First, please accept my apology for the incomplete letter you received from Canada Post, dated March 24, 2014.

Canada Post has conducted a review of customer traffic patterns at the Port Stanley post office at 238 Frances St., and determined that we have a small number of local customers between the hours of 8: 30 am. and 9 a. m., and again between 5 p.m. and 5: 45 p.m., Monday to Friday. As a result of this review, we will reduce our hours of operation, effective May 26, 2014.

The new hours at this post office will be: Monday to Friday: 9 a. m. to 5 p.m.

Postal box customers will still have access to their mail 24 hours a day, seven days per week.

Customers will continue to enjoy access to a full range ofpostal services and products at this post office. There will be no change to the range of services we offer. As well, customers can purchase stamps, pay for and print shipping labels and access other postal services online at canadapost.ca.

While I recognize this is a change for your community, I want to reassure you that we remain committed to providing postal services in urban and rural communities across the country. Our operations are funded by the sale of our products and services, not taxpayer dollars. Increased Sales to Minors: A recent Ipsos -Reid mystery- shopper survey found that 21% of Ontario convenience stores failed to ask a 17 year -old shopper for ID when they tried purchasing cigarettes. A 2013 Centre for Addiction and Mental Health survey discovered 15. 6% of Ontario high school students who smoked reported getting their last cigarette directly from a grocery store, convenience store, gas station or bar. Are convenience stores ready for the responsibility of selling alcohol?

Higher Recycling Costs for Municipalities: Our world- renowned recycling program collects over 2 billion containers a year, or 92% of all alcohol containers sold. The packaging recycled through the Beer Store system is equal to more than half of all the material collected through the entire Ontario Blue Box program. Convenience stores and gas stations will have no space for this packaging, meaning it would end up in your waste stream. Based on current municipal Blue Box and landfill costs, this would cost municipalities about $40 million in new waste management costs every year.

Higher Prices for Consumers: Evidence from other markets clearly shows that a dramatic expansion of liquor retail outlets will lead to higher prices. Numerous studies have shown that when Alberta and B. C. deregulated liquor sales and greatly expanded the number of stores selling liquor, prices increased significantly. In fact Statistics Canada shows that Alberta liquor prices have increased at the highest rate in the nation since they expanded liquor sales in 1993. Currently, the Beer Store is proud to sell quality beer brands for prices that are commonly $10 lower on a case of 24 than what consumers pay in other provinces. Even the head of the Ontario Convenience Store Association has publicly admitted that beer prices will increase if corner stores are allowed to sell liquor.

The Loss of Well- Paying Jobs in Your Community: Our 7,000 workers are active members of the community throughout Ontario. They not only work in your community, they also give back through a variety of charitable fundraising efforts —activities that raised almost $2. 4 million last year alone. Over the past eight years our Returns for Leukemia bottle drive has raised more than $8 million for life- saving blood cancer research. Our employees also earn competitive wages that help them, their families and local economies thrive, grow and prosper. Expanding liquor sales to 10, 000 -plus convenience stores would result in the elimination of most of these well -paying jobs, jobs that will not be replaced at convenience stores where wages are lower and benefits and pensions seldom exist.

I would urge you to bring these facts before your council and share them with your constituents. Your citizens deserve to know how such a massive expansion of liquor sales may affect their community.

I am pleased to present The Rural Roadmao: The Path Fortvard for Ontario.

Working with our rural partners, this report highlights the many accomplishments we' ve made together, over a ten -year period, to create a stronger, healthier rural Ontario. Accomplishments that include constructing and renovating hundreds of schools and hospitals; building and rebuilding more than 7, 900 kilometres of highways and more than 950 bridges across Ontario; and providing millions ofrural Ontarians with high -speed internet access.

But like any long -term project, our work is not yet done.

To this end, the roadmap outlines key priorities for the next year. Priorities that will serve as building blocks for our government' s long -term rural planning.

One of these priorities includes developing a permanent municipal roads and bridges fund based on consultations with our municipal partners. This includes more predictable, reliable and sustainable infrastructure funding for consideration in the 2014 Ontario Budget.

Revitalizing rural manufacturing is another priority. Based on employment, manufacturing remains rural Ontario' s second largest industry. But to succeed in today' s global economy, we need to create a more competitive and innovative manufacturing industry. That' s why, as outlined in the Rural Roadmap, my ministry will collaborate with the Ministry of Economic Development, Trade and Employment to help grow the rural manufacturing sector.

We will also continue creating more investment -ready regions through the Rural Economic Development Program. Since 2003, the province has invested more than $ 167 million in this program, generating more than $ 1. 2 billion in local economic activity and creating more than 35, 000 jobs.

Potential Donor

On September 10, 2013 heavy rainfall caused extreme flooding in the Central Algoma area leaving behind hundreds of thousands of dollars worth of destruction and damage resulting in the area being declared a disaster area by the provincial government.

A volunteer committee, the Central Algoma Joint Disaster Relief Committee CAJDRC), has been set up to spearhead the local fundraising effort to assist the private sector of our area. A tentative fundraising target of $80,000. 00 has been set to provide assistance to local homeowners, farmers and small businesses whose essential property has been damaged from the flooding in the four represented townships. A considerable community response is needed to help those less fortunate who have suffered such private and personal devastating losses.

Financial support from the area will be instrumental in attracting provincial financial assistance. For every dollar raised, the province of Ontario will contribute up to a ratio of 2: 1 through the Ontario Disaster Relief Program, ODRAP.

Your caring financial assistance will make a huge difference in the lives of victims of the flood by helping them regain their homes, businesses and lives. Origin: Municipal and Planning staff were approached by Frank Sharifi of Prespa Homes regarding the use of a by -law to remove Part Lot Control for the purposes of severing his three semi -detached lots on George Street in Port Stanley. Two of the three lots are developed or in the process of being completed. Central Elgin has not used the Part Lot Control provisions within the Planning Act in the past, principally because there have not been any semi -detached lots included in recent subdivisions.

Background: Section 50( 3) of the Planning Act provides that land may only be conveyed or transferred if, among other things, it is a whole lot on a plan of subdivision or a consent ( severance) is given. Similarly, Subsection 50( 5) provides that part of a lot or block on a registered plan of subdivision may not be conveyed or transferred unless, among other things, a consent is given. This second condition is referred to as Part Lot Control and the specific rules regarding such may be found in Subsection 50 ( 5) -( 7) of the Act.

Subsection 50( 7) of the Act goes on to state that the Council of a local municipality may by by -law provide that subsection ( 5) does not apply to land that is within

Application Form for Removal of Page 26 of 167 Part Lot Control Reference Plan such registered plan or plans of subdivision or parts of them as are designated in the by -law. This is commonly used in subdivisions where there are semi -detached lots. The lots are created through the plan of subdivision with the intention of being split later when the semi -detached dwelling is built. The split is done after the house is built because it would be too difficult for the builder to try and locate the common wall of the units on a lot line that has already been created. By -laws for removal of Part Lot Control are set up with sunset clauses in them, just like a temporary zoning by -law. This is because as long as the by -law is in place there is nothing to stop the owner(s) from transferring land back and forth. Typically the time period is set for as long as is reasonable for the builder to complete construction on the lots specified in the by -law. Most by -laws are for anywhere from 1 to 3 years.

By -laws for the removal of Part Lot Control do not take effect until they have been approved by the appropriate approval authority. For Central Elgin, that will be the Count of Elgin.

Since Part Lot Control has not been used in Central Elgin in the past there was no application form. Staff have prepared the attached application based on the one used in St. Thomas. Council will need to give consideration to an appropriate fee. The County fee for approving the by -law is $ 500.

Prespa Homes Request: The three lots that are subject of the request by Prespa Homes were created through the plan of subdivision process ( Lots 1, 2 and 3 on Plan 11M -199). The attached reference plan was provided by Prespa Homes and shows the location of the two homes already built or under construction. The third lot should be completed within the year. Staff have reviewed this request and are recommending that Council approve the required by -law. A by -law has been placed on the May 12"' agenda for consideration. Normally staff would not bring a by -law forward on such short notice, but the developer has time constraints to meet on the closing of the first home and has asked for Council' s assistance in that regard.

The time period on the by -law before Council is set to expire on December 31St, 2015. Subsection 50( 7. 4) of the Act states that Council can extend the time period without further approval by the approval authority. Further, Subsection 50( 7. 5) states that the by -law can be amended or repealed without further approval by the approval authority. This means that once the sem' etached lots arg created the by -law can be amended so that it no longer applib the completlots.

THAT the Council of the Corporation of the Municipality of Central Elgin direct staff to prepare a by -law to adopt the draft Code of Conduct for Members of Council, Local Boards and Committees: AND THAT staff be directed to prepare a by -law to appoint John Maddox as the Municipality of Central Elgin' s Integrity Commissioner....

By -laws adopting a Code of Conduct, appointing the Integrity Commissioner and prescribing the complaint form have been prepared for Council' s consideration. The by -laws, as drafted, are to be effective December 1, 2014, the start of the next Council' s term of office. As directed by Council on May 14, 2012, the proposed by -laws are based on the by -laws adopted by Elgin County Council.

Integrity Commissioner Elgin County Council has appointed John Maddox as the County of Elgin's first Integrity Commissioner. Mr. Maddox is currently the Closed Meeting Investigator for the County, the Municipality of Central Elgin and a number of other lower -tier municipalities in the County. The County of Elgin has agreed to pay Mr. Maddox's Integrity Commissioner retainer fees for the lower -tier municipalities. Any time spent on specific advisory, compliance investigation/ determinations and educational activities would be the responsibility of the applicable municipality. A similar arrangement is in place in Mr. Maddox's capacity as the Closed Meeting Investigator.

REPORT:

Central Elgin receives a number of applications from vendors every year, requesting permission to sell or rent a product, or provide a service in Port Stanley in the busy summer months. Central Elgin Council has had a policy for Port Stanley's Main Beach, based on an outstanding Port Stanley by -law, indicating that temporary vendors were not permitted. In 2014 this policy was under review and discussion by the User Fee Committee. It has been decided to pilot a new policy that would encourage more recreational activity and business opportunity during the tourist season. Central Elgin Council values the Blue Flag status of Port Stanley's Main Beach, and will not allow any activity that would jeopardize that status.

Additionally, it has been decided that the pilot project will also include the West Harbour Walkway, and an area at Little Beach. Central Elgin Council will select vendors on the basis of optimizing the types of activities most desirable for Port Stanley.

The User Fee Committee would respectfully request that Council receive Report CAD- 21 - 14, °Port Stanley Seasonal Vendor Pilot' as Information, and pass a by -law to establish the 2014 Port Stanley Seasonal Vendor Pilot Policies, Rules, and Regulations, as attached.

Purpose

Central Elgin Council has had a policy for Port Stanley' s Main Beach, based on an outstanding Port Stanley by -law, indicating that temporary vendors were not permitted. In 2014 this policy was under review and discussion. It has been decided to pilot a new policy that would encourage more recreational activity and business opportunity during the tourist season. REPORT: Council, at its meeting of April 14, 2o14, received staff report CAO. 14.14, copy attached. Staff was requested to prepare an additional report indentifying the conceptual costs the owners of 123 Centennial Avenue may have incurred if they had carried out a repair of their malfunctioning septic system or had replaced their septic system with a temporary holding tank pending the installation of sanitary sewers.

It Is difficult to estimate the cost of a repair as the cost of will vary depending upon the nature of the system malfunction. A repair may not have even been possible, in which case, a holding tank would be an alternative. Leon Bach, Chief Building Official, contacted four septic tank installers and obtained pricing on the installation of a holding tank and pump out costs. REPORT: This report is in response to correspondence from Charles and Marg Collins, 123 Centennial Avenue copy attached). On September 24, 2009, the Collins obtained a permit to install a septic system on their property. Prior to and after this date, the Municipality' s Chief Building Official, based on Council' s commitment to service the Eastwood Subdivision with sanitary services, was permitting property owners with malfunctioning septic systems to carry out temporary repairs. Where repairs were not possible, property owners were permitted to install a holding tank pending the installation of municipal sanitary sewers. The Collins have written asking for an explanation why they were required to install a new septic system while other property owners were permitted other alternatives. Staff is unable to provide an explanation. To staffs knowledge, no other property owners were required to install a new septic system in this time period. Staff understand that the Collins are contacting Council at this time because the proposed bylaw to establish a rate for the sewage capital works, By -law 1714, is to be considered by Council at its April 14th, 2014 meeting. Council has two options: Council can advise the Collins that their situation is unfortunate, but take no further action. Council can reduce the rate to be charged for the sanitary sewers in recognition of the additional cost that the Collins incurred when installing a new septic system. It should be noted that the Collins would have incurred some cost in 2009 to either temporarily repair their septic system or install a holding tank and maintain pump outs over a five year period. The costs of the alternatives, however, are likely less than the cost of a new septic system.

RECOMMENDATION: ' THAT Council of the Municipality of Central Elgin appoint Stantec Consulting to complete the Master Servicing Plan / Environmental Assessment for the optimization of the Port Stanley Waste Water Treatment Facility at a total cost of $72,588 exclusive of taxes.

REPORT: At the November 25, 2015 meeting of Council, staff were directed to undertake a procurement process to secure the services of a consulting engineer to complete a master servicing plan / Environmental Assessment to come up with options for plant improvements so that the rated capacity of the plant could be more easily attained. As a result of this direction, staff developed a Request for Proposal ( RFP) document for the provision of engineering services to complete the Master Servicing Plan. The document was sent to four area consulting firms with expertise in similar projects. Two proposals were received and one " regret" letter.

We would note that the RFP format was similar to previous projects. A two envelope process was utilized with the first envelope including the technical proposal. This envelope only references the technical aspects and qualifications of the consulting team. This envelope is opened separately and the proposals reviewed from the perspective of the quality of the team and services that can be provided including experience with similar projects, experience of the proposed consulting team etc. This envelope represents sixty (60%) of the total points awarded. Once the technical proposals have been reviewed and scored then the second envelope for each proposal submitted is opened and ranked according to price.

As a result of this review, we would note that Stantec Consulting had the best overall technical proposal as well as the lowest price. As a result, the committee is recommending that the proposed work be awarded to Stantec Consulting.

SUBJECT: Belmont Arena Concession Contract Extension

TO COUNCIL: May 12, 2014

RECOMMENDATION. THAT Council of the Municipality of Central Elgin extend the contact for the operation of the Belmont Arena Concession for the 2014 -2015 season to Ken MacPherson in the amount of $600 annually.

REPORT The concession booth at the Belmont Arena has been operated by a private contractor for the past 16 years. The operator in the past has been selected through a competitive procurement process. The last procurement process was undertaken in 2010 for the 2010/ 2011, 2011/ 2012, and the 2012/ 2013 ice seasons.

At the June 24"1, 2014 meeting of Council, staff were directed to negotiate a one year lease with Ken MacPherson for the operation of the concession for the 2013/ 2014 season. Staff would note that the lease was under the same terms and conditions as the previous operator. The annual payment for the lease is $ 600. Staff would note that Mr. MacPherson has an interest in operating the concession again for the upcoming season at the same terms and conditions as the previous lease. It is also Important to note that Mr. MacPherson was very professional in the operation of the concession and did a remarkable job in serving the public using the facility.

Staff would recommend that Council consider extending the lease to Mr. MacPherson for a further one year term subject to the same terms and conditions as the lease for the 2013/ 2014 season.
