Thomas M. Lucas is Resident Manager and Partner in the Norfolk, Virginia office of Jackson Lewis LLP. Mr. Lucas represents management exclusively in the full range of employment and labor law matters, including employment discrimination litigation and traditional labor law. He has represented corporate clients throughout the Mid-Atlantic Region and nationally for more than 25 years, including clients in the maritime, ship repair, manufacturing, healthcare and service industries. Prior to entering private practice, Mr. Lucas practiced with the National Labor Relations Board as a Trial Specialist and Deputy to the Assistant General Counsel.
An experienced trial attorney, Mr. Lucas defends clients in litigation arising under Title VII, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the Americans with Disabilities Act, and in other employment-related civil litigation. He also represents clients before federal and state administrative and regulatory agencies, including the Equal Employment Opportunity Commission, the Department of Labor (Wage & Hour, OFCCP, OSHA), the National Labor Relations Board, the Department of Justice and ICE.
Mr. Lucas' counseling practice includes drafting employment policies, handbooks, employment and non-competition agreements, and advising clients on the difficult day-to-day issues arising in the workplace. He trains managers and supervisors in the law and practice of union avoidance, and he counsels and represents clients in organizational campaigns, collective bargaining and related litigation.
Mr. Lucas was recognized for his employment and labor law expertise by his election as a Fellow in The College of Labor and Employment Law of the American Bar Association in 2009. He has been designated in The Best Lawyers in America, Labor and Employment Law, for the past nineteen years. He is a past Chair of the Labor and Employment Section of the Virginia Bar Association and an active member of the Employment Law Committee of the Virginia Chamber of Commerce. A union has begun efforts to organize Martin's Food Markets employees in the Richmond area.
But Martin's officials say representation by the United Food and Commercial Workers Local 400 union isn't needed.
The union made its case public for the first time Tuesday by sponsoring a vigil to commemorate the one- year anniversary of the sale of the Ukrop's Super Markets chain to Royal Ahold NV, the Dutch supermarket conglomerate that owns Martin's.
About 70 people showed up for the vigil outside the Martin's store in Carytown, mostly union members from local Kroger stores and union members from Ahold's Giant stores in Northern Virginia. Kroger is the only grocery chain that is unionized in the Richmond area.
The union, which represents grocery workers at area Kroger stores and aabout 70,000 Ahold employees in the U.S, said it wants the opportunity to speak with employeees and let them choose whether to unionize.
"We're asking Martin's to step up and allow the breadwinners to organize and to vote. That's all we're asking for," said the Rev. Lester Frye, pastor of Healing and Living Waters Ministry in Richmond.
"It's unfortunate that union activities are disrupting the shopping experience for customers," said Christopher Brand, a spokesman for the grocery chain. "Martin's is a uniion-free chain committed to providing the best working environment for our associates — one that allows us to communicate directly without the interference of an outside third party."
In a flier distributed Tuesday, the union compliments Ukrop's for its "progressive business model" but said Martin's "has failed to sustain the policies, practices and culture that had made its predecessor such a positive force in the area." Ukrop's was nonunion.
Brand said Martin's commitment to the area includes investing millions in stores, giving to charities, sponsoring events and hiring all of Ukrop's store employees.
"UFCW 400 is engaging in a misleading campaign, with the goal of unionizing our associates," Brand said.
