C’est le développement de prestations de services afférentes – accueil touristique et plate-formes logistiques de groupage-dégroupage des marchandises – qui permettra à la ligne Transmanche Dieppe- Newhaven de participer à un équilibre économique acceptable par tous. C'est dans ce contexte que la Filière Logistique Haut-Normande (LSN- Logistique Seine-Normandie) a souhaité analyser avec Dieppe-Maritime, le Syndicat Mixte du Port de Dieppe, et les acteurs économiques du territoire les potentialités de la ligne Dieppe-Newhaven et en identifier les facteurs clés de succès. LSN réunit environ 160 membres, institutions, organisations professionnelles, entreprises et organismes de formations de la Région Haute-Normandie, dont HAROPA, le réseau des CCI territoriales, etc. En particulier, la Communauté d’Agglomérations de Dieppe-Maritime, le Syndicat Mixte du Port de Dieppe, le Club Logistique de la CCI Dieppe, et la Grappe d’entreprises VIALOG, à laquelle adhère DFDS, sont membres de LSN. Les domaines d’actions de LSN touchent à : 1_ la montée en compétence et en compétitivité des entreprises logistiques régionales par le biais notamment d’actions collectives ; 2_ l’accompagnement dans la recherche de performance opérationnelle des entreprises logistiques du territoire au travers de la mutualisation de ressources ou de services ; 3_ la contribution à la visibilité et à l’attractivité du territoire par la promotion des atouts logistiques ; 4_ l'expertise territoriale sur les questions alliant logistique et aménagement du territoire, au travers, notamment, d’un Observatoire logistique traitant du Foncier, des Indicateurs de Performance de la logistique... ; 5_ Enfin, LSN prend position et porte la parole, en soutien et avec le partenariat des acteurs concernés, sur des sujets logistiques majeurs impactant la compétitivité et l'attractivité du territoire (infrastructures de transport, sujets réglementaires...). 3/30 Contexte La Ligne Transmanche Dieppe-Newhaven fait l’objet d’une DSP de 8 ans (2 x 4 années renouvelables) entre le Département de Seine-Maritime et l’opérateur LD-Lines. Cette DSP, reprise en 2012 par DFDS Seaways, arrive à terme au 31/12/2014 et le Département de Seine-Maritime pose objectivement la question de son renouvellement au vu du coût de cet engagement. L’ouverture du tunnel en 1994 a fortement modifié le trafic Transmanche (part de marché actuelle d’Eurotunnel = 40% des trafics transmanche FR/UK) ainsi que (plus récemment) la stratégie de compagnies aériennes low-cost (notons toutefois que Ryanair, qui fait la réussite de l’aéroport de Beauvais, « a reçu en 2010 de la part des collectivités locales en France la somme de 35 M€, soit 11€ par passager embarqué » - ref. revue Perspectives et entrepreneurs, Avril 2014). 4 compagnies de ferries se partagent aujourd’hui les trafics transmanche : . Brittany Ferries, positionné en Manche Ouest . P&O Ferries, qui n'est présente aujourd’hui que sur le détroit Calais-Douvres . My FerryLink, nouvelle compagnie constituée en SCOP qui loue auprès d’Eurotunnel les bateaux de l’Ex compagnie SeaFrance . DFDS Seaways, qui s’impose comme le principal opérateur en Manche Est et qui a repris la DSP initialement contractualisée avec LD-Lines sur la ligne Dieppe-Newhaven. La crise de 2008 ainsi que la baisse de la Livre anglaise ont entraîné une chute brutale du trafic, qui peine à retrouver son niveau antérieur. Ces effets conjugués se traduisent par une concurrence exacerbée entre les opérateurs actuels : ainsi la SCOP My FerryLink, qui bénéficie de l’affrètement auprès d’Eurotunnel des actifs de SeaFrance, fait l’objet d’une requête auprès de l’autorité de la concurrence britannique. De même Brittany Ferries, venue récemment renforcer sa présence en centre Manche sur la place havraise, pourrait souffrir de sa politique concurrentielle… Par ailleurs, les nouvelles réglementations MARPOL 6 en matière de contrôle d’émission de souffre vont imposer de lourds investissements sur les bateaux et pourraient également contribuer à une redistribution des cartes (on parle de 12 M€ par navire pour la conversion au GNL et de 8 M€ pour la mise en place de ‘scrubbers’ ou filtres à particules – cf. annexe n°2). L’interdiction d’exercer sur Calais-Douvres prononcée contre My FerryLink par l’Autorité de la Concurrence et des Marchés (CMA) en mai 2014, combinée à la saturation des capacités sur le détroit, pourrait, si elle est confirmée mi-juin, entraîner un report favorable sur Dieppe-Newhaven dès 2015 (bien que la SCOP puisse encore faire appel de cette décision). 4/30 Retombées En termes de flux, le trafic par Dieppe- 2011 2012 est. 2013 Newhaven dépasse celui de la ligne Le LEH passagers 343 000 212 000 266 000 Havre-Portsmouth, non seulement pour véhicules 126 000 78 000 100 000 les passagers mais également pour le PL/remorques 26 000 27 000 30 000 fret. La clientèle passagers est, dans sa grande majorité, britannique (près de 80%). C’est une clientèle essentiellement de proximité (East Sussex, West Sussex, Londres côté britannique et Normandie, Picardie, Ile de France côté français). Les principales motivations des voyageurs sont d’ordre touristique ou ‘shopping’, générant de ce fait des retombées importantes sur l’économie du territoire. Ainsi, selon une étude réalisée par la CCI de Dieppe en 2003 (Synthèse de l'opération franco-britannique INTERREG IIIA : "Impacts économiques et touristiques de la ligne Dieppe-Newhaven"), « la ligne Transmanche Dieppe-Newhaven permet d'injecter 17.5 millions € dans l'économie locale » (NDLR - pour 380 000 passagers à l’époque). Le transport de marchandises par le Transmanche est quant à lui la principale activité commerciale du Syndicat Mixte du Port de Dieppe avec 67% des 1,86 Mt de commerce maritime traité dans l’année. Ainsi le Transmanche représente 3,1 millions €, soit 45% des recettes d’exploitation du port et environ 25% des recettes totales du SMPD. Les dépenses de fonctionnement hors investissement

    APPENDIX A Terms of reference and conduct of the inquiry Terms of reference 1. On 29 October 2012, the OFT sent the following reference to the CC: 1. In exercise of its duty under section 22(1) of the Enterprise Act 2002 (‘the Act’) to make a reference to the Competition Commission (‘the CC’) in relation to a completed merger, the Office of Fair Trading (‘the OFT’) believes that it is or may be the case that: (a) a relevant merger situation has been created in that: (i) enterprises carried on by or under the control of Groupe Eurotunnel S.A. have ceased to be distinct from enterprises comprising certain assets of former SeaFrance S.A.; and (ii) the condition specified in section 23(3) of the Act is satisfied; and (b) the creation of that situation has resulted or may be expected to result in a substantial lessening of competition within any market or markets in the UK for goods or services, including the supply of passenger and freight trans- port services on the short sea channel crossing.1 2. Therefore, in exercise of its duty under section 22(1) of the Act, the OFT hereby refers to the CC, for investigation and report within a period ending on 14 April 2013, on the following questions in accordance with section 35(1) of the Act: (a) whether a relevant merger situation has been created; and (b) if so, whether the creation of that situation has resulted or may be expected to result in a substantial lessening of competition within any market or markets in the UK for goods and services.
