1 DETAILS OF PARTIES

1.1 The names and addresses of the parties to the reference are as follows:-

(a) Freightliner Limited whose Registered Office is at 3rd Floor, 90 Whitfield Street, W1T 4EZ (“Freightliner”) ("the Claimant"); and

(b) Infrastructure Limited whose Registered Office is at 1 Eversholt Street, London NW1 2DN ("Network Rail") ("the Defendant").

1.2 Other Train and Freight Operating Companies that could be affected by the outcome of this dispute:

(a) Greater Anglia (Abellio Ltd), MTR Corporation () Ltd, Rail London Ltd, GB Ltd, DB Cargo (UK) Ltd, (Trenitalia c2c Ltd)

2 CONTENTS OF THIS DOCUMENT

This Response to the Claimant’s Sole Reference includes:-

(a) Confirmation, or qualification, that the subject matter of the dispute is as set out by the Claimant in its Sole Reference, in the form of a summary schedule cross-referenced to the issues raised by the Claimant in the Sole Reference, identifying which the Defendant agrees with and which it disagrees with.

(b) A detailed explanation of the Defendant’s arguments in support of its position on those issues where it disagrees with the Claimant’s Sole Reference, including references to documents or contractual provisions not dealt with in the Claimant’s Sole Reference.

(c) Any further related issues not raised by the Claimant but which the Defendant considers fall to be determined as part of the dispute;

(d) The decisions of principle sought from the Panel in respect of

(i) legal entitlement, and

(ii) remedies;

(e) Appendices and other supporting material.

3 SUBJECT MATTER OF DISPUTE

(a) Regarding Freightliner’s Section 4.1, Network Rail confirms that this is a dispute regarding Network Rail’s ‘Decision Document Week 39/40 Liverpool Street to Shenfield’ issued 29/7/2019. Network Rail clarifies that it believes the dispute is specifically regarding elements of that Restriction of Use (RoU) which impact Freightliner services on 27 and 28 December 2019, and that other elements of the RoU are not part of the subject matter of dispute (in line with Freightliner’s Section 6.1).

(b) Regarding Freightliner’s Section 4.8, Network Rail clarifies that it interprets Freightliner’s dispute to be about Network Rail’s application of the Decision Criteria to this Restriction of Use (RoU) as specified by Network Code clause D3.4.4 (b) and the communication of this to Timetable Parties.

(c) Regarding Freightliner’s Sections 4.1 to 4.7, Network Rail confirms the general timeline presented.

(d) Regarding Freightliner’s Sections 4.2 to 4.7, elements of Section 4.8 and Section 4.9, Network Rail has interpreted these to be generally part of Freightliner’s arguments to support its case rather than part of the Subject Matter of Dispute and has therefore addressed these under Section 4 below for clarity.

4 EXPLANATION FROM THE DEFENDANT’S PERSPECTIVE OF EACH ISSUE IN DISPUTE

4.1 Issues where the Defendant Accepts the Claimant’s Case

(a) Regarding Freightliner’s Section 4.2, Network Rail accepts that the proposal for the additional Restriction of Use (RoU) (09 July 2019) was made after the date of issue of the Confirmed Period Possession Plan (CPPP) (09 June 2019). Network Rail confirms that the effect of the RoU on Freightliner’s services is that on Friday 27 December only a diesel-hauled route is available via Stratford, and that on Saturday 28 December no route is available via Stratford, therefore requiring freight services to divert via the “cross-country” route - Leicester, Nuneaton, Peterborough and Ely.

3 of 9 (b) Regarding Freightliner’s Section 4.5, Network Rail accepts that Freightliner responded on 16 July 2019.

(c) Regarding Freightliner’s Section 4.6, Network Rail accepts that the Decision Document for the RoU was issued on 29 July 2019.

(d) Regarding Freightliner’s Section 4.7, Network Rail accepts that Freightliner lodged the dispute relating to this RoU on 31 July 2019.

(e) Regarding Freightliner’s Section 4.8, Network Rail accepts the acknowledgement that Network Rail consulted Timetable Participants for this RoU.

4.2 Issues where the Defendant qualifies or refutes the Claimant’s Case

(a) Regarding Freightliner’s Section 4.2, Network Rail clarifies that the RoU that was proposed covers 5 days (25 December 2019 to 29 December 2019 inclusive) but that the timing of it means that only 2 of these days impact Freightliner’s services (25 and 26 December 2019 being a Christmas shutdown, and 29 December 2019 being a Sunday with limited freight operations).

(b) Regarding Freightliner’s Section 4.3, Network Rail qualifies that although Freightliner declined the proposal on 09 July 2019 as noted, the reason provided was only around the timing of the proposal [See Timeline in Appendix A].

(c) Regarding Freightliner’s Section 4.4, while as noted, the essence of Network Rail’s response on 11 July 2019 was that in its view, progressing with the RoU in question was the best option available, Network Rail clarifies that in this response it requested Freightliner to confirm if there were any specific issues with the RoU, such as cross-country diversionary route availability or other restrictions in an effort to seek a suitable solution.

(d) Regarding Freightliner’s Section 4.5, Network Rail clarifies that Freightliner had not raised any qualifications on the Christmas blockade RoU through the Engineering Access Statement process and qualifies that it does not believe that this in itself was a reason to decline the RoU. Network Rail clarifies that while the interface between the Stratford RoU and the Colchester Christmas blockade RoU is

4 of 9 relevant due to its combined impact on the Timetable, this can be accounted for in the application of the Decision Criteria [Appendix C]. Network Rail clarifies that the benefits from having the route available around the Colchester Christmas blockade RoU still apply to freight operators on 30 and 31 December 2019 and to passenger operators on 27 to 31 December 2019 inclusive.

(e) Regarding Freightliner’s Section 4.6, Network Rail qualifies that although Freightliner’s requests were not accommodated by the Decision Document for the RoU, it was not “completely ignoring” Freightliner’s response and referred in the Decision Document to the concerns raised by some operators, and the continued efforts to seek to resolve these. Network Rail aimed to take into account all of the responses received alongside the requirements for the delivery of the work. Network Rail clarifies that the RoU was accepted at this stage (with some caveats) by Greater Anglia, MTR Crossrail, , GB Railfreight and DB Cargo. Network Rail clarifies that allowing a (diesel-only) route via Stratford and the for freight on Friday 27 December 2019 in the proposal and Decision for the RoU was a concession aimed at freight operators demonstrating that steps had been taken earlier in the process to accommodate freight as far as possible.

(f) Regarding Freightliner’s Section 4.8, Network Rail clarifies that although it has not shared evidence of the application of the Decision Criteria with Timetable Participants, Network Rail made the decision by application of the Decision Criteria in accordance with Condition D4.6. To support this Timetable Hearing, Network Rail has formalised this by preparing a detailed Decision Criteria document. Refer to Appendix C. Network Rail believes that this Decision Criteria document demonstrates that overall, the benefits of progressing with the RoU as per the Decision Document outweigh the disbenefits, including those raised by Freightliner.

(g) Regarding Freightliner’s Section 4.9, Network Rail clarifies that although no formal information has been shared with Timetable Participants about the consequences of not progressing the RoU to the delivery of the Crossrail Timetable, Network Rail has organised meetings between the Crossrail Traction Power upgrade team and Timetable Participants to share updates and discuss strategy for the overall Traction Power scheme (eg 23rd Feb, 11th April, 30th May – refer to Timeline in Appendix A). To support this Timetable Hearing, Network Rail has prepared a detailed

5 of 9 Impact Statement document covering specifically the impact of not progressing elements of the RoU that are the subject matter of this dispute - refer to Appendix D. This Impact Statement also supports the Decision Criteria document (Appendix C). As noted in these documents, the Traction Power upgrade work provides an improvement to the capability of the Network in order to support future passenger Timetable increases, introduction of the New East Anglia Trains fleet and the continued operation of electric freight services. The works planned in the RoU in question and specifically on 27 and 28 December 2019 contribute directly to the January 2020 commissioning activity between the new Pudding Mill Lane feeder station and Manor Park, which is followed by a sequence of commissioning activities in the subsequent weekend RoUs through to completion in April 2020. Completion of the work by May 2020 is also a Network Rail commitment monitored by the ORR and would be subject to additional project costs if delayed.

(h) Regarding Freightliner’s Section 5.1, in relation to the comments that “Network Rail should not be proposing additional Restrictions of Use for major projects such as Crossrail outside of DPPP & CPPP timescales...”, Network Rail confirms that it seeks to avoid such timescales where practical, but qualifies that the timescales at which the RoU was progressed are covered by the conditions of Network Code Section D3. The Timeline (Appendix A) helps to outline the background to the timing of the proposal and Decision for the RoU. Network Rail acknowledges the interface between the Colchester Christmas blockade RoU and the RoU in question due to the combined impact on the train plan, but qualifies that it does not believe the combination of RoUs presents an unmanageable situation for the Timetable Participants.

(i) Regarding Freightliner’s Section 5.1, in relation to the comments relating to availability, including “Network Rail seems to think that Freightliner has an endless supply of diesel locomotives”, Network Rail qualifies that RoUs requiring multiple days of diversions of Felixstowe freight services via the diesel-only cross-country route have been implemented in Christmas 2016 (inc Wednesday to Saturday inclusive), 2017 (inc Wednesday to Saturday inclusive) and 2018 (inc Thursday to Saturday inclusive). Network Rail has made allowance for this impact in the Decision Criteria document (Appendix C). Under the terms of Freightliner Ltd’s Track Access Contract, Network Rail is contractually obliged to cover additional costs incurred by them as a result of a RoU. This includes compensation for a requirement

6 of 9 to run diesel vice electric traction, or if an additional loco (internally or externally sourced) is required over and above the original base service. Refer to extract in Appendix B8.

4.3 Issues not addressed by the Claimant that the Defendant considers should be taken into account as material to the determination

(a) Network Rail notes that amendment of the RoU in line with the decision sought in Freightliner’s Sole Reference would adversely impact the ability to complete the Traction Power works in the period between December 2019 and May 2020 as noted in the Impact Statement (Appendix D), and that this impact needs to be considered in the application of the Decision Criteria. Network Rail acknowledges that Freightliner has not had full visibility of the information contained within the Impact Statement to be able to address this in their Sole Reference.

4.4 Why the arguments raised in 4.1 to 4.3 taken together favour the position of the Defendant

(a) Network Rail believes that the Decision Criteria document prepared for this Timetable Hearing (Appendix C) demonstrates Network Rail’s application of the Decision Criteria at the time of issue of the Decision Document for the RoU in question, and that this document demonstrates that progressing with the RoU is more beneficial than amending it as per Freightliner’s Sole Reference. This is primarily due to the positive impact of the RoU on the opportunity to progress the Traction Power scheme in the period up to May 2020, and the benefits this has, including to future Network capability, weighed up against the adverse impact to train services in the short term.

(b) Network Rail acknowledges that while the timing of the Variation for the additional RoU meant that it was progressed after publication of the Confirmed Period Possession Plan, the Network Code allows for this and Network Rail has sought to achieve those timescales.

5.1 Network Rail seeks that the Panel uphold its Decision Document Week 39/40 Liverpool Street to Shenfield as regards the elements of the RoU which impact Freightliner services on 27 and 28 December 2019.

Possessions could be extended to Bethnal Green E Jn and to Shenfield inc’, with GA services terminating in the down platform at Ingatestone. The non- commissioning of the Central Operating Section (COS) enables the extension at the eastern end, but care to be taken to ensure that a direct route to Orient Way CS remains, either via Bow and Stratford or via Hackney Downs and Hale (reverse). Action Mark/Steve to raise ACT for week 44 as a matter of priority Action Chris/Mark/Steve to review ATF programme and confirm by the end of May, the requirements for these 4 track possessions which must include any outstabling requirements. Crossrail programme are looking to extend the existing Electric Line possessions in weeks 05, 09 and 11 to Goodmayes on the Sat/Sun and Sun/Mon so they are inclusive of the Road Rail Access Point, the original access point at Stratford was lost with the addition to the plan of the SPZ possessions. NR understands that the following amendments will be non-disruptive (except week 05) and these will be notified/proposed out by EAP

Currently week 02 shows a ML possession B Green E Jn to Romford L/End, NR requests that this possession is shortened to Forest Gate Jn (exc) to Romford L/End ML , same duration, to allow for a new EL possession between Bethnal Green East Jn (exc) and Maryland East Jn (exc) – which maintains the double junction for parallel moves.

Freightliner: Have categorically rejected this access at present:

EAP to address the dispute by Freightliner and issue a decision by Friday.

West Anglia Suburban Block:

’s puled Standard hour agreed for this block between GA and ARL, with a caveat that if the ATF block get that the suburban block is revisited.

Colchester :

Dan Wilson has had a look at a possible standard hour plan where There are two freight paths per hour each way (but these do hit at Colchester so either an up or a down to be applied each time). Dave Beadle to review and feedback.

If I have missed something or mis interpreted anything please do let me know.

We will await a decision regarding the ATF proposal from EAP and will put in another teleconference if required.

Dear all.

My colleagues within P2R Anglia are responsible for delivering: Traction Power Upgrades (TPS) between Pudding Mill Lane and Shenfield, providing necessary capacity for Crossrail and NEAT additional trains. Commissioning Week 03 Station Enhancements including Ilford & Romford concourse rebuilds, TOs and lifts plus residual works, including SISS, across 13 stations. Completing end-2020

TPS is the most access-hungry work. The Box Plan for Autumn 2019 has been rescheduled to Spring 2020 following discussions with operators and to fully optimise existing possessions. This new Box Plan will seek to utilise the existing 52 hour weekend possessions in Week 44, weeks 47-53 and Week 03. This access was originally booked for S&C work in the Maryland area and extensions will be requested to Shenfield to complete the TPS scope.

However, to deconflict TPS and S&C works during these 9 x ALBs, the TPS work in the Bow-Maryland area must be substantially complete before Week 44. To achieve this, TPS requires 5 days at Christmas to install wiring, UTXs and URXs in the Bow/Stratford area and HV cabling in the Stratford/Maryland area. Specifically, wiring must be completed alongside a very rare LU shutdown of the Central Line on Christmas Day.

Also during these 5 days at Christmas, Ilford London-End Footbridge structural safety works will be undertaken, installing a series of steel frameworks above all 4 lines.

“Category 2 Disruption” means a variation to any Base Service which would otherwise have operated, where such variation has one or more of the following effects:

(a) there is no Revised Base Service;

(b) the imposition of more demanding gauge restrictions for the Revised Base Service compared to the Base Service;

(c) at least one additional locomotive is used for the Revised Base Service over the number used for the Base Service; or

(d) a diesel locomotive is required to be used for the Revised Base Service in circumstances where Network Rail has agreed to provide electricity for traction purposes for the Base Service as apparent from the column headed “Timing Load” in the Rights Table annexed to Schedule 5;

provided that:

(i) the relevant variation arises as a direct result of a Network Rail Early Notice Possession; and

(ii) a Category 3 Disruption has not been claimed and paid in relation to the relevant Base Service;

“Category 3 Disruption” means a variation to any Base Service which would otherwise have operated, where such variation has one or more of the following effects:

(a) there is no Revised Base Service and the access from the Origin or to the Destination of the Base Service is blocked to all rail freight services (except as a result of the non-availability of the applicable gauge cleared route);

(b) (i) there is no Revised Base Service due to the lack of an applicable gauge cleared route between the Origin and the Destination which has lasted or lasts in total for more than 60 hours; or

(ii) the Revised Base Service does not have an applicable gauge cleared route between the Origin and the Destination where:

(A) the lack of such applicable gauge cleared route has lasted or lasts in total for more than 60 hours; and

(B) the Revised Base Service operates in whole, or in part, at the relevant location within this 60 hour period;

Page 41 of 53 (c) all or part of the goods planned to be carried by the Base Service are required to be transported by any mode other than rail, for all or any part of the journey from its Origin to its Destination;

(e) at least one additional locomotive is used for the Revised Base Service over the number used for the Base Service;

(f) a diesel locomotive is required to be used for the Revised Base Service in circumstances where Network Rail has agreed to provide electricity for traction purposes for the Base Service as apparent from the column headed “Timing Load” in the Rights Table annexed to Schedule 5; or

(g) the parties agree that there is a requirement for a specified number of the Train Operator’s train crew to acquire knowledge of any diversionary route which may form part of the Revised Base Service and such requirement has come about as a direct result of the exceptional nature of the variation to the Base Service,

This application of the Decision Criteria is relevant to the RoU at Christmas 2019 in the Stratford area - P2019/2559894. Although NR has always taken due cognisance of the Decision Criteria in making its decisions over the RoU in question, NR has prepared this application of the Decision Criteria with specific reference to Freightliner's Sole Reference Submission and confirms this has not been shared previously. This application of the Decision Criteria considers the impact on all affected Timetable Participants (also referred to as Operators) with specific reference to the impact on the 27 and 28 Dec 2019 since it is the impact on Freightliner services on these dates that has been disputed. Although the RoU covers other days (25 to 29 Dec 2019 inclusive), no Operators have raised objections to these so these are not covered here. In each case, the justification considers the impact of: (1) retaining the RoU as per Network Rail's Decision Document, (2) proceeding with Freightliner's desire for the RoU to be amended. Electric route would need to be made available between Stratford and the North London line via Channelsea Curve on 27 and 28 Dec 2019.

Summary NR consider that this application of the Decision Criteria supports the case for (1) proceeding with the RoU as per Network Rail’s decision. This is primarily due to the positive impact of the RoU on the opportunity to progress the Traction Power scheme in the period up to May 2020 and the benefits of this weighed up against the negative impact on train operations during the RoU.

Why are the Crossrail Traction Power Upgrade works urgent?

A new Traction Power distribution system is required in the Liverpool Street to Shenfield area to support increased train services for Crossrail and the New East Anglia trains and continue to support freight operations; this part of the Crossrail project will upgrade the system to provide this. Works involved in the traction power upgrade include the new Pudding Mill Lane Feeder station, significant alterations to current electrical feeding arrangements, trackside civils works involving cable routing, under track crossings, new small parts steel on structures and running both ATF and earth wires between Bow and Gidea Park.

The works planned for Christmas 2019 are critical to achieving Network Rail’s commitment to Crossrail Ltd to upgrade the traction power between Pudding Mill Lane and Gidea Park. Network Rail are party to a legal agreement with Crossrail Limited, “the Protocol”, which commits to delivery of certain scope against various deadlines, known as Key Output Dates. This includes Key Output 6a which is due in May 2020 and commits to delivering the traction power upgrade to Gidea Park.

These Christmas works are critical to achieve this date and failure to do so will see Network Rail renege on our formal commitment to Crossrail Limited. In turn, the Key Output dates are based on supporting the introduction of the Crossrail timetables through the staged introduction of services. If the traction power upgrade were not completed by May 2020 and particularly if the works were deferred to the following Christmas, then this could impact on the readiness to support the Crossrail timetable.

Furthermore, Key Output 6a is a CP6 Regulated Milestone agreed with the ORR and monitored via the Enhancements Delivery Plan.

In terms of timetable change impact, “Crossrail Ltd has identified a six-month delivery window between October 2020 and March 2021 for the start of Elizabeth line services through central London.” [Crossrail Limited website]. There is no opportunity to deliver the works before October 2020 if it is delayed from Christmas 2019.

A recent Peer Review of Traction Power Systems costs presented to Network Rail Infrastructure Projects Western’s Head of Engineering, Delivery Director and Finance Director showed that extending the programme from Week 03 to Christmas 2020, disregarding the conflict of Traction Power with overlapping GE OLE Programme re-wiring at Stratford, would cost approx. £15m including NR Opex costs, Contractor Extension of Time Prelims costs, additional direct costs, isolation provision and additional Schedule 4 access costs.

Why is the Christmas RoU so pivotal to the Crossrail Traction Power upgrade?

The Crossrail Traction Power upgrade has a staged commissioning programme in order to meet the commitment to deliver Key Output 6a by May 2020. See Key Traction Power Milestone Diagram below.

Page 47 of 53 What would the impact be of easing the RoU on 27 and 28 Dec?

The impact of further amending the RoU to allow electric hauled freight on 27 and 28 Dec is that planned works required for the Week 44 Stage 1 commissioning and subsequent Stage 2 to 4 commissioning activities could not be completed in this period requiring them to be deferred into the next available RoUs with a consequential impact as below.

Why can’t the Crossrail Traction Power Upgrade work be completed at another time?

As is evident from the timeline (Appendix A), a series of meetings have been held starting January 2019 with internal stakeholders and operators to develop the traction power access plan with the project team. The team was previously seeking to deliver the majority of the works through 2019. The outputs of the negotiations have been for the project to align works more with existing RoUs which has pushed the programme back at the request of operators. Another example of changes for operators is that in Weeks 32 to 36 the Traction Power project will be utilising 2 track 27 hour Sunday RoU which are compliant with the post May 2019 timetable change section 7 one third strategy, as opposed to taking additional All Lines RoU or 2 track 27 hour Sunday with a larger footprint which would have been more disruptive. This process has also been hindered by design and contractual issues resulting in delays and contributing to the post CPPP additional RoU request.

Aligning works with existing RoUs has resulted in the works targeting January to April 2020, and the need for the project to concentrate works between Bow to Ilford at Christmas in order to maintain commissioning milestones; access to these areas is very much restricted thereafter due to key asset renewals.

For the January to April 2020 period, additional integration meetings have taken place to incorporate Crossrail traction power works where possible (refer to Appendix A), whilst maintaining key Anglia Route asset renewals. Key Anglia route asset renewals in this period are listed below:

o Maryland Drainage (200yds): A poor drainage site due to geographic layout o Maryland East Jn S&C renewal (12 point ends): This is a ladder renewal required to reduce risk of condition of track TSR’s o Stratford OLE Structure Installations (4 No.): Required ahead of the future wire runs planned. Critical to provide 12Kva power upgrades o Ilford Up Main Drainage (175yds): Traditionally a poor drainage site due to geographic layout. Shortfall from previous year 4 CP5 o Mile End Down Main Plain Line Track renewal (350yds): Difficult renewal due to location o GE OLE Wiring between Ilford Station and Flyover (3 No. Wire Runs): Once complete then all OLE has been renewed between Maryland and Chelmsford

In Summary, deferring Traction power upgrade works from Christmas would:

Beyond this period, the next planned RoUs are December 2020 to February 2021 for the GE OLE Stratford overhead line renewal works. Work and design compatibility issues would hamper delivering both sets of works in these RoUs.
