Whitlam As Internationalist: a Centenary Reflection
WHITLAM AS INTERNATIONALIST: A CENTENARY REFLECTION T HE HON MICHAEL KIRBY AC CMG* Edward Gough Whitlam, the 21st Prime Minister of Australia, was born in July 1916. This year is the centenary of his birth. It follows closely on his death in October 2014 when his achievements, including in the law, were widely debated. In this article, the author reviews Whitlam’s particular interest in international law and relations. It outlines the many treaties that were ratified by the Whitlam government, following a long period of comparative disengagement by Australia from international treaty law. The range, variety and significance of the treaties are noted as is Whitlam’s attraction to treaties as a potential source of constitutional power for the enactment of federal laws by the Australian Parliament. This article also reviews Whitlam’s role in the conduct of international relations with Australia’s neighbours, notably the People’s Republic of China, Papua New Guinea, Indonesia and Indochina. The reconfiguration of geopolitical arrangements is noted as is the close engagement with the United Nations, its agencies and multilateralism. Whilst mistakes by Whitlam and his government are acknowledged, his strong emphasis on international law, and treaty law in particular, was timely. It became a signature theme of his government and life. The History of the Queensland Parliament, 1957–1989
6. The oppositional parties in the Parliament, 1957–1968 Parliamentary opposition to the Nicklin government came from a host of diverse players in the decade between August 1957 and January 1968. Especially after the Labor split of 1957, opponents of the Coalition government were a dispirited and dishevelled band, most of whom appeared as individualistic dissidents. Each had their own particular fights to fight and wars to wage. Each had different enemies in sight. Labor’s Jack Duggan and the QLP’s Ted Walsh never spoke to each other again privately after the split, despite afterwards sitting together in the Assembly for more than a decade, and frequently interjecting against each other. Adversarialism was not only a matter of formal battlelines drawn across the Chamber. Indeed, some of the most intense acrimony was found within the oppositional groups among remaining members who survived the 1957 split. If occasional internal conflicts simmered through the government side of politics, they at least demonstrated the capacity to remain in office while enjoying the comforts and trappings of power. The circumstance of being in government was sufficient to instil a collective solidarity between the Coalition parties, which was evident most strongly in the ministry. In contrast, the oppositional members were far more fragmented and querulous. They demonstrated little prospect of ever forming a single cohesive opposition. Indeed, after only one term in government, the Liberals were describing Labor as the weakest opposition in Queensland’s political history. Only towards the mid-1960s did the Labor opposition gradually develop any coherence and commitment of purpose. -

Chapter Six The Politics of Federalism Ben Davies In 1967 Sir Robert Menzies published Central Power in the Australian Commonwealth. In this book he adopted the labels coined by Lord Bryce to describe the two forces which operate in a federation—the centripetal and the centrifugal. For those uneducated in physics, such as myself, centripetal means those forces which draw power towards the centre, or the Commonwealth, whilst centrifugal forces are those which draw power outwards towards the States. Menzies remarked that these forces are constantly competing against each other, and that the balance between them is never static.1 Not surprisingly, his view in 1967 was that the centripetal forces had well and truly predominated during the previous 66 years of Federation. Of course, he would not need long to reach the same conclusion were he to consider the same question now, 40 years later. Essentially there are three levels on which these two forces exert themselves. The first and most fundamental is the legal level, which describes the constitutional structures which determine the federal balance. On questions of federalism this Society has since its inception quite rightly concentrated most on this level of federalism, as it is at this level that the most profound changes have occurred. It is also the most influential level, as it sets the boundaries within which the other two levels can operate. The second level is what I would call the financial level, and this level concerns itself with the question of the relative financial powers of the States and Commonwealth. In particular, this level is characterised by the ever-increasing financial dominance of the Commonwealth relative to the States, and the “vertical fiscal imbalance” with which the States have had to contend for most of their existence since Federation. -

This has required public agencies to lead and direct the creation of new technological opportunities and innovations. The predictable response from bureaucrats and politicians steeped in economic liberalism (that industry policy is not an appropriate instrument of public policy) must face rebuttal as both economically ill-informed and unjustified by evidence. This paper provides an overview of the key issues exemplifying the development of industry policy in many of the advanced economies and draws an outline map of how they might be applied to the Queensland economy. Introduction The structure of the Queensland economy has changed significantly in the past decade. Manufacturing, as a component of Gross State Product, has declined from 10.4 per cent in 2004-5 to 7.2 per cent in 2014-5. The sector’s contribution to State employment has declined from 10 per cent to 7.2 per cent. Likewise, mining’s contribution to Gross State Product has fallen from a peak of 14.8 per cent in 2008-9 to 7.3 per cent in 2014-5 while its contribution to employment has increased only slightly from 2 per cent to 2.8 per cent. -

INTRODUCTION ACRI is proud to have hosted this discussion of Gough Whitlam’s 1971 visit which opened up the contemporary relationship between Australia and China. It is sad that we weren’t able to interview Gough Whitlam about China in the way we intend to interview other Australian Prime Ministers. But we are honoured to add this transcript to the many tributes to Australia’s 21st Prime Minister. In our panel conversation, a long-term Whitlam advisor and friend, 81 year old Graham Freudenberg, recreated the tension around the visit. Mr Whitlam was Opposition Leader; he was taking a political risk in going to ‘Red China’. Mr Freudenberg, a master of story- telling, captured the sense of excitement felt by the Whitlam party encamped at the Peking Hotel. -
