THE WAIHEKE CLAIM The claim has two elements. The first describes the immediate cause of complaint—that the Board of Maori Affairs (the Board) disposed of lands comprising the Waiheke Development Scheme (the Waiheke Scheme) to the Waiheke Station Evans Partnership (the Evans Partnership) when it ought, the claimants say, have passed the land to the Ngati Paoa tribe. The second element describes the gravamen of the complaint, that Crown policies fail to support the tribal groups that were parties to the Treaty of Waitangi, and in particular, those tribes like Ngati Paoa now so lacking for land or other endowments that they are threatened with extinction. We begin with brief descriptions of the Waiheke Scheme and the current circumstances of Ngati Paoa before assessing both aspects of the claim in more detail. The Waiheke Scheme comprises some 2,050 acres at Onetangi to the north-east of Waiheke Island in the Hauraki Gulf with access by road to the wharf at Man-O-War Bay. Though the land has been developed by the Board of Maori Affairs, it is not Maori land. The Board bought it with ‘taxpayer’ money from private owners, and it is Crown land. In much earlier years the land was owned by Ngati Paoa, for Waiheke Island was once the northern sentinel of that tribe guarding the seaways to their mainland villages on the west coast of the Hauraki Gulf. But Ngati Paoa have not owned the land since 1858 when some 11,000 acres that included what is now the Waiheke Scheme was sold to the Crown. The Crown granted the land in many small allotments to various settlements. Eventually several of those allotments came into the ownership of one K M Scott. The Board of Maori Affairs was not involved at all until 1965 when it undertook the development of Mrs Scott’s acquisitions. The Board spent heavily on development. Later it bought the land from Mrs Scott. It became apparent however that the Board’s farming opera- tions could not sustain the cost and in 1983, the Board agreed to alienate the land by lease with purchase rights to the Evans Partnership. The current troubles then surfaced. Members of Ngati Paoa considered the Board ought to have preferred an arrangement with them for tradition- ally Waiheke was their land. The Board, it was considered, had a commit- ment to Maori people and was bound to have regard to Maori circumstances and customs not least of which required recognition of tribal boundaries and tribal needs. On 30 January 1984 a group of Ngati Paoa occupied the land to protest the proposed alienation. They were not removed until arrested on the Board’s charges of trespass. In the meantime this claim had been filed and when the trespass charges were disposed of, the claim was heard. The claimants sought a recommen- dation that the lease be declared “null and void” and that the Board negotiate with the tribe to establish a Ngati Paoa trust upon the land. 1 Downloaded from www.waitangitribunal.govt.nz Downloaded from www.waitangitribunal.govt.nz The full text of the claim was set out in a document filed by Hariata Gordon on 8 March 1985. Though it came in the form of a submission it outlined the immediate concerns clearly enough. Apart from some abbre- viation to the introduction the claim is as printed in Appendix I. In her closing submissions, Counsel for the claimants amended the remedies sought and asked for relief in four areas. These are described in Appendix II. A summary of the proceedings is contained in Appendix III. Upon hearing the immediate cause of complaint, that the scheme should have passed to a Ngati Paoa Tribal Trust, it was soon apparent the claim addressed much wider issues—for the real plight of Ngati Paoa is that it has been rendered almost landless. It is a tribe that lost with its land, its own identity, and yet, it was this once powerful tribe that held in former days a large slice of what is now Auckland and a substantial part of the Hauraki Gulf and Plains. The tribe suffered more than most the bad effects of European contact and then for no other reason than that it occupied some most desirable real estate and held to a strategic land corridor that led the way to other good pickings both north and south. In the result nearly all of its territory, being most at risk, was alienated early, last century in fact. Lacking a land base for its endowment, Ngati Paoa was denied the opportunity afforded other tribes to capitalise on the good effects of European settlement as an agricultural economy brought New Zealand to prosperity. Such is the lot of landless tribes. By the middle of this century one might well have asked, did Ngati Paoa exist or didn’t they ? Whether they were unnoticed when the Board disposed of the Waiheke Scheme is a question to be dealt with later, but certainly Ngati Paoa thought they were over- looked, and being by-passed, slighted. It was necessary in their view to remind the bureaucracy that though the land was no longer theirs, the land was still there to behold and Ngati Paoa was still here too. Thus the Waiheke occupation was more than an attempt to recapture a part of the world that once belonged to them. It was a proclamation of survival, and a call to the scattered remnants of a once powerful tribe to come together, to seek an ancestral base from which they might recapture the pride of their forbears and bring hope to a younger generation that might otherwise be lost to the cites. So it was that this claim illuminated broad issues sparked off by the arrangements for Waiheke Station and exposed a range of questions that Ngati Paoa introduced to us. It is timely now that we should introduce Ngati Paoa, the people and their land, to trace their progress to 1840, when they sought a pact in the Treaty of Waitangi, and to outline their decline, focusing thereafter on that part of their ancestral land that led to this inquiry—the land on Waiheke Island. 2 Downloaded from www.waitangitribunal.govt.nz Downloaded from www.waitangitribunal.govt.nz 2. NGATI PAOA The story of Ngati Paoa begins with the Tainui people of Waikato, probably in the 1600s when Paoa, younger brother of Manuta, left his home at Taupiri on the Waikato River to marry Tukutuku, great grand- daughter of Maratuahu, eponymous ancestor of the Hauraki tribes. In the course of time the children of Paoa and his followers dominated the western shores of the Hauraki Gulf where they lived close to the related tribes of the Marutuahu compact, Ngati Maru, Tamatera, Ngati Whanaunga and those earlier tribes absorbed by them, Ngati Huarere and Ngati Hei.

    First Years at Hokianga 1827-1836 by Rev.C.H.Laws FIRST YEARS AT HOKIANGA 1827 – 1836 In a previous brochure, entitled "Toil and Adversity at Whangaroa," the story of the Methodist Mission to New Zealand is told from its initiation in 1823 to its disruption and the enforced flight of the missionaries in 1827. After a brief stay with members of the Anglican Mission at the Bay of Islands the Methodist party sailed for Sydney in the whaler "Sisters" on January 28th, 1827, arriving at their destination on February 9th. It consisted of Nathaniel Turner and Mrs. Turner, with their three children, John Hobbs, James Stack and Mr. and Mrs. Luke Wade, and they took with them a Maori girl and two native lads. William White had left Whangaroa for England on September 19th, 1825, and at the time of the flight had not returned. The catastrophe to the Mission was complete. The buildings had been burned to the ground, the live stock killed; books and records destroyed, and the property of the Mission now consisted only of a few articles in store in Sydney which had not been forwarded to New Zealand.     Pre-emption, the Treaty of Waitangi and the Politics of Crown Purchase THE TREATY OF WAITANGI was once seen as something unique to the late 1830s, hurriedly devised and reflecting the specific humanitarian, political or international pressures of the moment.1 After the work of Claudia Orange and the new legal studies of the Treaty and international law, this idea of uniqueness is no longer sustainable.2 The Treaty expressed a series of views about sovereignty and property extending back at least to the early colonization of North America.3 But, while not unique, the Treaty of Waitangi was certainly an unusual example of treaties with indigenous peoples, especially in its time. Most North American treaties followed warfare against Native American nations, and ceded large areas of territory to the Crown or the United States. The uncompromising protection of Maori rights to land and other property in the Treaty of Waitangi was unusual, especially when its drafters anticipated large-scale colonization to follow almost immediately. Most of the historical debate has been on the diverse political influences on the evolution of Colonial Office policy between 1835 and 1840,4 but more recently, attention has turned to the Maori side of the Treaty, exploring the nature and limitations of Maori understandings of and agreement to the 1 K.     TITLE:The Ambum Stone LOCATION: Papua New Guinea DATE: 1500 BCE ARTIST: PERIOD/STYLE: Prehistoric Oceanic Art PATRON: MATERIAL/TECHNIQUE:Greywacke FORM: A composite human/animal figure, perhaps an anteater head and a human body. It has a pleasing shape and smooth surface, and the slightly shiny patina on some of its raised details suggest it has been well handled. It was made from greywacke stone, and its finished shape may suggest the original shape the stone it was carved from. Carved in the form of some kind of animal, its features are rounded and include a freestanding neck, elegantly curved head and long nose, and upper limbs that hug its torso and appear to enclose a cupped space above its belly. FUNCTION: The Ambum Stone is a decorative pestle. Sculpted stones uncovered in Papua New Guinea fall into three different categories: figurines, mortars, and pestles. These objects take the form of both land- and air-dwelling animals, anthropomorphic creatures, and human figures. The Ambum Stone is one of the earliest stone objects, hailing from way back in 3500 B.C.E., and would have been created as a pestle. It's likely that the Ambum Stone was used for fertility or burial rituals. The discovery of the Ambum Stone sheds light on the supernatural and religious beliefs of the ancient New Guinea peoples. The early stone sculptures have supernatural significance. These special mortars and pestles were used in religious rituals. New Guinea peoples believed the supernatural powers of these sculptures and the animals they depicted helped with fertility, hunting, and burial rites.

The battle in 1845/6 was the culmination of the War of the North, when Maori stood against the might of the British Empire. It was an armed response to the Treaty of Waitangi, seeking to prevent the erosion of Maori mana. Ruapekapeka is the best preserved of all the New Zealand Wars sites, a tangible connection to events which shaped New Zealand society as it is today.1 The Ruapekapeka Historic Reserve is accessed by a gravel road off State Highway 1, about 35 km north of Whangarei. Nine and half hectares in size, the reserve encompasses the pa itself, the British forward position, and part of the British main camp. The pa and British forward position are mown on a regular basis, and the reserve boasts a sealed car park, formed tracks, interpretation signs, and a beautiful carved waharoa (entranceway).

One notable aspect of the dominant legal portrayals of the Treaty signing, and subsequent legal cases, is their repression of the glaring discrepancies between the Maori version of the Treaty, signed by most Maori leaders, and the English versions. Historical arguments suggest that this discrepancy is the result ofdeliberate deceptio.n on the part of British missionaries translating the Treaty into Maori (Walker 1990: 9L Walker 1989: 269, Ross 1972: 20, Ross 1972 NZ]H: 140-141). I argue that this act ofdeception was necessary to the colonisation of New Zealand, and to the formation of New Zealand as a unified nation-state. The deceptive, or 'appropriative' mistranslation (Constable 1996: 634635), of the Treatywas the performance of an ideal of the forwardgazing (white, male) citizen who has successfully shed his history (Davidson 1997: 19, Bernal 1994: 125-127); it served both the individual interests of the citizen/subject translator and the interests of nation-building.

    ‘A Living Thing’: The Whakakotahitanga Flagstaff and its Place in New Zealand History VINCENT O’MALLEY The story of Hone Heke’s successful efforts in felling the flagstaff upon Maiki Hill at Kororareka four times between July 1844 and March 1845 – the fourth occasion marking the start of the Northern War between the British with their Maori allies and Heke’s followers – is widely known.1 The fate of the flagstaff after the war came to an inconclusive end at Ruapekapeka in January 1846 is, however, less appreciated. Yet the flagstaff’s subsequent history reveals just as much about the broader relationship between northern Maori and the Crown as the events upon Maiki Hill between 1844 and 1845 disclose about the breakdown in that relationship. Throughout the period between 1846 and 1857, Ngapuhi leaders at various times proposed to re-erect a flagstaff. Their suggestions met with at best lukewarm support from Crown officials, who worried that, regardless of who erected the flagstaff, the Crown would ultimately be required to defend it. Hence, when the pou kara known as Whakakotahitanga was erected on Maiki Hill in January 1858, Crown assistance was minimal. The decision to erect the new flagstaff had been made solely by northern Maori and was intended as an emblem of reconciliation and unity in the wake of the Northern War. These sentiments were scarcely reciprocated. Crown officials remained apprehensive about the strength of northern Maori ‘attachment’ to the government and feared that the flagstaff might again become a source of trouble and unrest. Later, as the government gradually gained a firmer grip over the north, such fears were put to bed.

John Hobbs, is a young Englishman from Thanet, who is compelled to join the Wesleyan Mission in the Hokianga, after hearing the story of the 1809 incident known as “The Burning of the Boyd”, where a young Maori Chief was beaten and flogged by the crew of an English sailing ship. His Maori warriors waited until nightfall, then taking their revenge. An elder John Hobbs narrates the story. He tells of the establishing of the Mission in the region, portraying the relationships, frustrations, conflicts and troubled times with the early settlers, the native Maori people and their Chiefs, especially, Patuone and Tamati Waka Nene. Also the very colourful life of the Rev. William White.     335 Confiscation of Maori land Michael R. Litchfield* New Zealand is a multi-cultural western style democracy in which the treat­ ment of its peoples in the past as well as the present must be shown to be fair and reasonable. This article is written in the hope that the facts surrounding the extensive confiscation of Maori land during the Anglo-Maori Land Wars of the 1860s can now be looked at honestly and objectively. It is concluded that these confiscations were unnecessary and unjust. Compensation in land and money is the only suitable solution. I. INTRODUCTION During the years 1864 to 1867 the New Zealand Goveernment confiscated approximately 3J million acres of Maori tribal land on the ground that the owners of the land were in rebellion against the sovereignty of the Crown. The confiscations were made under the authority of the New Zealand Settlements Act 1863 and its amendments.1 These Acts were passed during the so-called Maori Wars and their purpose was to enable confiscation of Maori land to punish and deter Maori “rebellion” and to prevent further insurrection by estab­ lishing military settlements on the land. It was hoped that the confiscated land could be sold to settlers and the proceeds of sale used to pay for the cost of the wars. The legislation and the war themselves were the result of the demand by settlers for land and not because Maori land owners had rejected the Queen’s authority. Land was confiscated from both loyal and “rebel” Maori land owners. Subsequent to the confiscations approximately half of the confiscated lands were given back to, or purchased from, the original owners.
