    The changed economy of legal knowledge: response through a radical change to the legal trainee career path Dr. Nigel Spencer,1 Dr. Katie Best,2 and Des Woods3 Abstract This paper uses a case study to explore how two changes in circumstances within the UK legal services sector led to innovations in career structure, organisational design and the distribution of knowledge within one particular City of London law firm. These two changes were: (1) changes in client demand for more commercial advisers; and (2) the financial crisis or Credit Crunch. The paper sets out the context for the innovation explaining the historic legal education system with its nearly exclusively technical legal curriculum. The authors then set out the need for change in knowledge distribution, based on external market demands, in order to produce more rounded, commercial and business-focused lawyers, and explain how the firm radically revised its career path to create a step-change in commercial knowledge and simultaneously changed the knowledge distribution in the firm. Background: the historic career model and legal services market which required ‘technical experts’ The legal sector’s work historically centred on delivering expert, technical knowledge-in-practice which its legal teams have gradually built up through their careers (Kritzer, 2002). Clients of leading City legal practices continued to value this technical knowledge, especially that of the senior members of the firm (the law firm Partners), and readily bought in the City firms to solve their legal problems, often in a relatively ‘transactional’ relationship whereby the law firm was hired to execute a particular legal instrument within a broader commercial context (Morgan, 2005).

For any organisation tasked with changing a market both in the public and consumer interest, evaluation of the impact of policies introduced is essential. For those operating in the regulatory sphere evaluation is key to understanding whether regulatory policy achieves the right balance of protecting consumers and promoting competition. However regulation does not operate in isolation from wider changes. The LSB needs to consider the wider context of the economy, and other external views and factors that may influence and change the perspectives of other players in the market place. In this report – the first of a series – we bring together data from a wide range of sources to look at how the legal services market in England and Wales has changed over the past five years. We believe that this is the first time this wide range of indicators have been presented together, allowing insight into longer term trends in legal services. We use what information is readily available to reflect on trends in the legal services market between 2006/07-2010/11. We see a legal services market growing in terms of number of professionals, and overall in good financial health – worth £25.5bn in 2010/11. Prices appear to be rising for business to business legal services. This is against a backdrop of falling levels of demand in some traditional areas of work, albeit with increases in some others.

  • And Legal Education: an English Perspective
    ALLIANCE “CAPITALISM” AND LEGAL EDUCATION: AN ENGLISH PERSPECTIVE James Faulconbridge* INTRODUCTION Elizabeth Chambliss’s analysis of developments in U.S. legal education is both comprehensive and instructive because of its critical perspective on the multi-dimensional changes currently under way as law schools increasingly collaborate with their “clients.”1 In this response Essay, my intention is not to question Chambliss’s analysis. Instead, I seek to compare the documented U.S. developments with some recent changes in the English context. I then reflect on the shared conundrums that exist as a result of what I describe—perhaps provocatively—as the forms of “alliance capitalism”2 that are emerging in and defining the challenges faced by legal education. I use “alliance capitalism” to refer tentatively to questions that the motivations associated with the growing role of collaborations in the U.S. and English contexts could raise. Part I provides a brief review of the peculiarities of English legal education to situate the discussion. Next, Part II documents a number of recent trends in English legal education that indicate the emergence of “alliance” strategies. Part III outlines the questions raised by changes in English legal education over the past five to ten years. Finally, this Essay concludes with a discussion of the wider implications of “alliance capitalism” in the U.S. and English contexts. I.
