THE EXECUTIVE COMMITTEE RECOMMENDS THAT 2.428 hectares (6.0 acres) more or less, being part of Lot 19, Concession 5 East of Hurontario Street, Town of Caledon, Regional Municipality of Peel and being a partial taking from a property municipally known as 19191 St. Andrews Road be purchased from Lorie Anderson and Wayne Anderson;

THAT the purchase price be $36,000, together with the vendor's legal fees to a maximum of $1,000;

THAT acquisition by Toronto and Region Conservation Authority (TRCA) is conditional on all necessary funding being available;

THAT TRCA receive conveyance of the land required free from encumbrance, subject to existing service easements;

THAT the firm of Gardiner Roberts LLP, Barristers and Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs and disbursements are to be paid;

AND FURTHER THAT the authorized TRCA officials be directed to take whatever actions may be required to give effect thereto including the obtaining of necessary approvals and the signing and execution of any documents. CARRIED BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

The property municipally known as 19191 St. Andrews Road is on the east side of St. Andrews Road, south of Beechgrove Side Road. The property is rectangular in shape, improved with a one story single family house and barn and consists of 4.856 hectares (12.0 acres) more or less. The parcel that is being offered for sale to TRCA is the rear unimproved rectangular portion containing a wetland area of 2.428 hectares (6.0 acres) more or less.

The offer at hand is supported by an appraised value based on an independent valuation.

Attached is a plan showing the location of the subject property.

RATIONALE The subject property falls within TRCA’s approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. The property is located in the Speersville Wetland Complex, Sleswick Complex Environmentally Significant Area and Lake Simcoe Sub-Lobe Drumlins area of Natural and Scientific Interest.

TAXES AND MAINTENANCE This parcel of land will merge with the abutting TRCA-owned property to the east and south and will not significantly impact TRCA’s maintenance costs. Based on a review of environmental criteria for lands that are eligible to receive a property tax exemption under the provincial, Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2012 taxation year.

FINANCIAL DETAILS TRCA staff has approached the Regional Municipality of Peel to provide 50% of the acquisition costs of the subject property. The remainder of the funding would be TRCA land sale revenue.

Funding is available in TRCA's land acquisition capital account 004-11-502.

Negotiations have been conducted with Mr. Sam Samivand of Re/Max Realtron Realty Inc. Brokerage, who acts as agent on behalf of the owners. The purchase price was determined by a market value appraisal prepared for TRCA staff; the owner's have agreed to the purchase price and an Agreement of Purchase and Sale has been executed in this regard.

RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the waterfront watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. The property (i.e. lot 96 on Plan 345) is located within the Frenchman's Bay Environmentally Significant Area at this location. The property is surrounded on all four sides by TRCA land.

240 TAXES AND MAINTENANCE It is proposed that the lands be turned over to the City of Pickering for management.

FINANCIAL DETAILS Funds for the costs related to this purchase are available in the TRCA land acquisition capital account. Staff is requesting that the City of Pickering fund 50% of the purchase price.

THAT the purchase price be $2.00;

THAT Toronto and Region Conservation Authority (TRCA) receive conveyance of the land free from encumbrance, subject to existing service easements;

Negotiations have been conducted with Mr. Gary Daniell who acts as agent on behalf of the owner. Mr. Daniell has requested that the transfer of the open space land include a condition that TRCA agrees not to develop, build, or clear the property and that he retain first right of refusal should TRCA ever sell the land. Staff has no objections to this request as it is highly unlikely that TRCA would consider disposal of the land due to its environmental significance and connection to the Rouge Duffins Wildlife Corridor (RDWC).

243 RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Petticoat Creek watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of Land Division Applications LD 122/2010 / LD 124/2010 and Zoning By-law Amendment Application A03/10 for the creation of four (4) residential lots, TRCA staff established the limits of the open space lands (i.e. Part 5 on Draft Plan of Survey) which are comprised of a portion of the Townline Swamp Provincially Significant Wetland (PSW) Complex and an environmental buffer adjacent to the PSW. As noted above, the land is also connected to the RDWC. Since TRCA does not presently own any adjoining property, a temporary access easement over the southern-most residential lot being created will be granted to TRCA as part of this transaction in order to periodically inspect the lands. The abutting lands to the east are in the process of being acquired by TRCA from the Ontario Realty Corporation (ORC); once the ORC lands have been transferred, access will be achieved from Finch Avenue and the temporary access will be eliminated.

TAXES AND MAINTENANCE Based on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2012 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT 0.02 hectares (0.06 acres), more or less, of vacant land being Part of Block B, Registered Plan M-723 and designated as Parts 1, 2, 3 and 4 on Plan 66R-14444, City of Toronto (Etobicoke York Community Council Area), located east of Albion Road, south of Finch Avenue (rear of 4, 5 and 6 Attercliff Court), be purchased from the City of Toronto;

THAT the purchase price be $2.00;

CARRIED BACKGROUND Resolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

In 1983, TRCA was approached by the Municipality of Metropolitan Toronto Parks Department to acquire certain lands at the rear of Attercliff Court from the City of Etobicoke. However, during negotiations, encroachments were identified on a portion of the land behind 4, 5 and 6 Attercliff Court and only a portion of the property was conveyed to TRCA in November of 1985. The City of Etobicoke proceeded to resolve the encroachments at the rear of 4, 5 and 6 Attercliff Court. In December of 1990, Council of the City of Etobicoke adopted a resolution to transfer the lands behind 4, 5 and 6 Attercliff Court to TRCA.

246 A report was never brought forward, seeking approval for TRCA to proceed with the acquisition of the parcel of land behind 4, 5 and 6 Attercliff Court. The unregistered transfer documents remained unnoticed by City of Etobicoke / City of Toronto staff throughout the ensuing years. When City staff realized that the transfer of the subject lands was never completed following a title search earlier this year, staff proceeded to register the transfer on March 17, 2011. TRCA staff is now seeking Authority approval to accept the title to the subject property.

TRCA has been approached by the owner of 5 Attercliff Court to purchase a portion of the subject property. A report to consider this request will be brought forward to a future meeting of the Executive Committee.

Negotiations have been conducted with Ms. Margaret Fischer, Director, Legal Services, Real Estate, of the City of Toronto.

Attached is a plan showing the location of the subject lands.

RATIONALE The subject property falls within TRCA's approved master plan for acquisition for the Humber River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. The lands (i.e. Parts 1, 2, 3 and 4 on Plan 66R-14444) are comprised of a portion of the valley corridor of the Humber River at this location.

TAXES AND MAINTENANCE It is proposed that the lands be turned over to the City of Toronto for management.

RATIONALE The subject property falls within TRCA’s approved master plan for acquisition for the Rouge River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015. Through the review of subdivisions 19T-04003 and 19T-98007 for a proposed residential development of these sites, TRCA staff established the limits of the open space lands (i.e. Block 43 on the draft M-Plan) which is comprised of the EPS2 lands and Oak Ridges Moraine land at this location. Further, Block 43 is also within a high aquifer area of the Oak Ridges Moraine.

249 TAXES AND MAINTENANCE Based on preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2012 taxation year. The Town of Richmond Hill has agreed to manage the property.

THAT the term of the easement agreement be five years with automatic extensions until terminated;

THAT the total payment to Lakeridge Farms Limited be the nominal sum of $2.00, for the term of the agreement;

THAT the agreement be on terms and conditions satisfactory to TRCA staff and solicitors;

CARRIED BACKGROUND Discussion began with Lakeridge Farms regarding possible trail alignments across their property following the TRCA purchase of the neighbouring Skyloft property. Negotiations included Township of Uxbridge staff, Durham Conservation Association and Uxbridge Naturally members. The trail easement agreement will facilitate an improved realignment of the Oak Ridges Trail with the intent of reducing on road segments of the trail for user safety and enhanced natural experience. Once it was determined that Lakeridge Farms was receptive to the concept of the easement, the Oak Ridges Trail Association was consulted and their organization also participated to determine the preferred easement alignment.

The Oak Ridges Trail Association cannot hold easements on land, so TRCA will enter into the easement agreement. The terms of the easement agreement will be for five (5) years with automatic extensions. Lakeridge Farms or TRCA can terminate the easement agreement at anytime by providing six (6) months prior written notice to the other party.

Additional easements similar to this are being discussed for Dagmar Ski Resort property and the Oak Ridge Moraine Land Trust property, which are all in the vicinity of Lakeridge Farms. All partners agree these types of arrangements help to improve the overall trail user experience, community connections and safety.

261 RATIONALE The trail easement agreement with Lakeridge Farms has been fully supported by the Township of Uxbridge and was developed in consultation with the community and the Oak Ridges Trail Association. The easement also provides a safer trail route, which takes it off road from the existing alignment. In addition, the new route over the easement will provide the user with a highly valued natural experience.

A plan illustrating the property location and trails is attached.

FINANCIAL DETAILS It is anticipated that Lakeridge Farms Limited and the Oak Ridges Trail Association will construct and manage the trails on subject easement, as well as TRCA land, resulting in minimal operating costs to TRCA for this work and management.

(a) The sale price to be paid by Mandy and Stephen Mabee is to be $3,000.00;

(b) Mandy and Stephen Mabee are to be responsible for all legal, survey, and other costs associated with completing the transaction, including any fees required for municipal approvals (such as minor variance application, Site Plan Control application, etc.) as deemed necessary by the City of Toronto;

(c) TRCA lands affected by the agreement are to be 10 metres in width and the depth is to be 42.0 metres (i.e. the same depth as the lot at 17 Fairglen Crescent);

(d) The building restrictions on the 10 metre strip of TRCA land are to be satisfactorily defined to ensure that normal park operation, paths, trails, etc., are guaranteed without restriction;

(e) This agreement does not restrict City of Toronto or TRCA staff from exercising their normal planning review and commenting responsibilities;

(f) The agreement is to continue and be binding upon TRCA so long as the new construction / renovation remains in place;

(g) The agreement will be revoked or terminated upon receipt of written notice from the City of Toronto that the new construction / renovation has been removed or no longer exists;

264 BACKGROUND Mandy and Stephen Mabee are proposing to either renovate the existing dwelling by adding a second storey or replace the house with a two storey structure at 17 Fairglen Crescent which abuts vacant TRCA-owned land on the west side of their lot. The TRCA property is being managed by City of Toronto Parks, Forestry & Recreation (PF&R) as a tableland, passively used park adjacent to the Humber River valley at this location.

To take advantage of the scenic view of the park land and valley, Mandy and Stephen Mabee will be substantially increasing the amount and size of windows on the westerly face of the newly renovated or reconstructed dwelling. To allow a substantial amount of glass on the west side of the dwelling, the City of Toronto requires that the abutting landowner agree not to construct a building within a certain distance of the property line (10 metres in this instance), as stipulated in The Building Code. City of Toronto PF&R staff has been consulted and is in agreement with this arrangement.

Attached is a plan showing the location of the subject lands.

The current zoning on the adjacent TRCA land is Public Open Space and prohibits any form of buildings or structures with the exception of passive, recreational-type development such as pathways and trails. In addition, the TRCA property is situated within the valley corridor of the Humber River as defined in the Valley and Stream Corridor Management Program (i.e. valley top-of-bank plus 10 metre tableland buffer); consequently, structural development would be precluded at this site. Therefore, the Limiting Distance Agreement will not result in any detrimental impact on the subject TRCA land nor the current use of the property.

FINANCIAL DETAILS Mandy and Stephen Mabee have agreed to the sale price of $3,000.00 for the Limiting Distance Agreement and all legal, survey, and other costs associated with completing the transaction.

CARRIED BACKGROUND The Meadowcliffe Drive Erosion Control Project is located along a portion of the Lake Ontario shoreline at the base of the Scarborough Bluffs west of Bellamy Ravine, in the City of Toronto. The purpose of the project is to provide long-term shoreline protection to reduce the impacts of wave energy, stabilize slopes, enhance natural processes and protect the residential properties on the top of the slope. As a consequence, risk to public safety and infrastructure will be reduced, passive recreational opportunities will be increased, and aquatic and terrestrial habitat conditions as well as aesthetics will be improved.

The preferred option determined through the Class Environmental Assessment process is a shoreline treatment consisting of a cobble stone beach retained by four headlands, and an earth berm at the east end of the shoreline. The 4-6 tonne armour stone will be used in the construction of the two easterly headlands.
