1. Introduction

1.1 Background

1. This report is the second External Resettlement Monitoring Report and Resettlement Completion Report for the Jilin Urban Environmental Improvement Project (the Project, JUEIP) covering the period up to the end of March 2013, the completion of the Project. It is prepared by the JUEIP Project Management Office (JPMO) with the assistance of domestic external resettlement specialists.

2. Description of the Project

2.1 Project Components

3. The project is a multi-sector urban environmental improvement initiative which aims to integrate urban development and environmental management to ensure long-term sustainable growth. It is intended to help: (i) reduce water pollution; (ii) protect water resources; (iii) address water shortage (through recycling effluent) and meet the demand for high quality treated water through 2012; (iv) control non-point source of pollution through effective solid waste management (SWM); (v) reduce air pollution through reduction in coal consumption and more efficient central heating; (vi) promote sustainable economic development; and (vii) improve the environment and living conditions in Changchun and Yanji cities of Jilin Province. The project supports the Government’s 11th Five-Year Plan (FYP) which includes goals of improving living conditions and health in the project cities and promoting sustainable economic development.

4. The revised Project scope has three engineering components, broken down into seven subcomponents as shown in Table 2. The locations of the subcomponents can be found in the maps preceding this chapter.

The project also includes a component on project management and capacity building to the PMO and IAs for effective project management including: (i) providing training to strengthen their organizational structures and staff resources to implement, operate, and maintain the project components; (ii) strengthening management practices in human resources, finance, and corporate planning, and (iii) training managers and staffs to ensure efficient project implementation and sustainability of project benefits. This component is intended to strengthen institutional capacity to facilitate the adoption of an integrated approach to water resource management, including pollution control.

2.2 Project Investment Plan

7. The estimated cost of the Project during appraisal totals at US$352.68 million. ADB’s loan of US$100 million from the ordinary capital resources will cover 28% of the Project cost. During last ADB review mission of February 2012, the Project Investment was re-calculated at the estimate of $324.11 million. Details please see Table 4. The Borrower is PRC. The Government of the PRC will relend the loan proceeds to JPG. The loan will have a term of 25 years, including a grace period of 5 years. The interest rate is determined in accordance with the LIBOR-based lending facility, commitment charge and such other terms and conditions set forth in the Loan Agreement.

2.4 Implementation Arrangements

9. The JPG is the Executing Agency (EA) who has overall responsibility for the loan project. The Project Leading Group (PLG) under JPG is headed by a Vice Governor and comprising the heads of the Jilin Development Reform Commission, Housing and Urban- Rural Development Department, and Finance Department. The PLG provides overall policy guidance, facilitates interagency coordination and resolve any institutional problems affecting project implementation. The Jilin Project Management Office (JPMO) is led by the Jilin Provincial Housing and Urban-Rural Development Department. The Project Management Offices in CMG and YMG coordinate and monitor activities of the IAs. The Project Implementation Unit (PIU) in each IA is responsible for day-to-day implementation.

3. Implementation Progress of the Project

3.1 Overall Progress

11. At the time for the preparation of the Second External Resettlement Monitoring Report and Resettlement Completion Report, the weighted progress for the whole project is 92% against the 95% of the time elapsed. The weighted progress of each Project component is summarized in Table 5. The construction accounts for 70% of the weight, and the remaining 30% of the weight, including 10% for design, 6% for bid and construction award and 14% for land acquisition and resettlement.

13. The Changchun No. 5 WTP and Distribution Mains Project has decreased to 4 contract packages using the ADB loan according to the updated procurement plan in

 Civil Works Bid I: All the civil works construction except the piecemeal engineering such as sprinkle systems, land surface of the underground are completed.

 Civil Works Bid II: Main bodies of 1#, 2#, 3# clear water tanks and walls for 4# clear water tanks have been completed.

 Process equipment for the WTP were all delivered to the site, equipment installation is almost completed except the sludge treatment equipment.

 All the electrical equipment for the WTP has been installed.

31. All pipeline engineering works have been completed. Civil works for 64 heating exchange stations and the equipment installation work have been completed. About 107.6 km of pipelines, with pipe diameter ranging from DN50 to DN500, have been paved.

4. Implementation of the LAR

34. Based on the updated figures in the RPs, the Project involves permanent land acquisition of 88.42 ha, affecting 196 households (HHs) and 695 persons; temporary land occupation of 154.86 ha, affecting 350 HHs and 1,461 persons, and 9 institutions and 1 private rental house; demolition of residential structure of 26,786.87 m2, with relocation of 156 HHs and 463 persons; demolition of non-residential structure of 242 m2, affecting 5 enterprises and shops and 6 workers.

35. Up to the completion of LAR, 87.5 ha (100.00%) has been acquired permanently (reduced 0.92 ha of land acquired permanently in comparison with the updated resettlement figure, or 98.96% of the updated resettlement figure); 57.05 ha (36.84%) has been occupied temporarily; 26,738.87 m2 of residential structures (reduced 48 m2 in comparison with the updated residential structure demolition figure, or 99.82% of the updated residential structure demolition figure) and 242 m2 (100%) of commercial buildings have been demolished. Accordingly, 196 HHs and 695 persons (100%) have been affected by permanent land acquisition; 478 HHs and 1,693 persons (100%) by temporary land occupation; 156 HHs and 463 persons (100%) by residential structure demolition; and 242 m2 non-residential, 2 enterprises (100%) and 3 shops (100%) by non-residential structure demolishment. A total of CNY 121.38 million (89.19%) have been disbursed for LAR. Table 9-1a is the progress of permanent and temporary land acquisition and residential structure demolishment while Table 9-1b is the progress of non-residential structure demolishment and settlement compensation.

During the implementation, in order to avoid house demolition and comply with the Changchun City Master Plan of the Changchun City Planning Bureau, the wastewater treatment plant has been finalized to be located close to the original proposed WWTP site. The WWTP is located in the east of Yitong River, north of the South Loop high-speed road, and south of State Road 102 in Changchun City. The land was used as the brick field by the Changchun Construction Engineering Group. After several years production, it has become to the messily excavated land and water pond. In 2003, the land of 98.44 ha was acquired by Changchun Urban Development (Group), and has been unused since then. In 2008, the State-Owned Land Reserve Center reserved this piece of land. Currently, the land is intended to be allocated to Changchun Dongnan WWTP, and the procedures are under processing. Thus, structure demolishment has been avoided. 2 A total of 39.96 ha of farmland was acquired in February 2007 with 16 households or 43 persons affected and a due diligence has been conducted by Economic and Management Institute of at the same year. 3 A total of 20.303 ha of land (9.329 ha paddy land, 9.169 ha dryland, and 1.805 ha other land) for tertiary wastewater plant was acquired in 2004 and a due diligence has been conducted by Economic and Management Institute of Tongji University in February 2007. 4 According to the RP, temporary land occupation will affect 34 households or 136 persons. During actual implementation, only the road surface of nine institutions and enterprises as well as one private rental houses was affected temporarily.

4.1 Changchun City No. 5 WTP and Distribution Mains

4.1.1 Impacts of Land Acquisition and Resettlement

36. According to the resettlement plan, 15.15 ha of land will be acquired permanently, including 10.09 ha of rural collective farmland, 2.59 ha of state-owned land, and 2.47 ha of enterprise land owned by Changchun Tap Water Supply Co.. Of the total land to be acquired, 0.45 ha (all dryland) of rural collective land and 0.77 ha of state-owned land (0.04 ha of wasteland and 0.73 ha of non-motorized road) will be acquired permanently for transmission pipeline. Water treatment plant will acquire 9.05 ha (all dryland with 3,000 small young trees), and 2.47 ha of self-owned rural collective land (all waste land). The northern booster station for the water distribution mains engineering will acquire 0.59 ha of rural collective land (all vegetable land), 0.47 ha of state-owned land (all open space) in the city. Southern booster station will acquire 1.2 ha of state-owned land (all open space) in the city. The water distribution network will acquire 0.15 ha of state-owned land (0.05 ha of motorized road and 0.10 ha of non-motorized road).

37. According to the resettlement plan, the water transmission pipeline construction will acquire 121.02 ha of land. Of which, 90.24 ha are rural collective land (79.51 ha dryland, 0.34 ha vegetable land, 0.26 ha paddy land, 6.32 rural road, and 3.81 ha un-used land), and 30.78 ha of state-owned land (1.31 ha dryland, 3.26 ha un-used land, 19.45 ha non- motorized road, and 6.76 ha motorized road).

38. The Project will not involve any structure demolition.

39. The land use of the Project will affect six (6) /economic development zone, three (3) townships and twelve (12) villages. The permanent land acquisition will affect 39 households or 126 persons and temporary land occupation 236 households or 898 persons. No structure demolition will be involved in the Project, thus no households or persons to be affected.

40. According to the updated resettlement figure, the permanent land acquisition of No. 5 WTP and Distribution Mains Subcomponent totals at 11.88 ha, 39 households or 126 persons are affected. The temporary land occupation totals at 121.02 ha, 236 households or 898 persons are affected. Residential house demolition added by 48 m2, 1 household or 3 persons are affected.

41. The construction of the Southern Booster Pumping Station is the associated engineering component of the Changchun No. 5 WTP and Distribution Main. So far, although there is no change for the location of the Southern Booster Pumping Station, the impact of LAR has been changed. According to the “Comments of the Construction Project Site Selection” of the Southern Booster Pumping Sttaion reviewed and approved by the Changchun City Planning Bureau in March 2008, the planned land use of the Southern Booster Pumping Station is 19,281 m2, of which 11,673 m2 of land use is from Changchun City Land Reserve Center (It land was agricultural land and was reserved as construction land by Changchun City Land Reserve Center from Jilin Province Yifang Real Estate Co., Ltd, in October 2007) and 7,608 m2 from Heizuizi Village. The land compensation agreement between Changchun Tap Water Supply Company and Heizuizi Village of was signed in November 2009. Currently, the structure and auxiliaries on the land have not been demolished, and the compensation payment has not been made yet. The scope of structure and auxiliary demolition impacts is presented in Table 10.

42. During actual implementation, Changchun No. 5 WTP and Distribution project construction have occupied 9.96 ha of the land, reduced 5.19 ha of land in comparison with the figure of the RP, and reduced 1.92 ha of land in comparison with the updated resettlement figure. Construction of water transmission line has been cancelled from the ADB loan proceeds and no temporary land occupation and house demolition was involved any more. The permanent land acquisition has affected a total of 39 households or 126 rural persons, and temporary occupation of collective land 15 households or 58 persons.

4.1.2 Compensation Standards and Disbursement

43. A total of CNY 6.4898 million (of which 3.3032 million paid as social insurance) were directly disbursed to the affected villagers for the loss of permanent collective land acquisition, CNY 3.2817 million for the loss of temporary land occupation. The compensation standards for Jiutai area are CNY 100,000/km for village cement road, CNY 50,000/km for tun road. The compensation standards of standing crops for Changchun City are CNY 3.5/m2 for vegetable land, CNY 2.2/m2 for paddy land, CNY 2.0/m2 for dryland; and for Jiutai area are CNY 3.5/m2 for vegetable land, CNY 1.6/m2 for paddy land, CNY 1.5/m2 for dryland. Table 11 is the compensation standards for permanent land acquisition. A total of CNY 77.7897 million were disbursed.

4.2 Changchun City Domestic Solid Waste Management

4.2.1 Impacts of Land Acquisition and Resettlement

44. According to the RP, the Project will acquire part of land and demolish some houses from Shangmogugou Tun, Yaomogugou Tun, Xiamogugou Tun in Shuangshan Village, Erdaoququanyan Township. The construction of the sanitary landfill will acquire land permanently. In total, 64.36 ha of rural collective land will be acquired, including 34.79 ha farmland, 13.86 ha wood land, 12.36 ha construction land and 3.35 ha un-used land. Of the total 34.79 ha of rural collective farmland acquired, 30.99 ha is in Shangmo Group and 3.8 ha in Yaomo Group. Permanent land acquisition will affect 46 rural households or 198 APs.

45. As a result of the landfill construction, a total of 25,902.87 m2 structures (including 16,254.87 m2 of houses with certificates and 9,648 m2 simple structures without certificates) will be demolished and 155 households or 460 persons will be relocated. The simple structures temporarily built for grain and agricultural machine storage by the farmers have no house certificates because the structures are not used for living. The quality of the simple houses is usually poorer and the costs of the materials are lower than the houses with certificates. Almost all the affected households have both houses with certificates and without certificates. In addition, 37,298 scattered trees will also be cut down (including 24,205 regular trees and 13,093 fruit trees. Those trees are owned by the individual villagers.

46. According to the updated resettlement figure, the project acquires permanent land acquisition of 60.25 ha land in total, and affects 140 households or 520 persons. During the construction period, the current rural roads are used as entry road and all equipment are

stored and used within the construction field, so the project does not need temporary land occupation.

47. Permanent land acquisition affects 140 households and 520 persons, and 155 households or 460 persons are affected by house demolition, 6 persons (including 3 shop owners) are affected. All these affected people are rural population living in Shuangshan Village, Quanyan Township, of Changchun City, of which 7 persons are classified as vulnerable people (4 disabled, 1 elder and 2 especially poor).

48. Permanent land acquisition of the Project was started in January 2007. In total, 60.25 ha of land have been acquired permanently. The actual figure of permanent land acquisition is 4.11 ha reduction in comparison with the figure of the RP, and is consistent with the updated resettlement figure.

49. House demolition of this Project was started in 27 August, 2008. Changchun City Urban Construction Development and House Demolishment Co., Ltd. are responsible for concrete house demolition. All residential houses have already been demolished, and the actual figure of demolition is consistent with the one of RP. The actual cutting down for various types of fruit and regular trees were higher than the numbers in the resettlement report. The difference is that the impact numbers are estimated number in the resettlement report, while the actual involved is from actual statistics. See Table 12 for impacts and progress of residential house demolition, Table 13 for impacts and progress of auxiliary demolition, Table 14 for the impacts of scattered trees cutting, and Table 15 for the shop demolition (reduced 3 shops’ demolition and avoided 11 workers affected).

51. The impacts of basic infrastructures and special facilities are presented in Table 16. In total, 14 380v concrete electric poles have been demolished.

4.2.2 Compensation Standards and Disbursement

52. For the permanent acquisition of agricultural land, the compensation rate in the RP is CNY 700,000/ha, but during actual implementation, a total of CNY 800,000/ha was compensated, CNY 100,000/ha higher than the standards of the RP. According to the actual evaluation, the rate of unused land is lower than the standard in the RP. The construction land has been compensated by land replacement without cash payment. Table 17 is the compensation standards for permanent land acquisition of unused land and construction land. The compensation for house demolition with certificates and without certificates is presented in Table 18-1a and Table 18-1b, the replacement houses were evaluated by Changchun Baitai Real Estate Company, the actual compensation was CNY 45/m2 higher than the rates of other projects, and higher than the average house price of CNY 790/m2. As a result, the APs have benefitted from the Project. According to Changchun City Structure Demolition Management and Regulation, compensation for the loss of working days is provided to each relocated family at CNY 300 per household and the transition cost is CNY 8 per square meter. For the 3 demolished shops, a total of CNY 75,114 was paid to the affected owners based on actual evaluation and negotiation. As the owners of the shops used the extra space for business, the compensation for the loss of working days is included in the compensation of residential structure demolition. The compensation standards of auxiliaries and infrastructures and special facilities are presented in Table 19-1 and Table 19-2.

53. In total, CNY 119.920 million or 100% of the total resettlement funds based on the updated figures of the RP have been disbursed. Table 20 is the progress of resettlement fund disbursement. Due to the fact that the higher compensation standards for permanent land acquisition and some auxiliaries as well as the quantity increase of some auxiliaries, the actual disbursement is higher than the total figure in the RP. Especially the increase of cost for permanent land acquisition in the resettlement area and affected area.

4.2.3 Resettlement and Rehabilitation Plan

54. According to the detailed survey results, a total of 155 households have moved, this is the same number as that presented in the RP. The house demolition started on 27 August 2008. Up to the completion, 48 households (farmers without land) have moved into the resettlement houses (economy houses) near the outskirt of Quannongshan Town. The remaining 115 households have been relocated within the same village (south of Shuangshan Village Committee, Quannongshan Township, west of village committee road) in a centralized way. The total area of the resettlement site is 10.47 ha, with total construction structure area of 20,951 m2. The new community is facilitated with day care center and community center. The detailed plan of the resettlement site is presented in Table 21. Currently, the road of the resettlement site has completed. The basic infrastructures including electricity, internet, telecommunication, water supply, and drainage have been fully completed, and greening have been completed. All the APs have moved into their new houses.

For the loss of livelihood due to the permanent land acquisition, the village committee has disbursed 60% of the land compensation and resettlement subsidy to the APs for the purchase of social insurance and interest income generation by depositing the payment into bank for income earnings from interests, engaging in taxi service, purchase of commercial shops for rental income, migrant labors, and provision of various employment and income generation opportunities during the project construction and operation phases, such as the jobs as workers in charge of landscaping and cooking meals and security guards. The owner of the Project and contractor hire in preference to the farmers who lost their land. Technical training was provided to the APs to increase their skills to be employed in the increasing demand of community services, such as day care and medical care, and auto accessories . The remaining 40% of land compensation and resettlement subsidy have been kept in the village committees to be used for the social

insurance and purchase of new land for the APs whose land were newly acquired. Table 22 shows the choice of compensation by APs affected by permanent land acquisition. The results indicate that to ensure future living standard, more villagers have chosen the social insurance than originally planned.

4.3 Changchun Dongnan WWTP and Sewerage Networks

56. According to the updated RP, during the implementation, in order to avoid house demolition and comply with the Changchun City Master Plan of the Changchun City Planning Bureau, the wastewater treatment plant has been finalized to be located close to the original proposed WWTP site. Thus, only 13.27 ha land transfer are involved in the Project without any structure and auxiliary demolition. It involved CNY 21.368 million for the land transfer and tariff (Table 23).

57. According to the updated RP, the pipeline construction will involve 248,686 m2 temporary land occupation of the state-owned land (road and pedestrian road). Table 24 is the impacts of temporary land occupation. As the pipeline construction now is included in other project construction, the impact of the temporary land occupation will not be included in the Project any more. Thus no temporary land cost will be involved.

4.4 Yanji Water Supply and Network Upgrade and Expansion

4.4.2 Impacts of Land Acquisition and Resettlement

58. The construction of the WTP would acquire 3.996 ha dryland. The People's Republic of China Construction Project Planning License (No. DG20050001) obtained on 23rd August 2005. The land acquisition and compensation agreement was signed between Yanji Water Supply Co. (now Yanji City Water Industry Co., Ltd.) and the affected Xingan village committee on 14 December, 2006 and the compensation payment was made to the APs on 9 January, 2007. A total of 16 households and 43 persons in the village were affected, of which 14 households and 33 persons were Korean. Table 25 is the impact of permanent land acquisition. The permanent land acquisition of the WTP was fully completed in 2006. A due diligence report on the permanent land acquisition of the WTP was conducted by the Economic Management Institute of Tongji University in February 2007. Based on the results of the interviews, the affected villagers are satisfied with the compensation and income restoration measures, and no remaining issues left. The water transmission pipeline and distribution mains and pipeline would not involve permanent land acquisition.

The APs have used the compensation payment of resettlement subsidy and standing crops to make arrangements to get employment in Korean and rent remaining land of the APs to maintain their previous livelihood. The affected village committee has used the land compensation for the improvement of education and basic infrastructure and facilities of the village. Their income has been increased than the level before the land acquisition, and they are much better-off. A due diligence report on the permanent land acquisition of the WTP was conducted by the Economic Management Institute of Tongji University in February 2007. It demonstrates that the APs are satisfied with the compensation and livelihood rehabilitation measure, and no issues remained for the permanent land acquisition due to the WTP construction.

60. In the original RP, temporary land use of both state-owned land and rural collective land will be involved in the Project. The construction will occupy a total of 10.498 ha of state land and rural collective land temporarily, including 6.693 ha of state land (6.218 ha urban road and 0.475 ha river channel) and 3.805 ha rural collective land (including 3.015 ha dryland and 0.79 ha wasteland). In the updated RP, a total of 8.3 ha state and rural collective lands will be temporarily occupied. The total numbers of the affected people are all rural residents. The land of 46 households will be temporarily occupied for a period of one month and thus the losses will be insignificant. The APs will be compensated for the loss of crops and the land will be restored to their original condition. The temporary land occupation will affect 46 households or 214 persons.

61. No houses or other structures will be affected by the construction of the Project.

Upon completion, water transmission pipeline and distribution networks construction have involved 42.8 ha or 428,000 m2 collective-owned land and state-owned land have been used temporarily, which is increased by 323,000 m2 or 407.7% of the original RP. Totally 45 households or 145 persons are affected by the project, which is increased by 16 households or 43 persons than the original RP.

63. Table 26 is the impacts of temporary land occupation.

4.4.3 Compensation Standards and Disbursement

64. For the agricultural land acquisition, the compensation at CNY 100/m2 has been paid, with a total of disbursement of CNY 3.996 million. The payment has been made before the construction of the Project, thus the cost is not included in the budget of the RP.

65. For the temporary farmland occupation, the compensation standard is CNY 6.54/m2, which is higher than the rates in the RP. The total compensation for land loss totals at CNY 280,000 or 532.32% according to the original RP, and 100% according to the updated figures of the RP. The compensation for temporary land occupation of pipeline construction is presented in Table 27.

4.4.4 Livelihood and Income Rehabilitation

66. According to the interview result of the APs affected by the WTP, it indicates that they are satisfied with the compensation. After land acquisition, their production and living level have been increased, and their income has also been increased greatly in comparison with 2009 and 2006. Table 28 is the income level change of the APs whose land was acquired. Up to the end of 2011, average income per capita of the local residents reached CNY 3,450.

67. Interview with Wang Jinmin, team leader of No. 4 Team informed that the land acquisition compensation was paid to his family 3 years ago. The living and production of the people affected have been completely rehabilitated and their current average income is CNY 2,800/ per capita which is higher than the level of 2006. For each family, there are persons go out of village as migrant labor, and quite a few people have been abroad with some of them been abroad for 3 to 5 years. So far, the production and living level of the APs have been fully recovered and increased after land acquisition. Ms. Ying Xinhua’s family has 3 persons. Before land acquisition, her family relied on agricultural production, but now engaging in rice-wine production and also in animal breeding. The income of her family has been increase greatly, with average income per capita over CNY 20,000 per year. Her family has several sets of houses and is very satisfied with their living. She indicates that the quality of the villagers is high and their income is very stable. Everybody is living very happily.

4.5 Yanji Effluent Reuse and Sewerage Upgrade and Expansion

4.5.2 Impacts of Land Acquisition and Resettlement

68. According to the RP, 1.6 ha of land east to the newly constructed Yanji Effluent Reuse Plant was required as the site for the effluent reuse plant. The Project site of the effluent reuse plant is located in Xiaoying Village, Xiaoying Township, and the north bank of Buerhatong River. The plant is 10 km away from the urban center of Yanji City and 1.8 km away from the border of the Yanji Development Zone. The land was acquired during the construction of the WWTP in 2002. A total of 20.3033 ha of rural collective land were acquired, accounting for 36.4% of the total village owned land. The total area of land acquisition is 9.329 ha which are paddy land, 9.1694 ha dryland, and 1.8049 ha other types of land. The permanent land acquisition affected 4 village groups of Xiaoying Village, namely Group 1, Group 2, Group 3 and Group 11. In total, 330 APs were affected and all of them are Korean. Table 29 provides the details of the permanent land acquisition impacts. The compensation payment has been allocated to affected villages and families for the permanent land losers. The WWTP was completed in 2006 and operated in the

69. For the construction of of effluent distribution pipeline and sewer networks, temporary land use of both rural collective- and state-owned land will be involved. The construction will occupy 64,719 m2 urban road and river embankment road of state land and 56,657 m2 of rural collective land, including 3,888 m2 of dryland with corn crops in Group 5 and Group 8 of Xiaoying Village, which is close to the existing thermal power plant next to the WWTP.

70. Within the WWTP site, a 1,877 m2 laboratory shed of agricultural technology extension station owned by the Yanji Agricultural Technology Extension Station was demolished in 2002. Cash compensation has been paid to the affected owner. A due diligence has been conducted, which indicates that no issues remained for the land acquisition of the WWTP construction.

71. The construction of wastewater pipeline will affect 79 households or 252 persons.

72. Upon completion, 38 km wastewater pipeline DN 400 to DN 1,000 has been paved, 3.051 ha of land or 25.13% in comparison with the original figures of the RP has been occupied temporarily and a total of 47 households and 151 persons have been affected. Table 30 is the impact and progress of temporary land occupation according to the original RP.

4.6 Yanji Thermal Power Plant Heating Networks and Yanji Central Heating Secondary Networks

4.6.2 Impacts of Land Acquisition and Resettlement

74. According to the RP, for the construction of Yanji Thermal Power Plant Heating Networks in District, it will involve permanent acquisition of 300 m2 farmland due to the construction of booster PS, and affect 1 household or 6 rural residents. The heat exchange stations will be built on the land where small boilers to be demolished, therefore, no land acquisition will be involved.

75. The construction of pipelines of Yanji Thermal Power Plant Heating Networks in Henan District will occupy 6,000 m2 farmland temporarily, and 34 households and 124 agricultural populations and 12 non-agricultural populations will be affected in Xiaoying Village.

76. The Project will not involve residential structure demolition.

77. The construction of Yanji Central Heating Secondary Networks will not involve permanent land acquisition. The construction of Yanji Central Heating Secondary Networks in District is along the urban road, it will occupy 16,000 m2 of road temporarily.

78. According to the RP, the construction of Yanji Central Heating Secondary Networks in Hebei District will involve demolishment of 270 m2 residential houses and affect 3 urban households and 9 people. The 3 households who will lose brick and wood structures will also lose simple structures which are extensions of houses. The materials used for construction are simple structures with poorer quality. In addition, some ground attachments will also be demolished.

79. According to the updated resettlement figure, the inspection wells and valve wells of Yanji Thermal Power Plant Heating Pipe Network Project will acquire 247 m2 of land permanently, and 1 rural household with 6 persons will be affected. The networks construction will occupy 59,000 m2 of land temporarily, and affect 209 persons. Demolitions for the Project include 836 m2 of residential structure and 101 m2 of non-residential structure, 2 enterprises or shops will be affected. Yanji Central Heating Secondary Networks Project will not involve permanent land acquisition and structure demolition. The networks construction will occupy 53,000 m2 of land temporarily, and no household or person will be affected.

80. Upon completion, the Yanji Thermal Power Plant Heating Networks Project has acquired a total of 247 m2 or 0.02 ha of land, which is consistent with the updated resettlement figure. The temporary land occupation is 59,000 m2 or 5.9 ha, with reduction of 0.1 ha of land in comparison with the figure of the original RP, and consistency with the updated resettlement figure (100% completion). The temporary land occupation has affected 209 persons in total, with 73 persons increase than the figure of the RP, and consistency

with the updated resettlement figure. A total of 836 m2 residential structure was demolished, with increase of 836 m2 increase than the figure of the RP, and consistency with the updated resettlement figure.

81. The temporary land occupation of Yanji Central Heating Secondary Networks was fully completed in 2010. It has temporarily occupied 114.6 m2 road surface of Friendship Massage Center, 300 m2 road surface, 10 boutiques houses closed for 7 days, 30 booths closing for 15 days of Yanji Guofu Engineering Investment Management Co., Ltd., Mr. Liu Shuangcong’s 260 m2 rental houses closed for 8 months. The quantity of temporary land occupation is consistent with the updated resettlement figure. The Project has taken the optimal design to reduce the demolition of houses. The damage of road surface and urban greening during the construction period has been recovered according to regulation. The loss of business stoppage has also been compensated. Table 31 is the progress of ground attachments demolition in comparison with the RP. During the construction period, the demolition of auxiliaries has been avoided as much as possible, as a result, the actual auxiliaries demolished have been reduced greatly.

82. Also the Project construction will demolish the non-residential structures of Wanjia Property Management Service and Bus Company. The non-residential structure demolition was completed by the end of December 2009. The area of non-residential structures demolished was 101 m2, which has reduced 22 m2 in comparison with the figure in the RP and the same with the updated figures of the RP. The ground attachment demolition is the same with the RP. Table 32 is the impact and progress of non-residential structure demolition and Table 33 is the ground attachment demolition of Wanjia Property Management Service and non-residential area of Bus Company.

83. The compensation rate for the loss of business closure is negotiated between Yanji Investment and Development Co. (YIDC) and the affected units. For the road recovery, Jilin Province Urban Road Excavation and Recovery Compensation Standard are executed. Table 34 shows the specific rate of compensation.

84. According to the compensation policy and the result of negotiation, the compensation for land occupation of Yanji Heating Plant and Secondary Networks Project

Yanji City Investment Management Co., Ltd. paid the compensation fees according to the agreement. The original income levels of the affected units have recovered their original income level. All road surface excavation has been recovered after obtaining compensation.

Yanji Thermal Power Plant Heating Networks

85. For the construction land use of the Yanji Thermal Power Plant Heating Networks of the Project, the Yanji Investment and Development Co. has signed two compensation agreements for the land loss with the Xiaoying Village Committee and Guangjin Village Committee of Xiaoyin Town, Yanji City on 3 September 2010 and on 5 September 2010 respectively. Those agreements clearly state that the construction mainly involves temporary land occupation (only small portion of the land use for inspection wells involves permanent land acquisition, and the compensation differs according to the location of the land acquired: ranges from CNY 200 to CNY 300). The compensation is for 3 years, from 3 August, 2010 to 3 August, 2013. The compensation standard is CNY 6.66/m2 per year with a total of CNY 20/m2 over the three year periods. The project has affected 97 households in Xiaoying Village and 112 households in Guangjin Village, the total land area compensated is: 37,485.51 m2 and 21,710.23 m2 respectively, and the total compensation is CNY 849,217.00 and CNY 609,204.5 respectively. The compensation details are presented in the following tables. To date, all the compensation for temporary land occupation has been paid, totaling at CNY 1,458,421.50. See Tables 35 and 36.

86. In conclusion, the land occupation area is 59,195.23 m2, of which permanent land occupation is 242.74 m2. Standing crops total at 41,515 m2, which have all been compensated. All the people affected have received the compensation payment, and they are satisfied. Yanji Municipal Investment and Development Co. has completed all the resettlement activities involved in the RP.

4.6.4 Closure of Small Boilers and Re-Deployment Status

87. In addition, the Yanji Thermal Power Plant Heating Networks Project and Yanji Heating Plant and Secondary Networks Project will involve the closure of 318 small coal burning boilers. The small boilers create severe urban air pollution to the surrounding residential areas of Yanji City. The closure will affect a total of 452 employees. All of the affected employees are living within the same city and no resettlement will be involved. More specifically, the Yanji Thermal Power Plant Heating Networks Project will close 120 low-efficiency high-pollution small boilers, with 210 workers to be affected. The Yanji Heating Plant and Secondary Networks Project will close 198 small boilers, with 242 workers to be affected. All the employees are living in the city of Yanji, and no relocation will be involved. The Project IAs will re-deploy all the affected employees in the newly built exchange stations or other units of their businesses. Training will be provided to the employees to make them adapt to new working environment and positions, with common goal that the affected employees will not be financially worse off than they would have been without the Project.

Yanji Heating Plant and Secondary Networks

88. Between 2007 and 2009, the Yanji Heating Plant and Secondary Networks Project has closed 198 small boilers. These boilers have not only the low heat efficiency of 55% to 65%, but also have no sufficient pollution control devices, which have caused serious environmental pollution. The closure of the small boilers will affect 242 employees.

89. While closing the small boilers, the Project of Yanji Central Heating Secondary Networks will newly build 64 new heat exchange stations. A total of 113 affected workers will be employed in the new heat exchange stations and be in charge of the operation. Yanji Central Heating Company hired 129 employees including Ma Yuqin, etc. No workers lost their jobs due to the closure of small boilers. The average monthly income per capita ranges from CNY 1,200 to CNY 3,500. The name list of employees working in Yanji Central Heating Company is shown below.

In order to ensure the income of the affected workers would not be affected by this Project, Yanji City Investment and Development Co. has identified new job positions for the affected workers in the new heat exchange station or Yanji City Central Heating Company, provided assistance and relevant job training to solve the employment issues of the affected workers. Yanji Investment and Development Co. has drafted the boiler closure plan, safety regulations and environmental protection measures to ensure the safety of the employees and reduce the impacts on social security and local environment. Of the affected employees, they have got stable transit in their new positions through receiving training and counseling.

Yanji Thermal Power Plant Networks

92. While closing the small boilers, the Yanji Thermal Power Plant Heating Networks Project has built 42 new heating exchange stations to supply heat for all users in the area.

 Due to the requirement of the municipal development in Yanji City, the municipal government has decided to establish a regional heating supply source in the west area of Yanji City and provide heating supply to a new area. Forty-two (42) staff members from the Yanji Heating Supply Company have been assigned to be responsible for the implementation and future operation of the Project. Meanwhile, the Yanji Heating Supply Company has kept 13 temporary workers to work on the provision of heating supply to the areas beyond the scope of the Project. The newly constructed heating exchange stations have hired 42 affected workers including Wang Youshun and Chen Dehong, etc. to work in the new heating supply company and be responsible for the operation of the stations.

 Forty (40) persons including Cong Peili, Yan Wei, etc. have been assigned to work in heating tariff collecting department and inspection department.

 In total, 73 persons including Liu Yaoshi, Lu Haifeng, etc. have been assigned to work in the maintenance division to conduct equipment maintenance as well as emergency repair.

93. In order to ensure that the income of the affected workers will not be affected by the project, Yanji Investment and Development Co. has arranged the affected workers to work in the newly built heating exchange stations or in the operation and management divisions. Also, training related to these positions has been provided to the affected workers. After the affected workers who have received the training and counseling, they have got smooth transition to their new positions. Their incomes range between CNY 1,500 to CNY 2,500 per month, which has an increase on the basis of their original positions from different degree.

5. Conclusion and Recommendations

(i) For the reduction of the compensation rate of the unused land of Changchun City Domestic Solid Waste Management subproject, the PMO submitted the supporting documents to ADB in November 2011 to confirm that the lower compensation was accepted by the village and that the acquired land was un-used land and there was no people affected.

(ii) In general, the land acquisition and resettlement of the Project progressed well. The implementation of land acquisition and resettlement program by the local government and respective IA is in compliance with the RPs and resettlement covenants of the loan and project agreements. The compensation rates both for land acquired and buildings and associated auxiliaries demolished were accepted by the APs. The interview with the APs demonstrates that they are satisfied with the compensation. During the LAR implementation, no appeal case has been involved.

(iii) To meet the requirement of social safeguard as stipulated in the Project Agreement, the Jilin PMO has engaged independent external resettlement monitoring specialists. According to the TOR, the Analysis Report on Living Standard Baseline Survey for Resettlement and the First External Resettlement Monitoring Report (January to June 2012) and the Second Resettlement Monitoring Report and Resettlement Completion Report have been completed.

(iv) The external resettlement monitoring specialists will continue to conduct the first annual evaluation and second annual evaluation of the resettlement to make proper recommendations for ensuring the APs’ livelihood and income rehabilitation as well as increasing the living standards of the APs.
