers the period from January to June 2020. The results of the resettlement screening and the Due Diligence Reports (Social Safeguard) prepared for the proposed subprojects concluded that, as per ADB Safeguard Policy Statement, the sub projects are categorized as ‘C’ for both Involuntary Resettlement and Indigenous Peoples. There will be no either resettlement impacts or temporary disruption of livelihood of any household or group of community in the project area during design and construction periods. Hence, it can be concluded that sub-projects of the Project do not have significant social safeguard issues.

All the subprojects comply with the concerned laws and regulations of Sri Lanka. The screening of the sub projects and the preparation of DDR-Social were based on the Government’s Land Acquisition Act (LAA) of 1950, National Involuntary Resettlement Policy (NIRP) 2001 and ADB’s Safeguard Policy Statement (2009).

The gender category of the sub projects is categorized as ‘Effective Gender Mainstreaming”. The sub project output indirectly contributes to gender equality and women's empowerment.

Public consultations have been carried out during the design phase as well as implementation phase of the project. The views raised at the consultation were incorporated in the design. Issues raised are being addressed during the implementation phase to ensure that the stakeholders are not affected adversely on implementation of the subprojects.

A three tier GRM for the project is developed and approved by ADB and disclosed on project website. The activities conducted during the reporting period has not caused any changes to the IR and IP categorization of the project.

The reporting period saw the emergence of a pandemic (Covid 19) and the government and the project has taken enough safety and precautionary measures to prevent spread of this pandemic as briefed in the main report. Necessary guidelines of safety and social distancing were issued. Awareness programs on Covid 19 were conducted on project worksite before the restart of work including arrangements made at sites to prevent spread of the said pandemic.

The site activities were considerably reduced during mid-March, April and early half of May 2020 due to the lockdown measures of the Government to control the spread of Covid 19 and hence the report will relate to the activities in the balance period during which it was possible to work on project sites.

2.1 Objective of the report

1. This Semi-Annual Social Safeguards Monitoring Report for the Local Government Enhancement Sector Project - (Additional Financing) of Sri Lanka covers the period from )1 January to 30 June 2020. The objective of the report is to provide an overview of the progress made in the implementation of the Social Safeguard activities in the first half of 2020. It provides information on social safeguards activities related DDR, GAP implementation and social as well as safeguards issues raised during the design and construction periods, as needed as well as social impact mitigation measures. It describes the project’s performance in dealing with community consultation and stakeholders’ participation and grievances received and redressed. Lessons learned and the recommendations for the implementation of safeguards component of the project in the next stage of the program are summarized at the end of the report.

2.2 Project Description

2. The Local Government Enhancement Sector Project (LGESP) is a key infrastructure and reforms initiative of the , and aims to improve local infrastructure, and services delivered effectively by local authorities in less developed areas in Sri Lanka. Participating local authorities implement subprojects in the areas of roads and bridges, water supply and sanitation, drainage, solid waste management, and other basic facilities including health centers and public markets. Funds for these subprojects will be obtained as grants from the Ministry of Provincial Councils and Local Government. To continue the support to the initiatives of the Government through the current project and on solving the problems in areas affected by Chronic Kidney Diseases and further the support in service delivery improvement and capacity building in local authorities, ADB and government have agreed on an additional financing component which will (i) support implementation of water supply schemes in areas affected by chronic kidney diseases and enable the availability of safe drinking water to the vulnerable section of these areas; (ii) Support infrastructure delivery in 29 additional Pradeshiya Sabhas; and (iii) extending the support for capacity building initiatives under the project.

3. The project is designed with three outputs with different sub-projects as below:

I) Output 1: Water supply systems in CKD affected areas improved - This component will provide support to improve water supply systems in areas affected by Chronic Kidney Diseases. II) Output 2: Local infrastructure and basic service delivery improved -This component will provide financing to Local Authorities for Eligible Subprojects. The subprojects are selected through a consultative process based on the demands of the locality and include various projects like (i) Roads and Bridges; (ii) Water Supply; (iii) Sanitation; (iv) Drainage; (v) Solid Waste Management; and other basic facilities including (vi) community-based buildings or (vii) enhancing health centers and (viii) public markets etc. III) Output 3: Local Government Policy Reform Advance and Capacity Strengthened - This component will support (i) Local Authorities to implementing the guidelines developed under the capacity development TA (ii) establishment and implementation of IT solutions in new Pradeshiya Sabhas; (iii)continuation of support and improvement of IT solutions in the original 108 Pradeshiya Sabhas and increase efficiency of local administration, (iii)support for implementing reform plans in the original and new Pradeshiya Sabhas; and (iv) capacity building programs to strengthen technical, financial, and administrative capacity of the original and new Pradeshiya Sabhas, provincial councils, and MPCLG Project Financing

4. Following are the institutional arrangements in respect to social safeguards: The Project Management Unit (PMU) in Colombo has a Safeguard Manager (Environment, Social and Gender). The Subproject Coordination Units (SPCU) in all Seven Provinces have each Safeguard cum Reform Manager to look after social, gender, and environmental issues. The Project Management Consultant team has also staffed with a Safeguards Expert (Social and Gender) who advises the project team on Social Safeguard issues.

5) SCOPE OF IMPACTS

5. Almost all physical work associated with subprojects are confined within the existing government-owned lands and do not have involuntary resettlement impacts (land acquisition and physical or economic displacement of people).

6. The subprojects of output 1 are laying of transmission main and distribution network along the RoW of RDA, PRDA, and PS roads. Concurrence for using RoW has been obtained from relevant agencies. The civil works such as Intake structures, Treatment plant, water tanks, etc., located on government land owned by NWSDB. During project preparation, assessments and field observations, identified subprojects revealed that there are no cases of resettlement impacts in any of the subprojects

7. No road closure is expected or experienced during pipe laying because of works scheduled by the contractor in such a manner. The contractors plan and undertake laying of pipes one side of the road first and, on completion of the same, moves the work on the other side to minimize the impact on traffic. The pipe laying and traffic routing studied in advance, and the contractor provides signals and signs if required at appropriate locations. The contractor is responsible for providing access to shops and residences using simple wooden and/or concrete walkways where needed and minimize the at a time excavation to a length of 500 m to reduce disruption.

8. The subprojects of component 2 are very small and mostly to the tune of 0.1 to 0.5mn US $ and consist of small office buildings, markets, libraries, small water supply projects, etc. which do not have any significant adverse social impacts. The land identified for locating these facilities belongs to respective PSs without acquiring private lands.

9. It has been found that no additional land is required for the subprojects. It is confirmed that there is no land acquisition or structural damages or livelihood disturbances due to the implementation of these sub-projects.

10. It is also confirmed that there is no presence of Indigenous people in this subproject area. The due diligence studies conducted during the design stage of the project confirmed that the project should be category C for both involuntary resettlement (IR) and indigenous peoples (IP) safeguards. Construction activities carried out during the reporting period had no impacts of involuntary resettlement, and no indigenous people were encountered. Thus no resettlement plans or indigenous people plans were needed to be developed during the reporting period. Therefore, the categorization on IR and IP remained as C during this reporting period

6) COMPENSATION AND REHABILITATION

11. The sub-projects are categorized as ‘C’ for both Involuntary Resettlement and Indigenous Peoples as per ADB Safeguard Policy Statement. As on date, considering the subprojects taken up, there is no rehabilitation / resettlement involved in the project. However, the project would report if it encounters any cases of rehabilitation / resettlement in the future.

7) STATUS OF COMPLIANCE, APPROVAL, DISCLOSURE OF SAFEGUARD DOCUMENTS (SOCIAL) INCLUDING SOCIAL SAFEGUARD CATEGORIZATION AND PROGRESS ON GENDER ACTION PLAN AND RELETED ISSUES

12. The status of compliance, approval, and disclosure of safeguard document (social) is given vide Attachment 1.. The details of social safeguard categorization is provided vide Attachment 2. The details and status of Grievance Redressal is given vide Attachment 3. The progress of Gender Action Plan is given in Attachment 4 and other details of progress regarding gender issues is given vide Attachment 6. All these information has been cumulated as on 30 June 2020 in attachments as indicated above. The details of safeguard measures taken to prevent the spread of Covid 19 as per government guidelines is given in Attachment 6.

7.1 Project-based Documents

13. As per the ADB’s Safeguards Policy Statement (SPS - 2009), Resettlement Framework (RF) and Indigenous Peoples Planning Framework (IPPF) and Gender Action Plan already prepared and approved by ADB. All documents are available for reference on the ADB website.

7.2 Subproject-based Documents

14. As per ADB approved RF and IPPF, Due Diligence Reports (Social Safeguards) have been prepared for each subproject and approved by ADB. The DDR confirmed that each subproject falls under “Category C”. The status of preparation and approval of DDR-Social is provided vide attachment 1 as mentioned in earlier paragraphs. As to date,, there has been no resettlement impacts and impacts on Indigenous people in any of the subprojects.

7.3 Project disclosure, public participation, and consultation

15. Consistent with National Involuntary Resettlement Policy (NIRP) and ADB’s Safeguard Policy Statement (2009) (SPS), meaningful consultation1 was organized. The project has followed a consultative process in deciding the subprojects and finalizing the designs of the project. The consultation process began during the planning stage and is carried out throughout the project.

16. Public Consultations were held during the planning stage to finalize the designs. The views of the stakeholders considered in the final design and in the project implementation process. Public Consultations are being held during the implementation

8) IMPLEMENTATION OF GENDER ACTION PLAN (GAP)

18. As per ADB gender classification, this project (Local Government Enhancement Sector Project- Additional Financing) has classified as Effective Gender Mainstreaming (EGM). Effective Gender Mainstreaming requires Gender Action Plan (GAP), and the GAP describes proposed measures to be included in the project design and implementation in promoting gender equality and in mainstreaming gender in main outputs of the project. The main output of the project is as already described in paragraph 3.

19. The progress of implementing the GAP is presented in attachment 4. The key gender- related activities based on the GAP are ensuring the participation of women in community decision making and integrate the gender-specific needs in project design and project implementation.

20. Men and women engaged in construction during subproject implementation are being paid equally for equal work and similar position, which will be monitored by design and construction supervision consultants. The proposed additional financing will provide opportunities to ensure benefits to women through improved public services and better access to education, health care, markets, etc.

9) GRIEVANCE REDRESS MECHANISM (GRM)

21. An effective ADB approved project-specific three-tier Grievance Redress Mechanism (GRM) is in place for timely and sensible hearings and facilitate solutions. The same framework of Grievance Redress Mechanism, which was applied for the previous Project, would apply in the implementation of the present project under A/F. The Grievance Redress Mechanism of the Project is also disclosed on the project website www.puraneguma.lk. The list of grievances recorded and attended is provided regularly in the quarterly progress reports. The Grievances Redressal Status Summary Reports are attached to this report as Attachment 3.

10) MONITORING RESULTS – FINDINGS

22. As on date, the project has not encountered any resettlement or IPP issues. There has been no significant issue on this account to date. The details of safeguard compliance has been cumulated as on 30 June 2020 and explained in attachment 1.

Safeguards – Related Provisions in Bidding Documents and Works Contracts The Borrower ensure, or cause to be ensured that all bidding documents and contracts for Works contain provisions that require contractors to: Complied – All bidding (a) comply with the measures relevant to the contractor set forth in any IEE or EIA, EMP, RP and IPP (to the extent they concern impacts on documents have affected people during construction), and any corrective or preventative actions set forth in a Safeguards Monitoring Report; relevant clauses. arise during construction, implementation or operation of the Project that were not considered in any IEE or EIA, EMP, RP and IPP; Schedule 5; (d) adequately record the condition of roads, agricultural land and other infrastructure prior to starting to transport materials and construction; Para 13 and (e) reinstate pathways, other local infrastructure, and agricultural land to at least their pre-project condition upon the completion of construction. The Borrower shall strictly monitor compliance with the requirements set forth above and provide ADB with regular report. Gender and Development The Borrower shall ensure, or cause to be ensured that, (a) the GAP is implemented in accordance with its terms; (b) bidding documents Being Complied and contracts include relevant provisions for contractors to comply with the measures set forth in the GAP; (c) Adequate resources are Schedule 5; allocated for implementation of the GAP; and (d) Progress on implementation of the GAP, including progress towards achieving key gender Para 17 outcome and output targets, are regularly monitored and reported to ADB.

Grievance Redressal Mechanism Section 5; Within 6 months of effective date, the borrower, through the PMU, shall finalize, or shall cause to be finalized, a Grievance Redressal Being Complied Para 26 Mechanism acceptable to ADB, and ensure that they is appointed an officer, with the requisite capacity in each SPCU to receive, resolve and act upon both independently and expeditiously, complaints or grievances or reports from stakeholders on misuse of funds and other irregularities relating to the project or the specific subprojects in each provisional council, including but not limited to Grievances due to resettlements and environmental impacts. 25. With the outbreak of COVID 19 Pandemic and subsequent lockdown, most of the activities in the country stopped temporarily until the country becomes normalized. From around 20th March up to 15th May 2020 all most all the construction sites in the country temporarily suspended. With the decrease of the threat of COVID 19, construction activities of the LGESP (AF) resumed with compliance to guidelines and precautionary measures applied by the Ministry of Health and the same guidelines circulated by the PMU. The following actions have been brought by the construction sites of LGESP (AF) that resumed constructions.

14) FOLLOW UP ACTIONS, RECOMMENDATION, AND DISCLOSURE

27. CKD awareness program should be conducted as planned. Awareness should be created for the public to obtain safe drinking water. There are water supply schemes in the CKD affected areas about to complete under this project, and it is the right time for organization awareness programs for CKD prevention to such sub-projects.

28. The safeguard compliance reports are disclosed in the Project website www.puraneguma.lk (along with quarterly reports)

KII with Doctor who conducted CKD awareness program

Dr. Nimali Retneyake, attached to RDHS office Matale is in charge of conducting CKD awareness programs in the area. "The project intervention to include CKD awareness programs is a great impact on the society, especially CKD affected areas like this," said Dr. Nimali and appreciated the program. She further added that the doctors could have more interaction with the public as well as patients when such programs organized. Doctors will have the opportunity to explain well about the CKD during this session. "The participants can also understand and raise questions for further understanding," the doctor said.

The doctor who conducted the CKD awareness program explained that prolong and untreated non-communicable diseases such as diabetes and hypertension might also lead to CKD. In addition to this, contamination of agrochemical with drinking water sources as a result of over- application of fertilizer water source becomes polluted. The doctor highlighted "drinking water from such polluted sources may also cause CKD".

The doctor added, "since this is paddy cultivation area, the ADB assisted water supply project to ensure safe drinking water to the villagers and promote health standard of the people". She said, "These programs will create awareness among the villagers for safe drinking water".

5.5: Extract of Contract Condition

The Contractor shall (a) encourage the employment of the poor, particularly women, and provide appropriate facilities for women in work sites; (b) give priority in employment to people directly affected by the Project; (c) not differentiate wages between men and women for work of equal value; and (d) comply with the measures set forth in the Gender Action Plan.

PCC 82 The Contractor shall comply with all relevant (a) labour laws and regulations applicable to the Contractors’ personnel, including staff, consultants, contractors, and agents, and (b) workplace health and safety laws.

The contractor shall not make employment decisions based upon personal characteristics unrelated to job requirements. The Contractor shall base the employment relationship upon equal opportunity and fair treatment, and shall not discriminate with respect to aspects of the employment relationship, including recruitment and hiring, compensation (including wages and benefits), working conditions and terms of employment or retirement and discipline.

The Contractor shall (a) provide equal wages and benefits to men and women for work of equal value or type: (b) maximize employment of females and local poor and disadvantaged persons for construction purposes, provided that the requirements for efficiency are adequately met.

The normal working hours shall be in accordance with the labour regulations of Sri Lanka and if the contractor needs to inform the Engineer at least a day in advance, if intending to work after normal working hours and on holidays (Sundays and Mercantile).

Appendix 6.2: Guideline circulated by the PMU to resume office work and construction activities after lifting lockdown (curfew) imposed because of COVID-19

To resume office work and construction activities in all sites, after COVID 19 outbreak normalize, your attention is focused on adhering following:

While all guidelines of Government are to be followed, some of the key points are as follows:

A. General Measures to be taken by Employer / Site In-charge:

1) The head of the office / site in-charge should collect the details of all the staff – (i) Travel details in past one month before joining back office / site work; (ii) details of any fever, cough, cold / running nose, (and all Covid-19 symptoms) in the last month; (iii) Details of coming into contact with any Covid-19 patient in the last one month ( A suggested format is given vide Attachment 1);

2) The head office / site in-charge should arrange the awareness session on Covid- 19 disease which include, details of the disease, its mode of spreading, precautions to be taken and reporting requirements. This should be organized to each and every staff / worker and acknowledgement taken from the respective staff;

3) The employer should provide necessary personnel protective equipment (PPE) like masks, gloves sanitizers, etc. as required to personnel and office and train the staff on use and disposal of these equipment in the awareness programs mentioned above. Adequate washing facilities to be made available in the project site / office;

4) If any worker or his / her neighbor or community reports symptoms, it is the duty of the employer or site / officer in-charge to report to concerned health authorities immediately without fail.

5) The employer / site in-charge to organize regular health checks (Periodically) once in 3 / 4 days (twice a week) to assess the condition of the staff and document them properly. If a staff shows any symptoms of Covid -19 he / she should be sent for quarantine and the staff and his associates to offered for testing by reporting to appropriate authorities

6) The Employer’s should refrain from / be cautious and doubly sure on health conditions on employing persons from high risk areas.

7) A brief report / check list should be prepared fortnightly on each project site before 5 days after completion of the fortnight for first two months and monthly reports thereafter by 5th of next month and submitted to the PMU. (Sample of Covid -19 briefing report is attached vide Attachment 2).

8) The officials in-charge of the site should be in close contact with provincial / national health officials for the required support.

9) Key guidelines on prevention of Covid -19 should be displayed in office / project office as appropriate at all prominent places.

10) Partial Staffing on rotation with others working at home / staffing on shift basis to be explored and decided upon by the head of office / site in-charge.

B. Key Measures to be taken in the office / Project Site:

Open burning should not be practiced for disposal in the site. 4 Imported Material Disinfection Any imported material from other countries to be disinfected before bringing the same to the site or office as necessary 5 Disinfect Common Areas When and where necessary common areas to be disinfected as required in collaboration with the MOH office or Local Authority of the area. Special attention should be paid when the sites are opened for the first time. Cleaning/ disinfecting the sites should be done before they are opened for civil work activities (especially stores, yards and labour camps) 6 Personal Protective Equipment Use all required and appropriate Personal Protective equipment like mask, gloves and boots continuously during work. 7 Social Distancing in worksite Staff should keep a standard distance of more than 1 mt between each other while interacting / working in office and project site and should always keep their face covered with mask. There should be no physical contacts like shaking hands and sitting together etc. Do not enter the site / work place without a mask. 8 Group activities of workers Workers / Staff should refrain from close meetings and meet only on absolutely necessary issues with proper social distance maintained. contacts and correspondence. 9 Night stay in camps All safety facilities to be provided and the social distancing requirements should be maintained. 10 Use of drugs and Alcohol Totally prohibited 11 Precaution while leaving home The staff / worker should wash hands and shoes properly before leaving home. 12 Precautions on reaching home. The staff should wash all clothes / and have a wash before touching any person or item in the house to ensure safety of oneself and family persons. All items like car keys, specs etc. should be disinfected / washed as the first thing before reaching home. 13. Sharing of food / Articles etc. Sharing of food / items with each other should be avoided for next few months until normalcy is back or if done, should be done with full care and required disinfection. 14 Maintenance of toilets and common facilities All toilets and common facilities to be disinfected periodically to control the incidence / spread. 15 Reporting responsibility of staff Staff should report immediately without fail for any symptoms for self and associates on Covid-19 for appropriate informed decision 16 Provisioning of a dedicated team for cleaning A dedicated team shall be assigned for activities and safety of cleaning staff cleaning work at sites. These staff should be provided with all appropriate PPE and they should be wearing the PPE while on duty. Instructions should be given to wash or sanitize their hands thoroughly after each encounter (e.g. after cleaning each room, wash room, front desk, etc.) 17 Arrangements for transportation of staff to and Following special precautions are to be from sites taken if staff is to be transported: Clean and disinfect all vehicles used for transportation. No front loaders or other construction machinery shall be used for transportation of staff. Vehicles used for transportation of staff should have adequate capacity to provide appropriate physical distancing. A designated officer must be present to open and close doors of the vehicle for passengers and no passenger shall be allowed to handle the door. Note: The above is indicative to cover key areas. The guidelines / annexures released by Government from time to time as required shall be followed in total. Important Note: All contractors shall develop a health and safety (HS) management plan or update the existing HS plan based on the guidelines presented in section B and submit to respective SPCU for approval before commencement of site activities.
