Barrick Cortez Refractory Ore Amendment - Wastes, Hazardous or Solid

1.0 Introduction

This resource report describes the affected environment relative to wastes, and considers the direct, indirect, and cumulative effects due to wastes, hazardous or solid generated during the Proposed Plan of Operations Amendment, which is described in Section 1.1. The analysis area for direct, indirect, and cumulative effects to the environment from wastes includes the ore transportation route. The transportation of ore from Cortez Mine (Cortez) to (Goldstrike) and back haul of ore from Arturo Mine (Arturo) was included in previous National Environmental Policy Act (NEPA) documents, which are incorporated by reference (BLM 2008a, BLM 2008b, BLM 2015). 1.1 Proposed Plan of Operations Amendment – Cortez Refractory Ore The Proposed Plan of Operations Amendment, as described in the Barrick Cortez, Inc. (NVN- 067575 [18-1A]) Amendment to Plan of Operations and Reclamation Permit Application for Temporary Refractory Ore Haulage (SRK 2018), is a minor amendment to the current Cortez Plan of Operations (NVN-067575 [14-1A]) (SRK 2015) to allow the shipment (transport or haul) of an additional 1.2 million tons of refractory ore from the Cortez Hills Open Pit to Goldstrike for processing in an 18-month period, which would begin immediately upon Bureau of Land Management (BLM) approval. The Proposed Plan of Operations Amendment would not change , stockpiling, sampling, or the ore transportation route; and would not require new ground disturbance. The Proposed Plan of Operations Amendment would modify the transportation plan to allow for additional trucks necessary to haul the additional 1.2 million tons of refractory ore for an 18-month period. Under the current Cortez Plan of Operations, Barrick Cortez, Inc. (BCI) is authorized to haul up to 1.2 million tons of ore each year from stockpiles at Cortez to processing facilities at Goldstrike, and is allowed to back haul 600,000 tons of oxide ore each year from Arturo to Cortez. Currently, the ore is transported via a fleet of over-the-road truck and trailer units, which consist of a Kenworth drive unit pulling a 28-ton primary trailer and a 10-ton auxiliary trailer. Ore may be transported at any time of day. Authorization of the minor amendment would increase the amount of ore authorized for transportation to Goldstrike for an 18-month period. The back- haul of ore from Arturo would not change. The minor amendment would increase the expected number of trucks per hour in each direction to 14, which equates to an additional 113 truck trips per day, resulting in a total of 280 truck trips per day (Matrix Design Group, Inc. 2017). The current ore transportation route would not change (Figure 1). The ore transportation route is located between Cortez and Goldstrike, in portions of Lander, Eureka, and Elko counties. BCI’s trucks are loaded with ore at Cortez and travel north on State Route (SR) 306 through Crescent Valley and Beowawe to Interstate 80 (I-80), then continue east on I-80, over Emigrant Pass, to the East Carlin exit (Exit 282). The trucks then cross over I-80 and re-enter I-80 going westbound from Exit 282 to Exit 280, then proceed north along SR 766 to Goldstrike. After delivery of the ore from Cortez, some of the trucks continue to Arturo to pick up oxide ore for

delivery back to Cortez on the return trip. The back-haul follows this route in reverse, entering I- 80 westbound at Exit 280. The current ore stockpiling would not change. The sampling and inventory of would not change. The transportation plan would be modified to include the additional 11 trucks needed to haul the additional ore. All other operations within Cortez would continue under the terms of current permits and approvals as authorized by the BLM and the State of . The Proposed Plan of Operations Amendment would not change the life of operations at Cortez. BCI’s work force would not change. The haul truck contractor would handle any adjustment in work force needed for the increased haulage. 1.2 Applicant-committed Environmental Protection Measures BCI’s applicant-committed environmental protection measures (EPMs) for operations at Cortez are identified in the Cortez Hills Expansion Project Final Environmental Impact Statement (FEIS) and Supplemental Environmental Impact Statement (SEIS) (BLM 2008a, BLM 2011) and FEIS Record of Decision (BLM 2008b). In addition, the BCI (NVN-067575 [14-1A]) Amendment 3 to Plan of Operations and Reclamation Permit Application (APO3) Environmental Assessment (EA) and Record of Decision (BLM 2015) and the Cortez Plan of Operations (SRK 2015), identified EPMs that applied specifically to APO3. These EPMs currently are, and would continue to be, implemented as standard operating procedures to mitigate potential impacts to the environment and human resources in order to prevent unnecessary and undue degradation of public lands. The current EPMs that specifically apply to the Proposed Plan of Operations Amendment are identified below. 1.2.1 Air Quality • Fugitive dust controls, including water application on haul roads and other disturbed areas, chemical dust suppressant application (e.g., magnesium chloride), where appropriate, and application of other Best Management Practices (BMPs) (BCI 2013) as approved by the Nevada Department of Environmental Protection (NDEP) Bureau of Air Pollution Control (BAPC), currently are, and would continue to be, implemented. (Current operating permits include: Class I [Title V] Air Quality Operating Permit [Permit No. AP1041-2141] and Mercury Operating Permit to Construct: Phase 2 [Permit No. AP1041-2220]). • To control combustion emissions, all manufacturer installed pollution control equipment will be operated and maintained in good working order. • Committed air quality practices include dust control for mine unit operations as described by the BAPC-required Surface Area Disturbance Fugitive Dust Control Plan. In general, the Dust Control Plan provides for water application on haul roads and other disturbed areas, chemical dust suppressant application (such as magnesium chloride) where appropriate, and other dust control measures in accordance with accepted and reasonable industry practice. • As part of the Nevada Mercury Control Program, Cortez uses chemical mercury precipitants in the processing circuit to inhibit the adsorption of mercury on the air control’s activated carbon, and remove the mercury from the system before it can be emitted to the atmosphere. 2

1.2.2 Wildlife and Special Status Species • Cortez will continue its mandatory employee education program for all personnel to minimize wildlife/vehicle-related impacts during operations. 1.2.3 Spill Prevention and Emergency Response • The Cortez Emergency Response Plan would continue to be maintained, updated annually, and implemented as needed, throughout the life of the Proposed Plan of Operations Amendment and life of the mine. The Emergency Response Plan describes the system that would be used for the prevention, response, containment, and safe cleanup of any spills or discharges of substances that potentially may degrade the environment, including petroleum fuels, lubrication oil, coolant, and used oil. The Emergency Response Plan also identifies the spill discovery, notification, and general cleanup procedures. The procedures outlined in the Emergency Response Plan apply to potential leaks and spills that would remain within the mine boundary or flow off site. • Chemicals would continue to be stored and handled in accordance with manufacturer’s recommendations and applicable regulations. The material safety data sheets (MSDS) for chemicals used at Cortez would continue to be kept at locations that are accessible to the working personnel in accordance with the Occupational Safety and Health Administration (OSHA) and Mine Safety and Health Administration (MSHA) Hazard Communication Standard.

1.2.4 Wastes, Hazardous and Solid Materials • The types of materials required to support the Proposed Plan of Operations Amendment would be the same as those currently used at Cortez. Cortez would continue to provide annual inventories of materials used to the appropriate agencies, including the State Fire Marshal’s office. • The Cortez Emergency Response Plan would continue to be maintained, updated annually, and implemented as needed, throughout the life of the Proposed Plan of Operations Amendment and life of the mine. The Emergency Response Plan describes the system that would be used for the prevention, response, containment, and safe cleanup of any spills or discharges of substances that potentially may degrade the environment. The procedures outlined in the Emergency Response Plan apply to potential leaks and spills that would remain within the mine boundary or flow off site. • If a hazardous substance is released in an amount greater than the reportable quantity, then Cortez would report the release to the National Response Center and to state and local authorities. Hazardous substances used at Cortez would continue to be transported to the site in accordance with United States Department of Transportation and applicable Nevada Department of Transportation (NDOT) regulations. • Implementation of the management procedures for the handling of solid and hazardous waste generated at Cortez, reagent storage, transportation, and handling requirements, would continue. • The current employee training program would continue to be implemented to inform employees of their responsibilities in proper waste disposal procedures.

1.3 No Action Alternative Under the No Action Alternative, the BLM would not grant approval of the proposed minor amendment to the Cortez Plan of Operations. The current 1.2 million tons per year of refractory ore that is mined at Cortez and transported to Goldstrike for processing, and the back haul of 600,000 tons per year of ore from Arturo to Cortez would continue as currently authorized. 1.4 Alternatives Considered but Eliminated from Detailed Analysis No other alternatives were considered as they would not meet BCI’s purpose and need. 1.5 Cumulative Effects: Past, Present, and Reasonably Foreseeable Future Actions Cumulative effects are defined as “the impact on the environment which results from the incremental impact of the action when added to other past, present, and reasonably foreseeable future actions (RFFAs) regardless of what agency (federal or non-federal) or person undertakes such other actions. Cumulative effects can result from individually minor, but collectively significant actions taking place over a period of time” (40 Code of Federal Regulations (CFR) 1508.7). Projects and actions considered in the cumulative effects analysis are defined for this resource report as those past, present, and RFFAs that could interact with the Proposed Plan of Operations Amendment in a manner that would result in cumulative effects. The past and present actions and RFFAs were described in detail in the Cortez Hills Expansion Project FEIS (BLM 2008a), and were updated for the subsequent SEIS (BLM 2011), the EA for BCI 2011 Amendment to Plan of Operations and Reclamation Permit Application (BLM 2014), the APO3 EA (BLM 2015), and have been updated for this resource report. These projects and actions are identified in Table 1 and Figure 1. The analysis area for cumulative effects is the ore transportation route. The period of potential cumulative impact is defined as 18 months, the period of time over which the Proposed Plan of Operations Amendment would occur. The cumulative effects analysis in this report incorporates by reference the analysis in the Cortez Hills Expansion Project FEIS and SEIS (BLM 2008a, 2008b, BLM 2011) and APO3 EA (BLM 2015). Table 1. The acreage is inclusive of approximately 27,804 acres of fire-affected pinyon-juniper woodland. 10 Surface disturbance associated with recreation activities have not been quantified. 11 Surface disturbance associated with existing livestock water use is assumed to be 0.5 acre per water right. Surface disturbance associated with the livestock RFFAs is based on the projected acreage affected by future seeding activities (change in vegetation and habitat), 0.5 acre per water development activity, and 43 acres for fencing and cattle guards. Livestock-related activities outside of the Carico Lake Allotment have not been quantified. 12 Surface disturbance associated with agricultural development is based on the acreage under irrigation and assumes that a change in vegetation and habitat equates to surface disturbance. Acreage values were based on a February 15, 1998, special hydrographic abstract for Hydrographic Basin No. 054 from the Nevada Division of Water Resources. These values are based on permitted or authorized use of water and may not reflect actual use in a given year. 13 This facility is located on the JD Ranch Road, 4 miles west of SR 278 at the BCI-owned JD Ranch.

2.0 Affected Environment – Wastes, Hazardous or Solid

The affected environment for wastes, hazardous or solid, includes air, water, soil, and biological resources that potentially could be affected by an accidental release of these wastes during transport of the additional ore. Procedures for reagent transportation, storage, waste management, and spill prevention and emergency response programs currently are in place and implemented for the existing operations at Cortez, as described in the South Pipeline Project FEIS (BLM 2000) and Pipeline/South Pit Expansion Final SEIS (BLM 2004). The regulatory framework for wastes, hazardous and solid, are described in the Cortez Hills Expansion Project FEIS (BLM 2008a). Petroleum products are excluded from regulation as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). Standards for the storage and spill prevention of petroleum products are established by regulations issued under the Clean Water Act. These regulations are contained in 40 CFR Part 112. In compliance with Part 112, the Cortez Emergency Response Plan describes the system that would be used for the prevention, response, containment, and safe cleanup of any spills or discharges of substances that potentially may degrade the environment, including petroleum fuels, lubrication oil, coolant, and used oil.

3.0 Environmental Consequences – Wastes, Hazardous or Solid

The analysis considered types of waste produced from the Proposed Plan of Operations Amendment and whether the types produced have potential to harm people or natural resources. 7

Effects Context for Wastes, Hazardous or Solid Localized: Generation of waste (hazardous or solid) would only occur during distinct activities at a specific location. Regional: Generation of waste (hazardous or solid) would require the use of or have an effect on regional resources. Short-term: Generation of waste (hazardous or solid) would occur during the Proposed Plan of Operations Amendment (18 months). Long-term: Generation of waste (hazardous or solid) would occur beyond the Proposed Plan of Operations Amendment (greater than 18 months). Intensity of Effects Definitions for Wastes, Hazardous or Solid Negligible: No harmful hazardous waste would be generated by the Proposed Plan of Operations Amendment. A relatively small amount of solid, non-hazardous waste (i.e. garbage, human waste) would be generated, and petroleum products would be used. Applicant- committed EPMs and BMPs would minimize the potential for adverse effects on humans or natural resources Minor: Harmful or hazardous waste would be generated during the Proposed Plan of Operations Amendment, in addition to generation of solid, non-hazardous waste, and use of petroleum products. Applicant-committed EPMs and BMPs would minimize the potential for adverse effects on humans or natural resources. Moderate: Harmful or hazardous waste would be generated during the Proposed Plan of Operations Amendment. Solid, non-hazardous waste would be generated, and petroleum products used. Applicant-committed EPMs and BMPs would minimize the potential for adverse effects on humans or natural resources, but the exposure risk or quantities used/generated would increase the potential for harmful effects. Major: Harmful or hazardous waste would be generated during the Proposed Plan of Operations Amendment. Solid, non-hazardous waste would be generated, and petroleum products used. Applicant-committed EPMs and BMPs would minimize the potential for adverse effects on humans or natural resources, but the risk for adverse effects would be high. 3.1 Proposed Plan of Operations Amendment Cortez maintains an Emergency Response Plan to ensure effects related to wastes, hazardous or solid, do not occur. Changes to Cortez’s existing procedures and programs are not anticipated to be necessary as a result of the Proposed Plan of Operations Amendment. Under the Proposed Plan of Operations Amendment, there would be no change in the current reagent consumption rate and no new storage facilities would be needed. The majority of the hazardous materials used at Cortez are spent or consumed during operations. Materials that are not spent or consumed (e.g., petroleum oils, antifreeze, etc.) are recycled, to the extent possible, or disposed of off-site in an approved depository in accordance with Cortez’s Solid and Hazardous Waste Management Plan and all applicable federal and state regulations (BLM 2008a).

Under the current regulatory framework, including continued implementation of the current Emergency Response Plan, effects of the Proposed Plan of Operations Amendment would be minimized to a localized and negligible level, and would be short-term. 3.2 No Action Alternative Under the No Action Alternative, the BLM would not grant approval of the proposed minor amendment to the Cortez Plan of Operations. The currently authorized 1.2 million tons per year of refractory ore that is mined at Cortez and transported to Goldstrike for processing, and the back haul of 600,000 tons per year of ore from Arturo to Cortez would continue under the terms and conditions of current permits and approvals as authorized by the BLM and State of Nevada. There would be no additional direct or indirect impacts to the environment from wastes, hazardous or solid, beyond those analyzed in previous NEPA documents for existing operations at Cortez. 3.3 Cumulative Effects Proposed Plan of Operations Amendment The potential for a release or spill is low and the increase in ore transported would be short- term; the Proposed Plan of Operations Amendment would not incrementally combine with other past, present, or RFFAs to result in cumulative effects associated with wastes. No Action Alternative Ore transport activities would continue as currently authorized under the No Action Alternative. With continued implementation of the Cortez Emergency Response Plan, cumulative effects are not anticipated.
