Noda† INTRODUCTION In a celebrated children’s song, Malvina Reynolds observes that love is “just like a magic penny, / hold it tight and you won’t have any. / Lend it, spend it, and you’ll have so many / They’ll roll all over the floor.” 1 Just as love sometimes means letting go, the doctrine of fair use recognizes that the purposes of copyright are sometimes better served by allowing certain forms of infringing activity to occur. The four-factor test for fair use, codified at 17 U.S.C. § 107, affords courts sufficient latitude to fine tune the analysis in light of changing circumstances. The recent surge of interest in anime and manga, or Japanese animation and comics, 2 brings with it distinctive examples of what may be dubbed “fan-based activities,” which indicate how courts can adapt the fair use analysis to best balance the public’s access to creative works with the interests of copyright holders. It seeks to elucidate the strategies and institutional mechanisms through which the authorities in Osaka attempted to regulate the urban poor from the immediate aftermath of the Meiji Restoration to the Pacific War. It begins by examining the dissolution of early modern Osaka’s beggar fraternity, the kaito nakama, and considering the impact of the Restoration and subsequent dismantling of the early modern status system on the practice of poverty management and the lives of the urban poor. Following the Restoration, the mechanisms through which the authorities in Osaka attempted to regulate the poor underwent a dramatic transformation. For centuries, the authorities had permitted thousands of the city’s poorest residents to survive by gathering alms. However, in the early 1870s, officials came to view begging as a deleterious practice that encouraged idleness and dependence and stripped otherwise able-bodied individuals of their desire for self-sufficiency. Some asserted that if the practice were allowed to persist, it would ultimately undermine the vitality and stability of the fledgling Meiji state. In order for Japan to compete with the comparatively affluent states of the West, officials came to believe that it was necessary to mobilize the entire populous, including the members of economically disadvantaged groups previously permitted to subsist on the margins of the urban economy.

Despite much research concerning representations of the war in mainstream culture, little is known about representations in amateur works. This dissertation analyzes images of war in Japanese fan productions, defined via a modified concept of the 'circuit of culture'. I focus on four forms: music, dōjinshi (fan comic books), fan videos and military cosplay. I identify three main concepts necessary in the analysis of war‐themed fan productions: kandō, nostalgia, and pop nationalism. Kandō is a strong emotional reaction to given content. Nostalgia allows idealization of the past and its perception according to the needs of the present day. Finally, pop nationalism is a trend of 'loving Japan' expressed though small things like support for Japanese sports, national symbols and Japanese products, but without explicit reference to historical consciousness or politics of the contemporary state. These three elements are recurring aspects of the fan productions discussed.
