The Ninth Communication, covering the years 2007 and 2008, outlines the Commission’s opiniononapplicationof Articles 4and5at Community level andthe principal conclusions which can be drawn from the Member States’ reports. This document contains a detailed analysis of application of Articles 4 and 5 in each Member State based on the reporting obligationsforthe reference period. The Commission is responsible for ensuring correct application of Articles 4 and 5 of the Directive in accordance with the Treaty. Article 4(3) of the Directive requires the Member States toprovide the Commissionwith a report onapplicationof Articles 4and5every two years.Summariesofthesereportsare providedinAnnex3. The presentdocumentcomprisestwoparts: Part1:ApplicationofArticles4and5:Generalremarks; Part2:ApplicationofArticles4and5:Detailedanalysisfor eachMember State. APPLICATION OF ARTICLES 4 AND 5: GENERAL REMARKS In2007a total of 2053channels were reported,of which1590were coveredby Articles 4and 5of the Directive.In2008some 2151channels were reported,of which 1679were covered,a 51.6 %increase comparedwith2006. EN 5 EN This increase is the consequence of the highly dynamic development of the audiovisual sector whichhas continued since the last reference period 1.At the same time,the Commissionsent the Member States a pre-defined list of channels extracted from the European Audiovisual Observatory’s MAVISE database inorder toensure greater consistency andcomparability of the national statistical statements.This approachmight alsohave playeda part inthe increase inthenumberofchannelscovered. Progress has beenmade interms of the consistency of the measurements,althoughthere is still room for improvement in the consistency of the reporting: for instance, the distinction betweenlocal andregional channels neededsome clarification 2.The same applies tohow to treat certain specialised channels, such as cinema channels, which were exempt in some Member States 3. Trailers also appear to be counted as programmes for calculating the proportionofEuropeanandindependentworksinsomeMemberStates,butnotinothers.

From the total, 67 channels (28%) transmit in high definition (HD). James Bond, the legendary British secret agent, will drive an Aston Martin again in the next 007 film it was announced by Metro-Goldwyn-Mayer (MGM), Eon Productions, and Aston Martin. The 20th installment of the longest running and most successful franchise in cinema history, produced by Michael G. Wilson and Barbara Broccoli, is due for release in 2002. Bond 20 marks the 40th anniversary of the franchise that began in 1962 with Dr. No. Pierce Brosnan will make his fourth appearance as James Bond in the film, which will be directed by Lee Tamahori (Along Came a Spider, The Edge) and written by Neal Purvis and Robert Wade.
