України Власний Шлях Der Eigene Weg Der Ukraine Ukraine‘S Own Path The judicial mechanisms in W estern Europe as well as Germany and in Ukraine are not so different as they might seem at f rst glance. In both countries the norm constructions were, УКРАЇНИ ВЛАСНИЙ ШЛЯХ to a signif cant degree, initiated externally . So, the three normative areas presented in the book – corruption, data protection, and xenophobia/racism – show similar if somewhat dif- ferent characteristics. Yet, the norm application in both countries leaves much to be desired. DER EIGENE WEG DER UKRAINE What is still not recognized by the economic policies of the EU is the relationship between cause and effect. This can be seen most clearly in the essays using the example of corrup- tion. The authors argue that without distinct and secure social structures, corruption cannot UKRAINE’S OWN PATH be prevented. It is compensation for wealth which is inaccessible to all citizens. Only those people who possess something can keep it. If the economic situation is more balanced, cor- ruption will become superf uous for socio-structural reasons because wealth will be accessi- Незалежність та кооперація ble to everyone through legal opportunities. Corrupt actions are therefore not a question of – Власний шлях України до правової держави – morality or recognition of norms but a question of economic and social hardship, at least in cases where corruption is as per vasive as it is in Ukraine today. Also the separation of powers and judicial independence are still capable of being improved in Ukraine, as is argued in the Unabhängigkeit und Kooperation essays, whereby in particular the lack of a constitutional court for all citizens weighs heavily on – Der eigene Weg der Ukraine zum Rechtsstaat – the negative side. Furthermore, the law is to be measured using the standards of legal principles, which were Independence and Cooperation fought for and secured by human rights and science. That applies to both countries, though. – Ukraine’s own Path toward the Rule of Law – Due to its strong constitutional legality, Germany is better able to protect human rights. The judiciary is more independent, even if the subject of the independence of the third power in Germany is virulent. In the areas of corruption, data protection, and xenophobia, it is a differ- ent picture, as the essays of students from Ukraine and Germany show . Here, both countries Editors could cooperate and exchange experiences. Altogether, our compact seminars showed that the exchange of (academic) youth can be the right way to a common future for Ukraine and Germany.     inTrodUCTion The first written mentions of the Baltic tribes go back to the early middle ages.1 however, the first reference to Žemaitija in written sources is associated with a note in the hypatian Codex, dated to the late 13th century. in 1219, the Žemaitijan dukes, together with other Lithuanian dukes ‘by God’s word’, according to the chronicler, signed a peace treaty with the Principality of Volhynia.2 The source lists only a few Žemaitijan dukes who joined the envoys of the Lithuanian dukes sent to the Grand Princess of Volhynia, who at the time was ruling on behalf of her young sons. This is how the written history of Žemaitija begins. it entered sources later than many nearby lands did. for instance, written records of Lithuania begin with a note in Latin dating from 1009 in the ‘Quedlinburg annals’ about the murder of st Bruno (or Boni- 7 face) of Querfurt on the border of rus’ and Lithuania (in confinio Rusciae et Lituae).3 The relationship between Žemaitija and Lithuania, the first mentions of which are separated by a gap of a couple of hundred years, is a distinct and broad question. although Žemaitija began to integrate into the Grand duchy of Lithuania (GdL) in the 13th century, it preserved its own cultural and social structures from the 14th to the 18th centuries. The fact that Žemaitijans sent envoys to Volhynia with the Lithuanian dukes in 1219 shows that the Žemaitijan and Lithuanian dukes actively cooperated since the time historians call the confederation of the Lithuanian lands. This is also evidenced by later facts: Žemaitijan dukes belonged to the family of mindaugas, the first king of Lithuania, who was crowned in the summer of 1253.

The ethnical structure of Maramureş is the outcome of an ongoing process that has passed through some important stages connected with the rise and fall of the empires that used to dispute neighbouring territories. Worth recalling is the way in which these empires referred to the religion of conquered populations, or of their allied peoples. Christianity with the Proto-Romanians goes back to the time of Apostle Andrew, it gradually developing until the 8th century, a period in which it became the official religion of the Byzantine Empire (AD 313 – the Edict of Milan), spreading out in the territories inhabited by Romanians. The political pressures of the neighbouring empires of Maramureş ceased after the Second World War and the ethnical groups inside the province would evolved "normally". A significant increase registered the Rroma population, while the other ethnical minorities and the Romanian population are declining through population aging. 1. HISTORICAL CONSIDERATIONS The Christian population of Moldavia and Wallachia was under the protection of the Patriarchate of Constantinople (10th – 19th cc) except for the years 1235–1393, when it was under the guardianship of the Tyrnovo Metropolitan See. Throughout that time, the Transylvanian Christians (inclusive of those in Maramureş) had a distinctively different situation. In AD 732, the iconoclast Byzantine Emperor Leon the Sirian, dissolved the Prima Justiniana Bishopric.     Contemporary Nationalism in Ukraine: Why we need a Broader Analytical Framework Taras Kuzio Center for Transatlantic Relations, School of Advanced International Relations, Johns Hopkins University, Washington DC ‘Russian and Ukrainian Nationalism: Entangled Histories.’ A Harriman Institute Workshop, Columbia University, 22 and 23 April 2013 This paper puts forward the proposal that nationalism in Ukraine should be investigated in a broader context than is traditionally undertaken by scholars who focus on one region (Western Ukraine) and one element (ethnic Ukrainian nationalism). This paper is divided into three sections. The first section surveys the phenomena of racism, xenophobia, and anti-Semitism in Ukraine. The second section analyses the failure of the émigré OUNb (Organisation of Ukrainian Nationalists, Stepan Bandera wing) to establish its political force in Ukraine compared with the success of the Svoboda (Freedom) political party. The third section analyses Russian and Soviet nationalism in Ukraine. Racism, Xenophobia, and Anti-Semitism in Ukraine Racism Racist crimes in Ukraine against foreigners, migrants, asylum seekers, refugees, and Roma are rarely prosecuted and when they are they usually fall under the rubric of ‘hooliganism’ which leads to minor criminal charges. Racist and anti- Semitic crimes in Ukraine go unreported because of very low levels of public trust in the police1 and courts and fear of police racism and brutality. Racial profiling and individual targeting of identity checks in public places of immigrants and asylum seekers are commonplace which reduces confidence in the police and leads to under- reporting of racist attacks.

Summary. The article examines the political, ethnic and economic history of the Belarusian Panyamonne in the early Middle Ages (10th – 13th centuries). The Belorussian Panyamonne is a historical and ethnographic region of modern Belarus, located in the Neman river basin. The analysis of written and archaeological sources shows that the population of the region was poli-ethnic during this period. The East Slavic (Dregoviches, Volhynians, Krivichs) and the West Slavic (Mazovians) tribes came into contact with the Baltic tribes (Yotvingians, Lithuanians, Prussians). The cities of the Belarusian Panyamonne (Grodno, Slonim, Volkovysk, Novogrudok, Tureisk) were founded by the Slavs in the 11th – 13th centuries and quickly became centers of political, economic, and cultural life in the region. The unique architectural school was formed in 12th century in Grodno. In the middle of the 13th century the territory of the Belarusian Panyamonne became the center of the formation new political association - the Grand Duchy of Lithuania. Belarusian Panyamonne is a historical and ethnographic region of Belarus. It is distinguished by a complex of specifc ethno-cultural features and occupies the territory of Grodno and adjacent parts of Brest and Minsk regions.
