Public Hearing Opened for Text Amendments to Leesburg Code of Ordinances Bob Alexander, City Manager of Leesburg, addressed the board about modifying the proposed text amendments for the Overlay District for the City of Leesburg until staff attends the Rural Zone Applicant' s Workshop on Tuesday, April 10`h. Another public hearing will be held in a month to include the modifications.

Darrel Finnicum made a motion to reschedule to next month. Motion was seconded by Jason Sheffield and the Planning Commission voted to approve the motion unanimously.

COUNTY LAND USE DEVELOPMENT APPLICATIONS

JCI Construction( Z18-011) has submitted a Conditional Use application to the Lee County Planning Commission for a multi- unit storage complex for self-storage and RV and Boat accommodations on property located on Ledo Road near US Hwy 19 intersection. Property is

7 zoned C- 2( General Commercial District). The property owner is JW Congregation Support and the applicant is JCI Construction.

Chris Guarnieri read the agenda item and Megan Fowler presented the staff report. Jack Loyd was present to represent the application.

Discussion followed to include the conceptual plan and a future market study. Mr. Loyd gave several design options for the facade of the proposed mini warehouses. The first phase will be located closer to Wendy' s fast food restaurant and Dollar General. He discussed the option of a stucco facade with masonry work to provide an aesthetically pleasing appearance to Ledo Road. He indicated that a management office will be centrally located in the middle of the 7. 37 acre lot and that the entrance would be approximately 640 feet from the intersection at Ledo Road and North Slappey Blvd,/ US Hwy 19 S in order to minimize traffic jams and to accommodate future development of Phase 2 on the opposite side of the lot.

Chris Guarnieri made a motion to approve the Conditional Use for this applicant only. Motion was seconded by Chad Arnold. Planning Commission voted to approve the motion unanimously.

9 Rfq BASIC INFORMATION Lanier Engineering. LLC has submitted an application to rezone 9. 64 acres from C- 2( General Business District) to R-2( Multi- Family Residential District). The rezoning includes a preliminary development plan for a 46 unit( 5- one bedroom and 41- two bedroom apartments) senior adult complex, consisting of single- story. garden style apartments, and a community clubhouse with gathering area, fitness center and other amenities. A successful rezoning and approved development plan will allow for the proposed multi- family residential development.

Section 70- 205.— Procedures For rezoning only. a) No rezoning of property to R-2 will be effected until preliminary development plans have been reviewed and approved by the board of commissioners for the proposed site. b) A petition for rezoning land in this district shall be submitted to the county planning office the same as with any zoning request. c) A written statement to accompany the zoning application must contain the following: d) An explanation of the character of the development. e) A statement of present ownership of all land included within the development. f) A general indication of the expected schedule of development. g) Required plans. A preliminary development plan or conceptual development plan shall be submitted by the applicant with the initial rezoning application. Zoning approval without a preliminary development plan shall be conditioned on such plan being submitted and approved. The preliminary development plan shall include all of the following information: h) A preliminary site plan at a scale not less than 1"= 200', depicting all existing masses of trees and other natural features including the topography of the land. A preliminary solution of all storm drainage needs shall be included. i) The location and grouping of all uses and the amount of area for each, plus preliminary utility service plans. j) The tentative location of each residential density district, the number of residential units proposed for each density district, their general location, proposed lot designs and district lines. Tentative floor plans and exterior elevations, which need not be the result of final architectural decisions but which shall adequately describe the development, shall also be included. k) A preliminary vehicular and pedestrian circulation system including driveways, walkways, loading areas, parking areas including the number of parking spaces, and streets to be dedicated. I) A system of open space and recreational uses in residential projects with estimates of acreage to be dedicated for public use and that to be retained in common ownership. m) A draft of the declaration by which the use, maintenance and continued protection of the development and any of its common open space areas shall be submitted. n) A development schedule indicating the stages in which the project will be built and the approximate date when construction of each stage can be expected to begin, the anticipated rate of development, the approximate dates when the stages in the development will be completed and the area and location of common space that will be provided at each stage. o) The planning commission shall review and make recommendation to the board of commissioners for approval ofthe preliminary development plan. In reviewing a development site plan in this district, the planning commission shall consider the following criteria, to the extent relevant in each case, in evaluating the merits and purpose of a multi- family development. Individual lots, buildings, streets evaluating the merits and purpose of a multi- family development. Individual lots, buildings, streets and parking areas should be designed and situated to: p) Minimize alteration of the natural features and topography. q) Minimize the adverse effects of noise and traffic on off-site residents. r) Allow for proper and adequate access for fire fighting purposes and access to service areas to provide garbage and waste collection and for other emergency and accessory services. s) Achieve a compatible relationship between development and the land as well as with adjacent developments and land. t) The proposed development should not adversely affect the orderly development of the county. u) The proposed development shall accomplish the objectives and shall meet the standards and performance criteria as outlined in this article.

10 v) Final development plan. Following the approval of the preliminary development plan, the applicant shall. within six months, submit to the planning commission a final development plan containing in final form the information required in the preliminary development plan. The planning commission shall review and approve the final development plan to see that it is in compliance with the preliminary development plan. The planning commission may approve changes in the final development plan which comply with the following criteria: w) The revised plan contains the same or a fewer number of dwelling units or structures and/ or floor area. or x) The open space is in the same general location and in the same general amount, or a greater amount, or y) The buildings have the same or less number of stories and/or floor area, or z) The roads and drives follow approximately the same course. aa) Final approval. No building permits shall be issued until the approval process is complete and all necessary plans, drawings, specifications and other required data have been submitted and approved. No construction may commence until the entire approval process is completed and appropriate permits issued.

Pi-IYSICAL CHARACTERISTICS AND INFRASTRUCTURE The property does not lie in the 100 year floodplain. Public water and sewer are available in this area and will be connected during development process. Access to the property will be from Westover Road.

PLANNING CONSIDERATIONS

Listed below are several issues for consideration in evaluating this rezoning application.

I. Will the zoning proposal permit a use that is suitable in view ofthe use, development and zoning ofadjacent and nearby property? The property will allow for multi- family residential development to include single story, garden style apartments for senior adults, which is a compatible use to the adjacent single family residential subdivision( Palmyra). Commercial properties front Ledo Road and Westover Road_ with residential uses to the rear, providing retail sales. restaurants and recreation opportunities to residents. Appropriate vegetative buffers and screening from existing commercial uses, will mitigate any adverse effects of noise, lighting and operating hours, on the residential properties.

2. What is the effect on the property value ofthe subject property should the existing zoning be retained? Subject property has a reasonable economic value under the existing C- 2 ( General Business District) zoning which allows for retail or service establishments, wholesale, storage buildings, warehousing; distribution facilities, commercial greenhouses and nurseries, indoor shooting ranges, churches, clubs and fraternal organizations. hospitals. clinics, nursing homes or group homes, child care facilities and mortuaries. Rezoning to R-2( Multi- Family Residential District) will allow for the permitted use of apartments and expand housing options in the community.

3. Ifdenied, will the effect on the applicant' s property value under the existing zoning be offset by the gain to the health, safety, morals or general we/fare ofthe public? If the zoning proposal is denied. there should be no gain to the health, safety, morals or general welfare of the public.

4. Will the zoning proposal result in a use which will or could cause an excessive or burdensome use ofexisting streets, transportation facilities. utilities, schools, fire protection, public health fcilities, or emergency medical services? According to the Zoning Ordinance. the R- 2. multi- family residential district is designed to permit residential use of land with various types of multiple dwellings and related uses. For good accessibility, this district shall be located adjacent to arterial and/ or collector roads. Public water and sewer shall be required. Any developments in this district shall be designed to complement adjacent, existing or planned. single- family developments. Various types and sizes of residential

11 accommodations, for ownership or rental. would thereby be provided to meet the needs of the different age and family groups in the community without overtaxing existing community facilities, utilities or services. It is also the intention of this section to provide areas of sufficient size and allowing reasonable flexibility in design and orientation for the establishment of a structure or group of structures which include multiple dwellings designed in a planned unit development of more than one building on a given site.

The permitting of these planned unit developments as special and particular land uses can, in certain cases, increase the desirability and convenience to the residents or occupants of the planned unit development without causing adverse effects on adjoining properties. This type of development will permit a creative approach to residential development. A planned unit development will provide for an efficient use of land potentially resulting in more economical networks of streets and utilities thereby lowering housing and other land development costs as well as enhancing the appearance of neighborhoods through the preservation of natural features and the provision of recreation areas and open space.

Specifically related to Townhouse, condominium, and apartment developments, each individual dwelling unit shall contain at least 900 square feet of floor areas within outside walls exclusive of basements, unfinished attics, garages, porches or other such areas not normally used for human habitation. Construction plans designate 900 square feet for one bedroom apartments and 1, 194 square feet for two bedroom apartments. A row or grouping of dwelling units shall not exceed 250 feet in length. Plans demonstrate a maximum of 69 feet in building length, and buildings will not be in a linear arrangement, with more than a 30 foot angle between buildings. Interior parking spaces will provide privacy to residents, and be situated around the clubhouse, gazebo and community garden. open area. Zoning requirements include one parking space per unit, this complex requires 46 spaces and two handicap spaces: construction plans detail 59 parking spaces including eight handicap spaces, in excess of required parking.

According to Stephen B. Corcoran, P. E., report Senior Housing Trip Generation and Parking Demand Characteristics; special housing projects are being developed for the aging baby boomer generation, in lieu of the traditional single-family home or apartment. The changing lifestyle of older adults affects the transportation needs and usage as well, differing significantly from traditional residential uses. In this particular instance, this proposal incorporates Senior Apartments, defined by Corcoran, as traditional apartment complexes with a minimum age of 55 years old, and typically includes amenities of recreational facilities, security, and special design features. Residents are independent and may still be working.

Impact on the School System: Development should have no impact on the school system. Impact on Utilities: Public water and sewer will be provided by Lee County Utilities Authority. Impact on Transportation Network: Staff estimates that the impact on the surrounding transportation network would be as follows: Commercial development will be located on the Lee County side of N Westover Road, which is primarily undeveloped. Traffic data for Westover Road is not available. Access to N Westover Road is provided from Ledo Road,( Principal Arterial): GDOT 2016 traffic count identified 14.600 vehicles on Ledo Road. closest location near Cartmell Drive: which has a traffic capacity of 39, 800 vehicles. According to Trip Generation, 9th Edition. [' FF., 2012, senior adult housing units could generate 3. 44 weekday trips per dwelling unit. Based on 46 units, 148 weekday trips could be generated. Road Improvements: According to the FY 2015- 2018 Transportation Improvement Program and the Dougherty Area Regional Transportation Study: 2040, Roadway Project 0010571, is proposed for Westover Road Connector from Albany Mall to Ledo Road( 0. 19 mile TBD pending environment approval). Analysis: There is adequate traffic capacity available on Ledo Road to support the proposed development. Additional access will be provided by the future extension of the Westover Road Connector.

12 Ordinance requires each dwelling unit to have a minimum of two paved off-street parking spaces with direct access to a county road. Parking spaces and driveways are permitted in the front yard of a lot if a setback of 35 feet from the riuht-of=way is maintained and the front yard is properly landscaped. Site design provides for 92 parking spaces for 46 dwelling units. maintaining a minimum 35' building setback. The complex will have direct access to N Westover Road.

the proposed senior apartment development. is consistent with the intent of the R- 2( Multi- Family Residential District); increases the variety of dwelling types in the housing market, meeting the needs of senior adults in the community, without overtaxing existing community facilities, utilities or services. Apartments are a permitted use in the R- 2 District, with individual multi- family dwelling units allowed up to 12 per acre. The proposed development presents a significantly lower density of 4. 8 units per acre.

5. is the zoning proposal in conformity with the policy and intent ofthe litture land use plan for the physical development ofthe area? Yes

6. Is the subject property well suitedfor the proposed zoning purpose? Subject property is well suited for multi- family residential uses, adjacent to an established single- family residential neighborhood, and located behind commercial uses fronting on arterial roads. Necessary infrastructure exists to support the residential development.

7. Will the zoning proposal adversely affect the existing use or usability of adjacent or nearby property,? There should be no adverse effect to the existing use or usability of adjacent or nearby property.

8. Are there other existing or changing conditions affecting the use or development ofthe subject property which give supporting groundsfor the approval or disapproval of the zoning proposal? No

9. Would the change create an isolated district unrelated to the surrounding districts, such as " spot zoning"? Rezoning to R-2 for subject property will not he considered" spot zoning", as the surrounding area exhibits mixed- use of single- family residential, commercial( retail, office. medical and service establishments), and institutional( religious institution and proposed hospital) uses. The site is of such scale, to support almost ten acres of multi- family residential use.

I4. Are the present zoning district boundaries illogically drawn in relation to existing conditions in the area? The zoning district boundary is logically drawn for the proposed use. accounting for apartments. parking, clubhouse, gazebo, community garden and open space.

I I. Is the change requested out ofscale with the needs oldie county as a whole or the immediate neighborhood? The proposed senior apartment development will have a site density of 4. 8 units per acre: 46 units including 5- one bedroom apartments and 41- two bedroom apartments. with a clubhouse. gazebo and community garden. on a 9. 64 acre site. Market analysis provided by developer; demonstrates a waiting list and need for additional senior living arrangements within Lee County.

12. Is it impossible tofind adequate sites for the proposed use in districts permitting such use and already appropriately zoned? Alternative sites suitable for senior adult apartments. would require the necessary infrastructure of public water and sewer. transportation improvements and adequate open space and land development procedures. requiring additional time and professional services for engineering and construction plans.

13 13. Would there be an ecological or pollution impact resultingfrom the proposed zoning ifit is granted? Environmental considerations have been evaluated during the land development process and there should be no adverse effects if the property is rezoned to R- 2. The building,permit process will ensure that no ecological or pollution impact will result from development of the senior adult complex.

14. is the rezoning proposal in conformity with the policy and intent ofthe Lee County./Leesburg/Smithville Comprehensive Plan for Development? Future Land Use Goal of Housing is to ensure access to safe and affordable housing choices for a diverse population with controlled residential growth for high quality of life for everyone with adequate community facilities and services. New development in areas with adequate infrastructure and community facilities is preferred. The proposed location will be served by Lee County water and sewer, existing and planned transportation improvements, and close proximity to nearby commercial uses and the proposed Lee County Medical Center. Stormwater management will be provided in the existing Lee County retention pond located adjacent to and north of the site. Proposed site and construction plans demonstrate the development' s conformity to the county' s comprehensive land use plan.

RECOMMENDATION

Staff recommends approval to rezone to R-2( Multi- Family Residential District) and approval of the Preliminary Development Plan of 46 senior adult apartments.

Subject: Request for Qualifications( RFQ) for GIS/ Tax Map Consultant

In an effort to address the county' s mapping issues involving GIS and Tax Parcel data, joint departmental staff( Planning and Tax Assessor) are requesting permission to prepare a Scope of Work and publish a Request for Qualifications ( RFQ) to select a consultant.

Selected consultant would update the GIS parcel layer to be the Official Tax Map and create a contiguous zoning GIS layer to serve as the Official Zoning Map for Lee County. Additional GIS layers to be created include an accurate Land Lot layer, dashed parcel lines ( previous lot lines) layer and a parcel text annotation) layer. The database will integrate WinGap with GIS, to allow for automated update of the parcel attribute data on a regular basis.

Lee County Board of Commissioners,

I' d like to submit a short summary regarding our current property tax software, Thomas Reuters, formally named Manatron, that might help with the understanding of why I am requesting new software in my budget.

When we first started using Manatron to handle the property taxes it was a big step up from the old software being used when I first came into office. Several years ago Manatron was bought out by Thomas Reuters. While Thomas Reuters may be a well known name, property tax does not appear to be a priority for them. Over the years there have been numerous and continuous glitches with the software. Within the last year on two different occasions, I had an accounting issue, and a tax bill issue and had to put in a ticket for tech support. After days of not getting the issue resolved, I was asked to call a neighboring county to help me. The other occasion, tech support called a neighboring county to help them figure out how to fix the problem.

I have never dealt with a company who was not be able to address a problem regarding their own software. While our county is paying for tech support, I should have never been asked to call another county tax commissioner for help. Both of these incidents show me that the support needed is not there and is not a priority. Over the last several years, since Thomas Reuters bought the company, I have had a different" new" person, attempt to help with the digest submission. I literally dread the digest process!

Had Manatron not been bought out by Thomas Reuters, I feel our current software may have continued to be developed to give the tax commissioners offices what we need. I hope the BOC will consider updating our software. I have submitted in my budget a proposal of $68,750 for new software. If approved, we will not begin implementation until after the 2018 digest is submitted.

Consideration to approve the purchase of a Pursuit Sedan ( Taurus) All Wheel Drive Interceptor for the Sheriff's department in the amount of$23, 526. 00.

BACKGROUND

One of the front line patrol cars was involved in an accident that resulted in the 2014 Charger being totaled, through no fault of the officer. This same vehicle had been previously involved in two additional accidents and had in excess of 130, 000 miles. The insurance company issued a check in the amount of$3, 985. 00 after the $ 1, 000. 00 deductible.

Wade Ford has a Pursuit Sedan ( Taurus) Interceptor on the ground for, pickup under a government state- wide contract price of$ 23, 526. 00, to be purchased with SPLOST funds. We are requesting authorization to move forward immediately with the purchase of the vehicle. Co County Manager Sistrunk has spoken with Harry Prisant, Albany Ford Town Fleet Manager and he currently does not have any pursuit vehicles available for purchase. The City of Albany is purchasing 41 patrol cars from Ford Town; however they won't be delivered until August or September and are the same price.
