Pendekatan yang digunakan adalah pendekatan multidimensional : mencakup gejala-gejala kompleks, tidak hanya dilihat dari satu sisi kehidupan, dan ditulis secara deskriptif-analitis. Hasil penulisan menunjukan bahwa Adam Malik hanya menempuh pendidikan formal Sekolah Dasar (SD) di HIS (Hollandsh Inlandsche School). Sejak 17 tahun telah terjun ke dunia politik. Pada tahun 1959 ia memulai kariernya dalam pemerintahan, yaitu sebagai duta besar hingga menjadi wakil presiden Republik Indonesia. Kembalinya Irian Barat sampai dengan keberhasilan Indonesia menjalankan politik luar negeri bebas dan aktif, hingga diakuinya Indonesia dalam kancah pergaulan dunia, merupakan buah dari usaha atau sumbangannya bagi bangsa Indonesia. viii PLAGIAT MERUPAKAN TINDAKAN TIDAK TERPUJI ABSTRACT ADAM MALIK’S CAREER IN POLITICS IN INDONESIA IN 1959-1983 By : Hesty Riana Ledes NIM : 051314010 This study aims to describe and analyze Adam Malik’s socio-cultural and political backgrounds in politics in Indonesia in 1959-1983, and Adam Malik’s contributions to the Indonesian Government. The methodology used in this research is a history study that includes: the topic selection and the writing (historiography). The approach used in this research is multidimensional approach that includes: complex symptoms that are not only seen from one aspect of life. This study is a descriptive-analytic study. The result of this research shows that Adam Malik went to a formal Elementary School (ES) in HIS (Hollandsh Inlandsche School). Since he was 17, he had involved deeply into politics. In 1959, he started his career in Government as an ambassador, and then as a vice president of The Republic of Indonesia. Some of the results of his contributions to Indonesia were: Irian Barat become a part of Indonesia, the success of Indonesia in doing the political action in Non- Block, and the success of Indonesia to be accepted in the world. ix PLAGIAT MERUPAKAN TINDAKAN TIDAK TERPUJI KATA PENGANTAR Puji syukur kehadirat Tuhan Yang Maha Esa atas berkat dan rahmat-Nya, sehingga penulis dapat menyelesaikan skripsi yang berjudul “Karier Adam Malik dalam Pentas Politik di Indoensia Tahun 1959-1983”. Haley School of Law A sweeping proviso that protects basic or fundamental interests of a legal system is known in various names – ordre public, public policy, public order, government’s interest or Vorbehaltklausel. This study focuses on the concept of Indonesian public order in private international law. It argues that Indonesia has extraordinary layers of pluralism with respect to its people, statehood and law. Indonesian history is filled with the pursuit of nationhood while protecting diversity. The legal system has been the unifying instrument for the nation. However the selected cases on public order show that the legal system still lacks in coherence. Indonesian courts have treated public order argument inconsistently. A prima facie observation may find Indonesian public order unintelligible, and the courts have gained notoriety for it. This study proposes a different perspective. It sees public order in light of Indonesia’s legal pluralism and the stages of legal development.

This means that within the next seven months, the people of Indonesia and ASEAN member countries more integrated into one large house named AEC. This in turn will further encourage increased volume of international trade, both by the domestic consumers to foreign businesses, among foreign consumers by domestic businesses, as well as between foreign entrepreneurs with domestic businesses. As a result, the potential for legal disputes between the parties in international trade transactions can not be avoided. Therefore, the existence of the contract law of international commercial law in order to provide maximum protection for the parties to a transaction are indispensable. The existence of this legal regime will provide great benefit to all parties to a transaction to minimize disputes. This study aims to assess the significance of the governing of International Commercial Contract Law for Indonesia in the framework of the implementation of establishing the AEC 2015 and also to find legal principles underlying governing the International Commercial Contracts Law for Indonesia in the framework of the implementation of establishing the AEC 2015 so as to provide a valuable contribution to the development of Indonesian national law.

October 2013 Abstract How democratisation affects a state's foreign policy is a relatively neglected problem in International Relations. In Indonesia's case, there is a limited, but growing, body of literature examining the country's foreign policy in the post- authoritarian context. Yet this scholarship has tended to focus on the role of Indonesia's legislature and civil society organisations as newly-empowered foreign policy actors. Scholars of Southeast Asian politics, meanwhile, have concentrated on the effects of Indonesia's democratisation on regional integration and, in particular, on ASEAN cohesion and its traditional sovereignty-based norms. Email: [email protected] Abstract This paper examines legal pluralism’s discourse in Indonesia which experiences challenges from within. The strong influence of civil law tradition may hinder the reconciliation processes between the Indonesian living law, namely adat law, and the State legal system which is characterised by the strong legal positivist (formalist). The State law fiercely embraces the spirit of unification, discretion-limiting in legal reasoning and strictly moral-rule dichotomies. The first part of this paper aims to reveal the appropriate terminologies in legal pluralism discourse in the context of Indonesian legal system. The second part of this paper will trace the historical and dialectical development of Indonesian legal pluralism, by discussing the position taken by several scholars from diverse legal paradigms. This paper will demonstrate that philosophical reform by shifting from legalism and developmentalism to legal pluralism is pivotal to widen the space for justice for the people, particularly those considered to be indigenous peoples. KATZ* Law Reform in Post-Sukarno Indonesia Sukarno, Indonesia's president for two decades,' did not give a very high priority to law reform, as indicated by his statement to a group of lawyers in 1961 that "one cannot make a revolution with lawyers." 2 Since his fall from power, however, there have been many efforts to bring Indonesia closer to its goal of becoming a "Negara Hukum" (state based on the rule of law). 3 The purpose of this article is to describe the systematic progress that has been made in this direction. Perhaps the best way to chart this progress is to trace the career of an Indonesian leader, Professor Dr. Mochtar Kusumaatmadja, who has been very active in the law reform area. His career may be viewed in three stages, which parallel the recent stages of law reform in Indonesia.4 During the first stage-the latter part of the Sukarno regime-Professor Mochtar had to live outside of Indonesia because his view of law differed sharply from that of Sukarno.     Indonesian Technocracy in Transition: A Preliminary Analysis* Shiraishi Takashi** Indonesia underwent enormous political and institutional changes in the wake of the 1997–98 economic crisis and the collapse of Soeharto’s authoritarian regime. Yet something curious happened under President Yudhoyono: a politics of economic growth has returned in post-crisis decentralized, democratic Indonesia. The politics of economic growth is politics that transforms political issues of redistribution into problems of output and attempts to neutralize social conflict in favor of a consensus on growth. Under Soeharto, this politics provided ideological legitimation to his authoritarian regime. The new politics of economic growth in post-Soeharto Indo- nesia works differently. Decentralized democracy created a new set of conditions for doing politics: social divisions along ethnic and religious lines are no longer suppressed but are contained locally. A new institutional framework was also cre- ated for the economic policy-making. The 1999 Central Bank Law guarantees the independence of the Bank Indonesia (BI) from the government. The Law on State Finance requires the government to keep the annual budget deficit below 3% of the GDP while also expanding the powers of the Ministry of Finance (MOF) at the expense of National Development Planning Agency. No longer insulated in a state of political demobilization as under Soeharto, Indonesian technocracy depends for its performance on who runs these institutions and the complex political processes that inform their decisions and operations.     Binding Contestation: How Party-Military Relations Influence Democratization Darin Sanders Self Cornell University [email protected] December 7, 2020 Abstract From setting restrictions on popular sovereignty and open contestation, tocite yielding entirely to civilians, there is substantial variation in how militaries behave in transi- tions from military rule. I argue that the extent to which a military sets parameters on electoral and political institutions during a regime transition, what I call bounded democratization, is a function of a military's confidence that partiesnot will protect the military's corporate interests following the transition. A military's confidence in polit- ical parties is influenced by the degree of trust between the parties and the military, the institutionalization of the incumbent party, as welldo as the electoral and political strength of the incumbent party. When these factors- are high, the military's confidence increases and it becomes more willing to yield to civilian parties. Using comparative historical analysis on a paired comparison of Indonesia and Paraguay I test the causal mechanisms and then use quantitative models to show that the mechanisms are gen- eralizable. paper Working Job market paper for AY 2020-2021.     T he 7th D evelopment Cabinet: Loyal to a Fault? Michael Malley Five years ago, amid speculation that B. J. Habibie and his allies in the Association of Indonesian Muslim Intellectuals (ICMI) would gain a large number of seats in the cabinet, State Secretary Moerdiono announced that "expertise" would be Soeharto's chief criterion for choosing ministers. This year, despite the economic crisis that enveloped the country, few people even thought to suggest that Soeharto sought the most technically qualified assistants. As the outgoing cabinet's term wore to a close, the jockeying for influence among ministers and their would-be successors emphasized the most important qualification of any who would join the new cabinet: loyalty. As if to diminish any surprise at the lengths he would go to create a cabinet of loyalists, Soeharto fired his central bank chief, Soedradjad Djiwandono, in mid- February, just two weeks before the 6 ^ Development Cabinet's term expired. Together with the finance minister, Mar'ie Muhammad, Soedradjad had worked closely with the International Monetary Fund to reach the reform-for-aid agreements Soeharto signed in October 1997 and January this year. Their support for reforms that would strike directly at palace-linked business interests seems to have upset the president, and neither were expected to retain their posts in the 7 ^ Cabinet. But Soedradjad made the further mistake of opposing the introduction of a currency board system to fix the rupiah's value to that of the US dollar. The scheme's main Indonesian proponents were Fuad Bawazier, one of Mar'ie's subordinates, and Peter Gontha, the principal business adviser to Soeharto's son Bambang Trihatmodjo.
