2 − Angola −

Angola accessed the UN Protocol on Trafficking in Persons in 2014. The current legislation on trafficking in persons in Angola, Law 3/2014, criminalises trafficking in persons for sex exploitation, forced labour, slavery and servitude, organ removal as well as child trafficking.

Between 2017 and 2018, 11 cases of trafficking in persons were reported by the National Authorities of Angola.

4 − Benin −

The current legislation on trafficking in persons in Benin criminalises both trafficking in persons and child trafficking.

Investigations and suspects

In 2017, 105 persons were prosecuted for trafficking in persons and 30 persons were convicted.

In 2017, 536 child victims of trafficking were recorded. Of those identified as victims of trafficking in persons, 361 were girls and 174 were boys.

Between 2016 and 2017, the victims of trafficking in persons in Benin were trafficked both domestically and transnationally.

The areas of origin from which the victims were trafficked within the national territory are Zakpota, , Waké, , Matérie, , , , Aguégués, Comé, Lalo, , , Porto-Novo, Sègbohouè, Bopa, Houéyogbé and Aplahoué. In the same period, victims of trafficking in persons of Benin nationality were identified in Ghana, Niger, Nigeria and Togo. Additionally, persons identified as victims of trafficking in persons were repatriated from Cote d’Ivoire.

5 − Botswana −

The current legislation on trafficking in persons in Botswana, the Anti-Human Trafficking Act introduced in 2014, covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol. Additionally, Article 114 of the Children’s Act of 2009, also addresses child abduction and child trafficking.

Investigations and suspects

Since the introduction of national trafficking in persons legislation in Botswana in late 2014, the Directorate of Public Prosecutions has recorded several investigations. In the period between 2015 and 2016, 13 cases of trafficking in persons were prosecuted and one conviction was recorded.

10 − Cabo Verde −

11 − Cameroon −

The current legislation on trafficking in persons in Cameroon covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

Investigations and suspects

The Ministry of Justice reported that 15 cases of trafficking in persons were under judicial investigations in 2017, while between 2016 and 2017, 26 cases were pending before trial. According to the police force of Cameroon, between 2016 and 2017, a total of 121 men and 31 women were identified as suspects of trafficking in persons. In 2017, 15 traffickers of foreign nationalities were reported as suspects.

In the period between 2016 and 2017, the Ministry of Justice reported that 12 persons were convicted of trafficking in persons and five persons were acquitted.

12 − Chad −

The legislation on trafficking in persons in Chad covers most forms of exploitation indicated in the UN Trafficking in Persons Protocol.

Trafficking in persons among the vast refugee population has been recorded by international organizations. The practice of child marriages under the age of 15 is frequent in the country. About 30 per cent of girls marry before they turn 15 and the median age of marriage for women is 16.

13 − Côte d’Ivoire −

The current legislation on trafficking in persons of Côte d’Ivoire covers trafficking in persons and child trafficking for the purpose of sexual exploitation and forced labour.

According to the Ivoirian authorities, in 2018, 5 cases of trafficking in persons were recorded.

Between 2016 and 2017, a total of 97 cases of trafficking in persons were registered by the police of Côte d’Ivoire, including some cases of child trafficking. In the same period, 25 investigations, 25 prosecutions and 10 convictions were recorded.

The Ivoirian authorities reported that 220 persons were prosecuted of trafficking in persons in 2018. In the same year, of those persons convicted of trafficking in persons, one was from Côte d’Ivoire, three were from Nigeria, and one from Burkina Faso.

15 − Democratic Republic of Congo −

The Democratic Republic of the Congo does not have a specific offence of trafficking in persons. In recent years, efforts have been made by the Government to criminalize the worst forms of child labour (Section 6 of the Labour Code), the enrolment of children under 18 years of age in armed forces (Act No. 09/001 of 2009), and child marriage (Family Code of 2016). In addition, the Sexual Violence Law of 2006 criminalizes and prosecutes child trafficking for sexual exploitation.

Victims

In 2018, a total number of 631 children were recruited in armed groups in the Democratic Republic of Congo. Of those recruited, 540 were boys abd 91 were girls. A total of 2,253 children (of which 267 girls) were separated from armed groups and militia. Almost half of the children were below the age of 15 when recruited (1,067) and 45 per cent were used as combatantas (1,014).

In 2018, the number of abductions decreased compared to previous years, with 367 children reportedly abducted, of which 270 were boys and 97 girls). The large majority of abduction were reported from North Kivu (291). Accounts of children recruited in armed groups and militia and subjected to forced labour and sexual violence remain widespread, including 95 girls and 56 boys who have been abducted by the Bana Mura militia.

Between 2014 and 2017, MONUSCO, The United Nations Organization Stabilization Mission in the Democratic Republic of the Congo, reported that 6,168 children were sperated from armed groups and militia, of which 5,619 were boys and 549 were girls. In the same period, 2,171 of those minors recruited, were under the age of 15 years old.

Overall, between 2014 and 2017, child recruitment decreased by 50 per cent nationally, while it exponentially increased in the Kansais region, following the escalation of the conflict. The vast majority of documented cases of child recruitment were registered in North Kivu (75 per cent).

According to MONUSCO, 13 per cent of the children recruited in armed groups were abducted, and 9 per cent suffered from sexual violence.

While boys represent the large majority of children recruited in armed conflict, the Patriotic Resistance Force of Ituri (RFPI) presents the highest percentage of girls among child soldiers (27%), compared with other armed groups. The majority of the girls recruited in the RFPI, Nyatura and NDC- Rénové armed groups, had reportedly been subject to forced marriage and sex slavery. In the same period, 16 boys recruited in armed groups and militia operating in Democratic Republic of Congo, were reportedly subject to sexual violence.

Between 2014 and 2017, the vast majority of children recruited in armed conflicts were of Congolese (DRC) nationality, low but steady levels of cross-border child recruitment from neighbouring countries were also recorded.

17 In 2017, the UN Committee on the Rights of the Child, reported numerous cases abuses against children in the Democratic Republic of Congo, including the sale and trafficking of children for intercountry adoption affecting more than 1,200 children.

In the same year, the Committee reported that the practice of child marriage was widespread. In addition in 2017, a large number of children internally displaced and a significant number of refugees arriving from neighbouring countries were registered. In this context, minors subjected to forced labour, especially in extractive industries were reported, notably in the the provinces of Katanga, North Kivu and South Kivu.

18 − Eswatini –

The current legislation on trafficking in persons in Eswatini covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

Investigations and suspects

Between 2010 and 2016, 6 cases of trafficking in persons were prosecuted. Of those cases prosecuted, one case was closed with a conviction in 2013 and in three cases the offenders were acquitted of charges related to trafficking in persons respectively in 2012, 2013 and 2015.

Between 2016 and 2017, 14 cases of trafficking in persons were reported and 14 investigations of trafficking in persons were registered. Additionally, two prosecutions of trafficking in persons were reported in 2016.

In 2016, 26 persons were identified as victims of trafficking in persons, of which two were children. In addition, two victims of child trafficking were identified in 2017. In the period between 2016 and 2017, most of the victims of trafficking identified were females (both girls and women) trafficked for the purpose of sexual exploitation, forced labour and domestic servitude.

Between 2016 and 2017, those identified as victims of trafficking in persons were trafficked both domestically and transnationally. The victims of domestic trafficking identified were trafficked from the rural areas of the region to the main touristic and commercial centres.

In the same period, victims of child trafficking of Gambian nationality were identified in Nigeria and Guinea Bissau. Victims of trafficking in persons were also identified in Sierra Leone and Guinea.

21 − Ghana −

The current legislation on trafficking in persons in Ghana, the 2005 Human Trafficking Act, covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol. Additionally, in 1998, the Child Act was approved to protect childrens from exploitative labour and child marriage.

28 − Guinea Bissau −

The current legislation on trafficking in persons in Guinea Bissau covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

In 2016, 106 cases of trafficking in persons were reported in Guinea Bissau. In the period between 2016 and 2017, 284 prosecutions of trafficking in persons were reported.

In the same period, the majority of the victims of trafficking in persons identified were boys of the Fula ethnic group, originating from the region of Bafata and Gabu. In addition, identified victims of trafficking in persons were mostly trafficked with the purpose of forced labour, forced begging, and sexual exploitation.

Between 2016 and 2017, victims of child trafficking originating from Guinea Bissau were detected in Senegal.

29 − Kenya −

The current legislation on trafficking in persons in Kenya covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol. In the Kenyan legislation, the crime of trafficking for sexual exploitation includes also offences prosecuted under the Sexual Offence Act of 2006, such as child prostitution and child sex tourism. Furthermore, the Counter-Trafficking in Persons Act of 2010, additionally includes removal of body parts in addition to organs as form of trafficking.

The current legislation on trafficking in persons in Lesotho covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

34 − Liberia −

The Act to Ban Trafficking in Persons approved in Liberia in 2005 covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol. In addition, child trafficking is criminalized and prosecuted also under the Child Law of Liberia.

Investigations and suspects

In the period between 2016 and 2017, 6 cases of trafficking in persons were reported and 6 investigations were registered. In 2016, 4 prosecutions and one conviction were reported, while one conviction was recorded in 2017.

Victims

In the period between 2016 and 2017, the majority of those identifed as victims of trafficking in persons were females (both girls and women). Primarily, victims were trafficked for the purpose of sexual exploitation and forced labour.

In the same period, Liberian victims were trafficked domestically from Bong, Nimbia Counties and Central Liberia to Monrovia. The majority of those identified as victims of domestic trafficking were children.

Between 2016 and 2017, victims of Liberian nationality were identified in Mali, Guinea and Sierra Leone. In addition in 2016, 25 victims were repatriated from Guinea and in the period between 2016 and 2017, victims of child trafficking were repatriated from Côte d’Ivoire.

In 2017, two victims originating from Sierra Leone were repatriated from Liberia.

35 − Madagascar –

The current legislation on trafficking in persons in Madagascar covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol but does not follow the definition of exploitation presented in the Protocol. The current Anti-Trafficking Law No. 2014-040 was introduced and implemented in 2015.

In 2017, the Ministry of Justice reported that a total of 54 traffickers were apprehended, of which 30 were male and 25 female. Furthermore, of those apprehended traffickers, 54 were from Madagascar and one trafficker was from the South Asian region. In the subsequent year, 5 males and 22 females were identified as trafficking offenders, and they were all citizens of Madagascar.

According to the Gendarmerie, between 2017 and 2018, a total of 44 traffickers were apprehended. In 2019, the Gendarmerie reported 26 traffickers, of which 21 were males and 5 were females. The persons identified as trafficking offenders, were all citizens of Madagascar.

Between 2017 and 2018, The Ministry of Justice reported 38 Malagasy female victims of trafficking in persons, of which 16 were girls and 22 were women. Additionally, the Minister of Justice reported that in the same period, three victims were trafficked for the purpose of sexual exploitation, 24 for the purpose of exploitation in the domestic sector and 10 for the purpose of forced marriage.

In 2017, 46 persons were identified as potential victims of trafficking in persons in Sierra Leone. Between 2016 and 2017, the majority of the victims of trafficking in persons identified were minors, both girls and boys. In particular, in 2016 and 2017, 21 and 12 children were respectively identified as victims of trafficking in persons.

In the same period, most of the identified victims were trafficked for the purpose of sexual and labor exploitation. Between 2016 and 2017, nationals of Sierra Leone were identified as victims of trafficking in persons in Gambia, Guinea, Liberia, Mali and Nigeria.

64 – The United Republic of Tanzania –

The current legislation on trafficking in persons in the United Republic of Tanzania covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

Investigations and suspects

Between 2015 and 2017, a total of 22 cases of trafficking in persons were investigated in Tanzania. Additionally, one conviction of trafficking in persons in 2015 and 6 convictions of trafficking in persons in 2016, were registered.

66 – Togo –

The Togolese Criminal Code criminalizes trafficking in persons for the purpose of sexual and labour exploitation in Art. No. 317-326. Specific provisions on child trafficking are also presented in the Children’s Code of 2007.

Investigations and suspects

Between 2016 and 2017, 101 cases of trafficking in persons were reported. In the same period, 90 cases of trafficking in persons were investigated.

According to the Togolese authorities, 16 persons were convicted of trafficking in persons in 2017 and 8 in 2018. All the persons convicted of trafficking in persons between 2017 and 2018 were Togolese nationals.

Victims

Between 2016 and 2017, the victims of trafficking in persons in Togo were trafficked both domestically and transnationally.

In the period between 2016 and 2017, 36 victims of child trafficking were repatriated from Gabon. Additionally, 9 victims of child trafficking were repatriated from Benin in 2017.

67 – Uganda –

The current legislation on trafficking in persons in Uganda, adopted in 2009, covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol. In 2016, further to the Anti-trafficking law, the Children Amendement Act was adopted to strengthen the measures against the harmful employment of children.

According to the Uganda Police Force, of those cases of trafficking in persons registered in 2018, 89 were prosecuted and 14 resulted in convictions. In the same period, the Uganda Police Force reported that 91 persons were prosecuted, and 19 persons were convicted of trafficking in persons.

In 2017, the national authorities of Zambia reported victims of Zambian and Congolese (DRC) nationality. Of those victims of Zambian nationality reported, 2 were female and one was male.

In 2018, national authorities identified both male and female victims of Zambian nationality and 9 female victims of Congolese (DRC) nationality.

Additionally, in 2019, national authorities reported 12 victims of Zambian nationality, of which 6 were male and 6 female. In the same period, foreign victims of trafficking originating from Congo (DRC) and Rwanda were also identified.

71 – Zimbabwe –

The current legislation on trafficking in persons in Zimbabwe, the Trafficking in Persons Act, covers all forms of trafficking indicated in the UN Trafficking in Persons Protocol.

Between 2014 and 2016, 91 persons were identified as victims of human trafficking. Of those identified as victims, 90 were trafficked for the purpose of sexual exploitation and one was trafficked for the purpose of labour exploitation.
