Minutes of a meeting of Town Council Planning Committee held in the Council Offices, The Old Convent, Ottery St Mary on Tuesday 6th January 2015 at 7pm

Present: Chairman: Councillor Carter Councillors: Dobson, Holmes Talbot, Giles, Pratt, Pang and Bartlett Together with the Deputy Clerk

1. P/15/01/01 To receive Apologies Apologies were received from Councillors: Watmore, Thurgood, L. Harding, Mitchell, Bailey and Hansford.

2. P/15/01/02 To receive Declarations of Interest and requests for new Disclosable Pecuniary Interest (DPI) Dispensations for items on the Agenda Councillor Dobson declared a Personal Interest in Application 14/2919/TCA as he owns a property two doors away. 3. P/15/01/03 Reports, Correspondence and Items referred to the Committee Correspondence forwarded by Town Council to the Chair of the DMC at East regarding Sidmouth Town Councils Planning Committee (including their Ward Members) opposition to an application which was referred to DMC and subsequently refused. The said application was then determined under the delegated scheme. P/15/01/04 Information regarding an Adjoining Parish planning application ( and Buckerell) 14/2882/MFUL concerning flood alleviation works at Land North and South of Lyndale Station Road, Feniton. Duly noted. P/15/01/05 Appeal Decision APP/U1105/A/14/2225636 – The Old Manse, 9 Mill Street, Ottery St Mary, EX11 1AA. The Appeal was dismissed. P/15/01/06 Email information from the owner of the Ottermill Switchgear Factory building stating he is approaching the Senior Planning Officer at EDDC for a request to demolish the Factory building in February in advance of all reserved matters being dealt with. Duly noted.

P/15/01/07 Memo from the EDDC Arboricultural Team informing of a Tree Preservation Order – 14/0026/TPO made in respect of Land at Higher Metcombe Cottage, Metcombe, Ottery St Mary. Noted. P/15/01/08 Grant of Conditional Planning Permission for a small scale community composting facility at Woods Farm, , Sidmouth, EX10 OJS. Noted. P/15/01/09 Email notification from EDDC Enforcement Officer in relation to 14/FO787 – Silver Birch, Ridgeway, Ottery St Mary, EX11 1DX – Tree House not being built as approved/ Duly noted.

P/15/01/10 Planning Decisions Received 14/1227/MOUT – Former Gerway Nurseries, Sidmouth Rd, Ottery EX11 1PN Granted ** 14/2416/FUL – Land at Meadowgate, West Hill, Ottery St Mary, EX11 1UZ Granted ** 14/1745/VAR –Land At Barton Orchard, Tipton St John Granted ** 14/1230/RES – Land Adjacent Greytops (Coopers Court) West Hill Granted 14/2726/FUL – 8 Grandisson Drive, Ottery St Mary, EX11 1JD Granted Planning applications marked with ** do not agree with the EDDC decision

P/15/01/11 5 To consider and determine observations on the following Planning Applications A member of the public spoke on the application 14/2861/MRES highlighting:  Inadequate parking with just two visitor parking spaces for the retirement homes. It was felt visitors will park in Eastfield and use the entrance to the field as a turning point.  Lack of screening which was promised by the applicant 13 months after the Outline was granted and has not happened. This was for a 2 metre high close- boarded fence between the orchard and the Eastfield properties. Reference Applicant Details 1) 14/2861/MRES Blue Cedar Homes Reserved matters application for the erection of 25no dwellings (seeking approval of appearance, layout, scale & landscaping) pursuant to permission 13/1809/MOUT Land North of Eastfield, West Hill. The Planning Committee would like to add the following concerns to this application:  a 2 metre close boarded fence should be erected at the boundary behind the community orchard and open market bungalows to prevent access onto the Devon Bank and this will extend across the rear aspect of 3 properties in Eastfield.

-73-  Parking – more than 2 visitor spaces are needed in the Blue Cedar scheme, to lessen the risk of visitors parking in Eastfield.  The Eastfield residents remain strongly opposed to anything other than bungalows to back onto Eastfield, which are all bungalows. They have consistently stated this since the earliest consultation. The new plan shows one and a half storey dwellings. The land on the development site is higher than Eastfield and slopes upwards throughout the site

A member of the public spoke on the applications 14/2820/FUL and 14/2820/FUL highlighting:  The AONB runs along this track towards East Hill Strips which would have an impact on the countryside  The surface water on this site is a serious problem and it is usual in the winter for ¾ of the track to be washed away  Concerns that there will be more animals on the site plus 11 dogs so this will bring added noise issues

2) 14/2820/FUL Selley Siting of temporary mobile home for agricultural worker Ware Farm (Land At) Ottery St Mary, EX11 1PJ The Planning Committee unanimously does not support this application:  Lack of Agricultural justification  Adverse impact in an Area of Outstanding Natural Beauty  Surface water run off  The size of the holding at 16 acres is insufficient to support an agricultural dwelling  Dirty water run off from the animals

3) 14/2820/FUL Selley A M E N D E D P L A N S Updated Agricultural Appraisal Ware Farm (Land At ) Ottery St Mary, EX11 1PJ The Planning Committee unanimously does not support this application:  Lack of Agricultural justification  Adverse impact in an Area of Outstanding Natural Beauty  Surface water run off  The size of the holding at 16 acres is insufficient to support an agricultural dwelling  Dirty water run off from the animals

4) 14/3008/FUL Doherty Two storey side extension with rear terrace, enlarged dormer on front elevation & additional dormer on rear elevation Kings Gatchell, Higher Metcombe, Ottery St Mary, EX11 1SL The Planning Committee supports this application

5) 14/2586/FUL Howells Construction of dwelling with associated access, parking and ancillary outbuilding 10 Washbrook View, Ottery St Mary, EX11 1EP The Planning Committee unanimously supported this application subject to the Environment Agency being satisfied with the redirection of the Leat.

6) 14/2919/TCA Lascelles T1, Eucalyptus - Fell 29 Mill Street, Ottery St Mary, EX11 1AB The Planning Committee has no objection to this application

P/15/01/12 6. To consider a proposal from the Ottery St Mary Food & Families Festival regarding a road closure in June 2015 The Committee agreed in principle to support the Food & Families Festival on June 6th but would like more satisfactory information regarding the alternative arrangements for the Buses during the 9am – 5pm period.

P/15/01/13 7. To Receive Councillors’ questions relating to Planning Matters There were none
