He or she risked arrest and possible police brutalization for dancing with someone of the same sex, cross-dressing, propositioning another adult homosexual, possessing a homophile publication, writing about homosexuality without disapproval, displaying pictures of two people of the same sex in intimate positions, operating a lesbian or gay bar, or actually having sex with another adult homosexual. Arrest meant more than a file and an overnight stay in jail. Misdemeanor arrests for sex-related vagrancy or disorderly conduct offenses meant that the homosexual might have his or her name published in the local newspaper, would probably lose his or her job, and in several states would have to register as a sex offender (assuming conviction). In some states, the convicted homosexual lost his or her driver's license. If the homosexual was not a citizen, he or she would likely be deported. If the homosexual were a professional-a teacher, lawyer, doctor, mortician, beautician-he or she would likely lose the certification needed to practice that profession. Having oral or anal intercourse with someone of the same sex was the worst thing a homosexual could do in America circa 1961. Consensual homosexual intercourse was a serious crime in all the states, and a felony in all but one; several states imposed life sentences. A felony conviction (and in some states merely being charged) subjected the homosexual to special psychiatric evaluation as a potential "sexual psychopath." If found to be such a creature, the homosexual was incarcerated indefinitely in a mental institution which, for many inmates, was a horror chamber of electro- shock and mental torture, and for some, a life sentence. If the charged homosexual was a member of the armed forces, he or she might be court martialed and would likely be dishonorably discharged, thereby losing all veterans' benefits, however distinguished his or her service record. Fear of social and familial ostracism kept most homosexuals in the closet. The law sealed that closet shut for most gays and lesbians, while at the same time, outing others in state-sponsored witchhunts. It is those who were outed who transformed both the law and the homosexual existence, and that transformation began in earnest during 1961.2 1. Background can be found in William N. I choose 1961 as a pivotal date because it marked a generational transition away from the traditionalism of the Eisenhower Administration, the due process jurisprudence of Felix Frankfurter, and the apologists of the Mattachine Society and Daughters of Bilitis. In November, Dr. Franklin Kameny and a handful of others founded the Mattachine Society of Washington, D.C. ("MSW") as a more aggressive minority rights group.' Whereas the West Coast homophile groups from the 1950s sought to persuade straight society to tolerate homosexuals who would occupy a mutually protective closet, MSW insisted upon equal rights for the "homosexual minority." The stated goals of the group were: to "secure for homosexuals the basic rights and liberties established by the word and spirit of the Constitution of the United States"; "[t]o equalize the status and position of the homosexual with those of the heterosexual by achieving equality under law, equality of opportunity, equality in the society of his fellow men, and by eliminating adverse prejudice, both private and officiar'; and "[t]o secure for the homosexual the right, as a human being, to develop and achieve his full potential and dignity, and the right, as a citizen, to make his maximum contribution to the society in which he lives."4 This statement of purpose represented an intellectual turning point in the history of the closet: homosexuals insisted upon equality as uncloseted citizens, not liberty engendered by a protective closet. The main practical agenda of MSW was to confront harassment of homosexuals by the federal and district governments. At the August 1961 organizational meeting for MSW, Kameny was alerted that one of the sixteen men present was Lieutenant Louis Fochet of the District of Columbia Morals Squad. Kameny announced, "I understand that there is a member of the Metropolitan Police Department here. Could he please identify himself and tell us why he's here?"' Thus outed by an out-of- the-closet homosexual, Fochet skulked out. Kameny and MSW followed the same unashamed approach in dealings with all branches of govern- path-breaking rights jurisprudence of Hugo Black and William Douglas, and a new generation of homosexuals

Bonham Centre for Sexual Diversity Studies University of Toronto 2015 ABSTRACT Lesbian and gay archives, particularly those established within the context of the homophile, gay liberation, and lesbian feminist movements, serve as social movement organizations (SMOs). That is, they are organizational and administrative members of activist communities that acquire, manage, and share resources for the purpose of collective action for social change. Archives are nevertheless absent from literature on social movements and social movement theory. This project was designed to expand on current research in the fields of archival studies, social movement studies, and sexuality studies to better understand the experiences of lesbian and gay archives. A multiple case study was conducted at four community grown archives: The Canadian Lesbian and Gay Archives, the ONE National Gay and Lesbian Archives, The June L. Mazer Lesbian Archives, and the Lesbian Herstory Archives. Site visits took place over six months in 2013 and 2014, during which time interviews were conducted with 33 community archivists, volunteers, and community partners. In addition, more than 20,000 pages of organizational records related to the founding and development of these archives were reviewed. By tracing the emergence, development, and resource struggles of four lesbian and gay archives, this dissertation shows how these organizations have been shaped by broader movement goals, local geographies, socio-political structures, and the particular interests and energies of those who have nurtured their collections over the years.

    INTRODUCTION San Francisco Was a Wide-Open Town I think it’s important to realize that San Francisco did not happen after New York or after Stonewall. This was something that developed in San Francisco and evolved because there were a large number of Gay people who just did the traditional American thing of organizing— organizing around people’s interests. Larry Littlejohn, interview, 1990 San Francisco is a seductive city. Perched on the edge of a continent, its beautiful vistas, eccentric characters, and liberal politics reflect both the unruly nature of its frontier-town beginnings and the sophisticated de- sires of an urban metropolis. Sociologists Howard Becker and Irving Horowitz call San Francisco a culture of civility, noting that “devi- ance, like difference, is a civic resource, enjoyed by tourist and resident alike.” 1 But while the strength of the city’s queer communities is world renowned, there are few texts devoted to San Francisco’s gay and les- bian history.2 What follows, as a result, charts new ground. It asks the question “Why San Francisco?” Why do so many people associate San Francisco with homosexuals and homosexuality? In my research—and casual conversations—many answers have emerged. There are the same- sex dances of the Gold Rush era, the city’s location as an international seaport, the homosocial entertainments of the city’s Barbary Coast, the artistic revivals of the turn of the twentieth century, the tradition of vigi- lante law and order, the persistence of civic graft, the strength and di- versity of the city’s immigrant communities, the staunch resistance to anti-sex and anti-alcohol ordinances, the military presence of two world wars, and the bohemian, Beat, and hippie cultures that flourished in the postwar generations.3 But, by and large, when asked “Why San Fran- 1 2 INTRODUCTION cisco?” most people refer to San Francisco’s history of sexual permis- siveness and its function as a wide-open town—a town where anything goes.

Mary ZieglerI ABSTRACT At a time when the Supreme Court seems closer than ever before to treating sexual orientation as a suspect classification, consideration of the legal definition of sexual orientation is both timely and important. The Court’s 2015 decision in Obergefell recognizes two guideposts for defining sexual orientation: its immutability and normalcy. While other scholars offer rich and nuanced accounts of the fight for gay, lesbian, transgender, and bisexual rights, they do not fully analyze the history of sexual orientation as a legal category. This Article closes that gap, illuminating the hidden costs of the definition of sexual orientation that Obergefell endorses. In the past, definitions of sexual orientation based on immutability helped courts turn away equal protection arguments because of the “real” biological differences between same-sex and opposite sex couples.
