Your Excellency’s Government has made several important and encouraging commitments to restore and protect freedom of expression in Malaysia. In light of these commitments, I am writing to provide a preliminary analysis of proposed and adopted legislation in the areas of sedition, press freedom, defamation, “fake news,” official secrets and film censorship, taking into consideration your Excellency’s Government’s obligations to respect, protect and promote the right to freedom of expression under international human rights law. I. INTRODUCTION Upon the election of the Pakatan Harapan coalition in May 2018, your Excellency’s Government promised to fight corruption and to “abolish laws that are oppressive and unfair”. In addition, the new Government has communicated to me its intention to reform laws and policies widely viewed as inconsistent with the country’s obligations under international human rights law. For instance, in June 2018, your Government responded to a communication concerning the Anti-Fake News Act of 2018 (ref. no MYS 1/2018), assuring this mandate that the Government had already begun the process of repealing the Act. At present, I understand that several laws that restrict freedom of opinion and expression in Malaysia remain in force.

    ASIATIC, VOLUME 7, NUMBER 2, DECEMBER 2013 Notes on Why Friends, Why Friendship into Poems Edwin Thumboo1 National University of Singapore Abstract History is especially important in a nation that does not have a long past. For the writer who has to work in cross-cultural terms, the study of English Literature would have stressed the importance of a working history, tapped to provide a sense of context, location and continuity. This is the case with Singapore, which is without a direct historical hinterland. But because it is small, economically strong and politically stable, there is need for the writer to construct missing continuities. This he does by looking not only at the past, but also into the present, its multi-racial, multi-ethnic character. For the present case, friends are both the crystallisation and detailing of this precise historical context, essential for the penetration of both contemporary culture as well as their antecedents. They represent experience as well as repository, a combination that makes them excellent conduits. In the case of Singapore, these cultures mean for the writer specifically the Chinese, Indian, Malay and Eurasian. Abstract Malaysia operates a dual legal system: Common/Civil law and the Islamic legal system. The common law system is a legacy of British colonialism, 1824-1957. The Shari‘ah based system is Islamic in which Islamic law is implemented in the country. The Supreme law in Malaysia is the Federal Constitution of Malaysia, which was created right after Malaysia gained independence in 1957. The constitution is the supreme law of the land in which all laws created in Malaysia, Islamic or civil law, must conform to the federal constitution. This paper discusses the position and roles of the Syariah Court in Malaysia as an Islamic institution in safeguarding the faith of the Muslims and upholding Islamic law as the basis of justice. The history of Syariah Court as one of the oldest institutions in the legal history in Malaysia is also highlighted so that one could see the original position of the court prior to the colonisation and after the colonisation. It is equally important to look at the jurisdiction of Syariah Courts in Malaysia which is divided into civil and criminal jurisdiction. This information is significant to see the extent of the application of Islamic criminal law in Malaysia, as a modern Muslim state.
