VETO MESSAGE ‐ No. 285

TO THE ASSEMBLY:

I am returning herewith, without my approval, the following bill:

Assembly Bill Number 7593, entitled:

"AN ACT to amend the economic development law, in relation to creat‐ ing a directory of technical and financial assistance programs for small businesses and minority and women owned business enter‐ prises"

This bill would create a new section in the Economic Development Law requiring the Department of Economic Development (DED) to maintain a directory of state, federal, private and non‐profit technical and finan‐ cial programs available to small businesses and minority and women‐owned business enterprises (MWBEs). Specifically, this bill would require that the directory be: (i) in a computerized format, searchable, updated monthly and available to the public; (ii) organized into financial and technical assistance categories, and further subdivided based upon whether the assistance is intended specifically for MWBEs or for all small businesses; (iii) include a catalog of state and federal agencies with detailed contact information for each agency; and (iv) provide a link to the census data from the most recent United States census data.

I fully support the development of resources to allow for better access for MWBEs and small businesses to public contracts and programs. However, the information that would be included in the proposed new directory is largely duplicative of information already made publicly available in Empire State Development's (ESD) New York State Directory of Small Business Programs. This directory was first created in 2009 in response to recommendations from the Small Business Task Force. For the past 6 years, it has been accessible online, searchable, publicly avail‐ able, and already organized into "financial assistance" and "technical assistance" categories. It includes program information, types of assistance available, information on how to apply for assistance, and numerous links to up‐to‐date contact information. The directory also includes numerous links to data, including but not limited to the census data as required in the proposed bill.

In addition to ESD's directory, the NY First website provides another resource for companies seeking business opportunities in New York. ESD also maintains a comprehensive directory of resources specifically for MWBEs, including dedicated webpages for the Division of Minority and Women's Business Development (DMWBD) that includes MWBE Business Resource, Business Development Assistance, and Certification pages.

Finally, since 2011, New York State has consolidated numerous funding sources across dozens of state agencies into a Consolidated Funding Application (CFA). The CFA has a specific application period and single application streamlining the various financial assistance programs available for small businesses and MWBEs, and fulfilling the intention of the proposed legislation to make identifying and obtaining funding simpler for small businesses and MWBEs. http://public.leginfo.state.ny.us/navigate.cgi?NVDTO: 2/3 1/8/2016 Legislative Information ­ LBDC

Requiring ESD to develop another directory as described in would result in the allocation of significant resources to the production of information that would be largely redundant with current offerings. Furthermore, no funding has been provided in this bill to cover the cost of implementing this bill's provisions. Therefore, this bill is better discussed in the context of the budget.

Since such information is already made available to the public while this bill's provisions remain unfunded, I am constrained to veto this bill.
