CANADIAN ABORTION LAW RAYMOND MICHAEL FERRI* AND TERESE FERRI** INTRODUCTION Rarely has an issue sustained the level of public controversy that the abortion issue has. Even more rarely has a controversy been as protracted and seemingly irreconcilable as this. Moreover, the controversy appears to be heightening rather than diminishing in public stature. Abortion is surely an issue of the utmost importance in its own right. But its social impact has been intensified by the fact that it has become a focal point for many other serious social issues. Abortion has become, it seems, the point around which two fundamentally irreconcilable sets of values have begun to crystallize in modern society. Few subjects have pro- voked such fundamentally divergent responses. As the emerging rift deep- ens, the ability to remain neutral dissolves. The implications of abortion in the nature and control of incipient human life, the function of law, the purpose of medicine, the legal and ethical responsibilities of public institutions, touch all of us deeply and personally. These far-reaching implications require that the difficult reali- ties of abortion be honestly confronted and compassionately assessed with an acute awareness of the individual and social consequences.

What prompted me to write on this strategic question at this time is the statement that General Douglas McArthur made at the end of World War II, when he accepted the surrender of the Japanese military forces on the deck of the battleship Missouri, on September 2, 1945. McArthur had fully realized that “we have had our last chance” and that the next war was going to be a war of extension, because he understood that a thermonuclear war was unsurvivable. He stated: "Military alliances, balances of power, leagues of nations, all in turn failed, leaving the only path to be by way of the crucible of war. The utter destructiveness of war now blots out this alternative. We have had our last chance (My emphasis). If we will not devise some greater and more equitable system, Armageddon will be at our door. Little is known of their origins, and most of their records were destroyed during the suppression in the fourteenth century. In addition, they combined seemingly incompatible objectives: warriors and monks, as well as laity and clergy. This study bridges those divides, providing the historical developments from a secular and religious context. To understand the Templars’ foundation, it needs to be based on a premise that combines the ideologies of the priestly and knightly classes–salvation and the means to attain it. The conclusions were drawn following a multi-disciplinary approach. The primary source materials included the Hebrew and Christian Scriptures, patristic authors, medieval literature, canon law, the Templars’ rules, in addition to monastic cartularies and chronicles. The secondary sources were a similar collection from various disciplines. The approach allowed for the examination of the Templars from multiple angles, which helped to highlight their diversified origins. The Knights Templar were the product of a long evolution beginning with the Pauline imagery of the Christian as a soldier battling his/her own spiritual demons and continuing through the call for a crusade to defend the Patrimony of Christ.

Bouchard FAMILY STRUCTURE AND FAMILY CONSCIOUSNESS AMONG THE ARISTOCRACY IN THE NINTH TO ELEVENTH CENTURIES* There can be no question that the period from the ninth to eleventh centuries in westem Europe was one of political upheaval and change for the aristocracy. Charlemagne’s empire was invaded, fought over, divided into new kingdoms and principalities. Fief-holding, vassalage, and castles first became widespread. Even the sorts of men who wielded power changed as new lineages first of counts and then of castellans appeared and married into previously established lines1. This political change, it is generally agreed, was accompanied by some sort of change in the family structure of the aristocracy, but there has been a good deal of debate over exactly what this change entailed. In this paper, I shall reexamine the question of noble family structure in this period, trying first to define some of the parameters of the discussion and then making suggestions on the nature of the changes in family consciousness, suggestions quite different from the conclusions many have drawn in the last twenty-five years. I shall do so using concrete examples drawn from three different lineages or family groups.

Laws and circumstances have diverged to the point where the legal right to abortion is strong in Canada but vulnerable in the USA. Canada’s Legal Situation Canada first liberalized its criminal abortion law in 1969, allowing it to be performed in hospitals with the approval of a “therapeutic abortion committee.” But the law resulted in unequal access so the Canadian Supreme Court threw out the entire law in 1988. Although the Canadian legislature soon tried to re-criminalize abortion, the bill failed to pass. Governments have said repeatedly over the years that they do not intend to re-legislate against abortion. This leaves Canada as the only democratic, industrialized nation in the world with no legal restrictions on abortion. (Only one other country has no laws: China). Yet Canada has a relatively low rate of abortion compared to other industrialized countries and one of the lowest rates of abortion-related complications and maternal mortality in the world. About 90% of abortions are performed before 12 weeks gestation, and 99.3% by 20 weeks gestation.1 These statistics prove that no laws are needed to regulate or reduce abortions, and that women and doctors can be trusted to exercise the right responsibly.
