As the fall semester on Immigration & Citizenship begins, I am reflecting on how exciting my first nine months have been at Case Western Reserve University getting to know our faculty, staff, students, alumni and community partners. The Office of Inclusion, Diversity and Equal Opportunity (OIDEO) has been hard at work addressing the diversity challenges that can arise in the classroom, on campus, and in the workplace. Yet we know education and dialogue about the value and significance of diversity creates exciting opportunities to embrace both our differences and what we have in common. Still, 52% of LGBT workers can be denied employment or fired simply for being LGBT. This state of the law makes the U.S. lag behind many of its major trading partners, who have already established equal employment in their national laws. While there are a number of routes U.S. law may soon take to end LGBT employment discrimination, private firms, especially those with international operations, will need to determine the best course to take.

Sexual Orientation – Protections for Gay, Lesbian, Bisexual, and Transgender Employees. A. Has LGBT Discrimination Ended in the Workplace? 1. A 2014 report by the Center for American Progress1 compiled the following data on LGBT employment discrimination: i. 11 to 28% of lesbian, gay, and bisexual, or LGB workers are denied or passed over for a promotion because of the sexual orientation. ii. 47% of transgender people reported being fired, not hired, or denied a promotion because of their gender identity. Of the 47% discriminated against, roughly 26% report being fired from a job they already had simply because of their gender identity. iii. Gay and bisexual men make 10 to 32 percent less than straight men working similar jobs. iv. 7 to 41% of LGB workers were verbally or physically harassed or had their workplace vandalized. 2. Only 18 states and the District of Columbia have laws explicitly protecting LGBT workers from being fired because of their sexual orientation or gender identity.2 Ohio, Kentucky, Michigan, and Tennessee offer no protections. i. Will employers provide more employment benefits to same sex couples after Obergefell? Many Fortune 500 corporations already do. Check out the Human Rights Campaign’s Corporate Equality Index,3 where 13 Ohio corporations, including law firms, earned a 100% rating.     Ohio Civil Liberties 4506 Chester Avenue Cleveland, OH 44103 Snapshot Breaking the Chains on Juvenile Shackling in Ohio The ACLU of Ohio, along with other juvenile justice organizations, have been working tirelessly to end the automatic shackling of Ohio’s children in juvenile courts. This winter, the Supreme Court of Ohio produced and opened for public comment the first draft of Local Juvenile Restraint Rule 5.01, which would limit the use of shackles in juvenile courts. The ACLU of Ohio strongly supports the rule and has passionately called on other organizations and child advocates to do the same. We have been actively involved in advocating for change on this issue and are pleased with the positive feedback. In the first 24 hours of the comment period, the Court received over 500 responses. “It is unconstitutional to shackle adults in court without a specific reason, yet the same rules don’t apply to juveniles. Putting children in handcuffs, belly chains, and/or leg irons while in court causes psychological harm and ignores the mission of the juvenile justice system to rehabilitate young people,” said Shakyra Diaz, policy manager with the ACLU of as well as the rehabilitative mission of the juvenile Ohio. “This change would require courts to adopt a justice system. FUDGE On March 10, 2021, Marcia L. Fudge was sworn in as the eighteenth Secretary of HUD. Secretary Fudge served as U.S. Representative for the 11th Congressional District of Ohio from 2008 to March 9, 2021. She was a member of several Congressional Caucuses and past Chair of the Congressional Black Caucus. Prior to her Congressional ten- ure, Secretary Fudge was elected in 1999 to serve as the first female and first African American mayor of Warrensville Heights, Ohio, a position she held for two terms. Under Secretary Fudge’s leadership, the Department of Housing and Urban Development will work to eradicate the growing homelessness issue, put an end to discriminatory practices in the housing market, and ensure that our fair housing rules are doing what they are sup- posed to do: opening the door for families who have been systemati- cally locked out for generations to buy homes and have a fair shot at achieving the American dream. Each District Court ruled in petitioners’ favor, but the Sixth Circuit consolidated the cases and reversed.     52 Persecution of Homosexuals in the McCarthy Hearings: A History of Homosexuality in Postwar America and McCarthyism Hugo Marquez Introduction. The postwar years were a time of great changes for homosexuals in the United States. The conjunction of the fear and anxiety of the first Cold War years, negative stereotypes held as scientific truths explaining homosexuality, and the greater awareness people had about the existence of gays and lesbians resulted in an environment of misunderstanding and persecution. Within this environment, positive scientific contributions toward the understanding of homosexuality such as Kinsey's report were twisted to fit the larger societal preconceptions, and even influenced the creation of legislation aimed at eradicating homosexuals from the government. A protagonist in this postwar environment of fear and anxiety was a senator named Joseph McCarthy, who ascended in politics through lies and slander, and became most famous for his relentless persecution of 'infiltrated' communists, liberals, and dissenters. Assisting the senator in his crusade was a legal infrastructure previously laid out by committees who had taken the cause before him, the most important of which was the famous House of Un­ American Activities Committee. Despite the great number of literature written about the senator, there are relatively few studies that deal with McCarthy's persecution of homosexuals. Some historians mention it in the context of his other persecutions, and as an example of one of the many groups who suffered under the senator. In The Age of Anxiety: McCarlhyism to Terrorism, Haynes Johnson stated that the senator, and his chief council Roy Cohn took it as their mission to search for, and have fired, all homosexuals in the government.
