ANNEX 4: REPORT FROM THE STATES OF THE EUROPEAN FREE TRADE ASSOCIATION PARTICIPATING IN THE EUROPEAN ECONOMIC AREA 1. Application by the EFTA States participating in the EEA 1.1 Iceland European works The seven covered channels broadcast an average of 39.6% European works in 2007 and 42.2% in 2008. This represents a 2.6 percentage point increase over the reference period. For 2007 and 2008, of the total of seven covered channels, three channels achieved the majority proportion specified in Article 4 of the Directive (Omega Television, RUV and Syn - Vision TV), while four channels didn't meet this target (Sirkus, Skjár 1, Stöð 2 and Stöð 2 Bio). The compliance rate, in terms of numbers of channels, was 42.9%. European works made by independent producers The average proportion of European works by independent producers on all reported channels was 10.7% in 2007 and 12.6% in 2008, representing a 1.9 percentage points increase over the reference period. In 2007, of the total of seven identified channels, two channels exceeded the minimum proportion under Article 5 of the Directive, while three channels remained below the target. One channel was exempted (Syn - Vision TV) and no data was communicated for another one (Omega Television). The compliance rate, in terms of number of channels, was 33.3%. For 2008, of the total of seven covered channels, three exceeded the minimum proportion specified in Article 5 of the Directive, while two channels were below the target (Skjár 1 and Stöð 2 Bio). No data were communicated for two channels.

Beschluss Zulassungsantrag der NBCUniversal Global Networks Deutschland GmbH für das Fernsehspartenprogramm „13th Street“ Az: KEK 1001 In der Rundfunkangelegenheit der NBCUniversal Global Networks Deutschland GmbH, vertreten durch die Geschäftsführerin Katharina Behrends, Theresienstraße 47a, 80333 München, - Antragstellerin - w e g e n Zulassung zur Veranstaltung des bundesweiten Fernsehsparten- programms „13th Street“ hat die Kommission zur Ermittlung der Konzentration im Medienbereich (KEK) auf Vorlage der Medienanstalt Berlin-Brandenburg (mabb) vom 06.02.2019 in der Sitzung am 12.03.2019 unter Mitwirkung ihrer Mitglieder Prof. Dr. Gounalakis (Vorsitzender), Prof. Dr. Sjurts (stv. Vorsitzende), Prof. Dr. Althammer, Becker, Fischer, Dr. Lübbert, Prof. Dr. Mailänder, Prof. Dr. Müller-Terpitz, Sagurna, Schneider und Dr. Zimmer entschieden: Der von der NBCUniversal Global Networks Deutschland GmbH bei der Medienanstalt Berlin-Brandenburg (mabb) beantragten Zulassung zur Veranstaltung des bundesweit verbreiteten Fernsehspartenprogramms „13th Street“ stehen Gründe der Sicherung der Meinungsvielfalt im Fernsehen nicht entgegen. 1 Begründung I Sachverhalt 1 Zulassungsantrag Die NBCUniversal Global Networks Deutschland GmbH („NBCU Deutschland“) hat mit undatiertem Schreiben, welches am 04.02.2019 bei der mabb eingegangen ist, bei dieser die unbefristete Verlängerung der zum 30.04.2019 auslaufenden Zulassung zur Veranstaltung des bundesweiten Fernsehspartenprogramms 13th Street beantragt. Nach dem Staatsvertrag über die Zusammenarbeit zwischen Berlin und Brandenburg (MStV) ist die Erteilung einer unbefristeten Zulassung möglich, wenn mit ihr keine Zuweisung von Übertragungskapazitäten verbunden ist (vgl. § 28 Abs. 5 MStV). Die mabb hat die KEK mit Schreiben vom 06.02.2019 um medienkonzentrationsrechtliche Prüfung gebeten. 2 Programmstruktur und -verbreitung Das Programm 13th Street ist ein 24-stündiges Unterhaltungsspartenprogramm, welches überwiegend Spielfilme, Fernsehserien und Kurzfilme aus den Genres Action, Krimi und Thriller anbietet.

KG, vertreten durch die Komplementä- rin Sky Deutschland Verwaltungs-GmbH, diese vertreten durch die Geschäftsführer Brian Sullivan, Dr. Holger Enßlin, Pietro Maranzana und Carsten Schmidt, Medien- allee 4, 85774 Unterföhring, – Antragstellerin – w e g e n Zulassung zur Veranstaltung der bundesweiten Fernsehspartenprogramme „Sky C“ (Arbeitstitel) und „Sky Sport HD 3“ und Veränderung von Beteiligungsverhältnissen hat die Kommission zur Ermittlung der Konzentration im Medienbereich (KEK) auf Vorlage der Bayerischen Landeszentrale für neue Medien (BLM) vom 08.09.2010 sowie auf Vorlage der Medienanstalt Hamburg / Schleswig-Holstein (MA HSH) vom 02.09.2010, die auch im Namen der BLM erfolgte, in der Sitzung am 14.12.2010 unter Mitwirkung ihrer Mitglieder Prof. Dr. Sjurts (Vorsitzende), Dr. Lübbert (stv. Vorsitzender), Prof. Dr. Dörr, Prof. Dr. Gouna- lakis, Dr. Hege, Dr. Hornauer, Langheinrich, Prof. Dr. Müller-Terpitz, Dr. Schwarz und Prof. Thaenert entschieden: 2 I Den von der Sky Deutschland Fernsehen GmbH & Co. KG mit Schreiben vom 19.08.2010 und 31.08.2010 bei der Bayerischen Landeszentrale für neue Medien (BLM) beantragten Zulassungen zur Veranstaltung der bundesweit verbreiteten Fernsehspartenprogramme Sky C und Sky Sport HD 3 stehen Gründe der Siche- rung der Meinungsvielfalt im Fernsehen nicht entgegen. II Die von der Medienanstalt Hamburg / Schleswig-Holstein (MA HSH) mit Schrei- ben vom 02.09.2010 auch im Namen der Bayerischen Landeszentrale für neue Medien (BLM) zur Beurteilung nach dem Rundfunkstaatsvertrag (RStV) vorgeleg- ten Veränderungen von Beteiligungsverhältnissen bei der Sky Deutschland Fernsehen GmbH & Co.
