BAuM* Professor Baum uses political programming on television as an illustra- tion of the complexity of issues involved in the regulatory control of controversial broadcasting. The author describes the direction Parliament has chosen and records the Canadian Broadcasting Corporation'sattempt to achieve fairness and objectivity in the entire sphere of broadcasting contro- versial matters. The articles of Commissioners Johnson and Jones provide background to this discussion of policy within our national network. INTRODUCTION: The subject of controversial broadcasting brings into sharp focus the stated policy of the right to freedom of expression and the sometimes opposing right of a person to receive the programs of his choice. Parliament has res- ponded to this problem, as to broadcasting generally, by the enactment of legislation, creating an administrative agency to regulate major facets of broadcasting activity. What follows is intended as an examination of the mode of regulation chosen and the concomitant impact upon a specific broadcaster, the Canadian Broadcasting Corporation (CBC). -

NEW ORLEANS NOSTALGIA Remembering New Orleans History, Culture and Traditions By Ned Hémard Bonanza in the Big Easy Born in Ottawa, Canada, to Russian Jewish immigrants, this actor appeared as Monsieur Mercier in the 1958 Paramount Pictures film, The Buccaneer (which embellishes the role of Jean Lafitte (Yul Brynner) in helping Andrew Jackson (Charlton Heston) win the Battle of New Orleans. After a long and successful run in a weekly television series, this actor also reigned as Bacchus during the 1985 New Orleans Mardi Gras season. If the reader has not guessed by now, the actor mentioned above is Lorne Greene (the patriarch Ben Cartwright, star of Bonanza). The fictional setting for the show (according to the premiere episode's storyline) is a 600,000-acre ranch on the shores of Lake Tahoe known as the Ponderosa. Nestled high in the Sierra Nevada, with a large ranch house in its center, the Ponderosa spread is bigger than Don Corleone’s compound (also on Lake Tahoe), where the elaborate First Communion party scenes were filmed for The Godfather Part II. Ben Cartwright is said to have built the original, smaller homestead after moving from New Orleans with his pregnant third wife Marie de Marigny (that’s right, just like the Faubourg) and his two sons, Adam and Hoss (played by Pernell Roberts and Dan Blocker). The grown Adam designed the later sprawling ranch house as depicted on TV. The Ponderosa was roughly a two-hour ride on horseback from Virginia City, Nevada. Most people believe that the inspiration for the name Ponderosa was the great number of Ponderosa pines in the area, but it could’ve been taken from the Latin for large and ponderous in size. -

It was the only night when my mother made pizza. It was the only night of the week when we could drink soda. It was the only night of the week when we could have candy for dessert. Iit was the only night of the week when we were allowed to eat dinner in front of the television. And the only shows we ever watched were Mutual of Omaha’s Wild Kingdom and The Wonderful World of Disney. (Mom sent us to bed as soon as Bonanza started.) For almost the entirety of my childhood, The Wonderful World of Disney was always there, even as I grew from a boy to a young man of eighteen, and even as my family moved from the small towns and farms of rural Indiana to the coal and steel towns of West Virginia to the towering spires of the Motor City in Michigan. -

Thank you very much to the honourable members of the Senate Standing Committee on Official Languages (the “Committee”) for inviting me to testify and submit a brief as part of the study of the official languages reform proposal entitled French and English: Towards a Substantive Equality of Official Languages in Canada (“the reform proposal”). A) The reform proposal includes ambitious and essential measures 2. First, I would like to congratulate the Minister of Economic Development and Official Languages for her leadership and vision. It is, in my opinion, the most ambitious official languages reform proposal since the enactment of the Constitution Act, 1982 (“CA1982”)1 and the Canadian Charter of Rights and Freedoms (“Charter”),2 which enshrined the main provisions of the Official Languages Act (“OLA”)3 of 1969 in the Canadian Constitution. The last reform of the OLA was in 1988 and it is past time to modernize it to adapt it to Canada’s linguistic realities and challenges in the 21st century. 3. The Charter and the OLA proclaim that “English and French are the official languages of Canada and have equality of status and equal rights and privileges as to their use in all institutions of the Parliament and government of Canada.”4 In reality, however, as reported by Statistics Canada,5 English is dominant everywhere, while French is declining, including in Quebec. -

Reacting to the medium’s growing significance, members of the Canadian Broadcasting Corporation (CBC) accepted that they had a wartime responsibility to maintain civilian morale. The CBC thus unequivocally supported the national cause throughout all levels of its organization. Its senior administrations and programmers directed the CBC’s efforts to aid the Canadian war effort. -

CONSTITUTION-MAKING AS INTERGOVERNMENTAL RELATIONS A Case Study of the 1980 Canadian Constitutional Negotiations Adam D. McDonald1, University of Waterloo The Constitution Act, 1982 is a document that profoundly changed the Canadian political landscape. It brought home the highest law of the land; it provided Canadians a mechanism to change their Constitution; it created a Charter of Rights and Freedoms, entrenched within the Constitution, out of the reach of one government. Perhaps its most important legacies, however, are the seemingly permanent isolation of Quebec and the primacy of place in Canadian history it gave Pierre Trudeau. This paper will examine the constitutional history of Canada with a view to determining what made the 1980 negotiating sessions successful when the sessions that led to both the Meech Lake Accord and the Charlottetown Accord were not. It is important, however, to note that the word “successful” is used in the sense that an agreement was reached. Unlike Meech and Charlottetown, the repatriated constitution did not have unanimity among the participants. The question that comes to mind is this: if the governments did not really agree in 1981, why was a Constitution ratified? More importantly, are there lessons that can be drawn from this agreement that can be applied to the failed accords of the Mulroney era? In order to complete this examination, the paper will be divided into two parts. In the first part, Canada’s constitutional story will be told. This is a necessary part of any examination of the constitutional negotiations, for without knowing what the players wanted historically, one cannot see what was changed by the 1980s. -

THE CBC RADIO DRAMA PROJECT AND ITS BACKGROUND by Howard Fink Radio drama for me, as for many people who were growing up just after the War, was, quite simply, my introduction to theatre: the classics, Renaissance drama, and modern and contemporary plays, including European and Canadian. It is rare that one gets the opportunity to re-examine a major formative influence later in one's life, rarer still to find that in this objective light its value holds up. I have had that happy experience with CBC radio drama. I have also had an experience of a completely different kind, in attempting to trace the materials of this influ- ential phenomenon: one which, as regards the history of Canadian theatre in general, has been shared in some measure by many: it was almost impossible to study the achievement of CBC radio drama as a whole, or even at first to locate the vast majority of the plays created and produced. Of course this is partly owing to the particular nature of theatre, the original form of which, unlike a novel or a book of verse, is a live performance, which remains rather in the memories than in the bookcases of its audience. More particularly, the CBC has always considered itself a production organization rather than a repository of culture, and quite rightly so. It has, in fact, been discouraged from archival activities by the government, which considers the Public Archives of Canada as a more appropriate institution for that role. 3f course such well-known figures as Robertson Davies, George Ryga and James Reaney are well represented in print. -

JOURNAL OF NEW BRUNSWICK STUDIES Issue 3 (2012) A Near Golden Age: The Cooperative Commonwealth Federation (CCF) in New Brunswick, 1940-1949 Laurel Lewey Abstract This history of the Cooperative Commonwealth Federation (CCF) in the 1940s in New Brunswick adds to a growing body of literature that challenges the misperception that the CCF scarcely existed east of Ontario. However, in spite of a host of historical (and later) social conditions that called out for the CCF, the 1940s was the only decade when the movement showed considerable promise in New Brunswick. This article will suggest that the failure of the movement to gain permanent traction was attributable to several factors: the political strength of the Liberal political machinery and Premier John B. McNair; anti-labour sentiments and the anti- CCF campaign in the media; organizational challenges within the party; social and economic conditions within the province; and the divergent agenda of Francophone and Anglophone New Brunswickers. Résumé Cette histoire de la Fédération du Commonwealth coopératif (FCC) dans les années 1940 au Nouveau-Brunswick s’ajoute aux nombreux écrits qui dénoncent la fausse perception que la FCC a rarement existé à l’est de l’Ontario.
