Location: 11801 & 11880 Dufferin Street, Maple Ward 1, Vicinity of Kirby Road and Dufferin Street

Proposal: The Owner is requesting permission to create a new lot for residential uses. The severed and retained lands comply with the minimum lot frontage and lot area requirements stipulated by Zoning By-law 1-88.

Official Plan: The subject lands are designated “Natural Core Area” and “Natural Linkage Area” by in-effect OPA #600 (Vaughan Official Plan), as amended by OPA #604 (Oak Ridges Moraine Conformity Plan). The subject lands are also designated “ORM Natural Core”, “ORM Natural Linkage” and “Greenbelt Natural Heritage System within the Protected Countryside” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Municipal Board.

In-effect OPA #604 permits lot creation for lands designated “Natural Core Area” and “Natural Linkage Area”; however, new lots may be created for only the following circumstances (Subsection 10.14ii.a., listed below in-part):

“2. Severance from each other of two or more rural lots that have merged in title. The severance shall follow the original half lots.”

The Owner’s Agent has advised that the subject lands currently maintain two single detached dwellings, one at 11801 Keele Street and one at 11880 Dufferin Street. Both dwellings have Permits from the Building Standards Department. Further, the Agent has advised that the subject lands were originally two lots that merged in title in 1956 as a single Owner purchased both properties.

Based on the information provided by the Agent, the proposed severance, as noted in Consent application B007/13, will re- create two lots as they existed previous to 1956, and the proposed severance will not change the existing lot fabric in the surrounding area. The proposal is considered to be consistent with the policies in OPA #604.

Comments: The Development Planning Department has reviewed the proposed consent application in accordance with the policies of OPA #604, the requirements of Zoning By-law 1-88, and the area context. The proposed severance will not negatively affect the current lot fabric in the surrounding area.

Further, there are two single detached dwellings (one on each municipal address) that maintain their own access from Keele Street and Dufferin Street, respectively. Therefore, the subject lands are essentially functioning as two independent lots with uses, both Agricultural (crops are being grown on each lot) and Residential, which are permitted by in-effect OPA #604.

The subject lands are located within the and Region Conservation Authority’s regulated area and the Owner must obtain all necessary Permits in accordance with Ontario Regulation 166/06.

Recommendation: The Development Planning Department has no objection to Consent Application B007/13.
