But environmental activists shouldn’t rejoice just yet. The announcement is yet another example – such as banning plastic straws, false sustainability claims and corporate commit- ments that are far in the future – that seem to be more of a PR exercise than real attempts to move the needle. I’m a professor of engineering and the director of the MIT Center of Transportation and Logistics. As I argue in my book “Balancing Green: When to Embrace Sustainability in a Busi- ness (And When Not To),” announcements of these kinds distract us from legitimate – and more challenging – measures we need to put in place to avoid environmental catastrophe.

Behind the headlines InterContinental Hotels Group CEO Keith Barr says that replacing miniature bathroom products “will allow us to signifi- cantly reduce our waste footprint and environmental impact” at the conglomerate’s hotel chains, which include InterContinen- tal, Crowne Plaza and Holiday Inn. It’s true that the British foundation Clear Con- science estimates that 200 million travel-size toiletries end up in U.K. landfills every year, but there’s another motivation: With 5,600 hotels, the savings for IHG can mount to over US$11 million annually. Additionally, studies we have carried out at MIT and else- where show that evaluations of a product’s environmental impact can mislead if economists don’t consider the entire sup- ply chain management process. For example, most of the carbon footprint of companies like Apple, Microsoft and Cisco comes from the suppliers who actually make the iPhones, routers and Xboxes, not directly from the company itself. Additionally, the net reduction in discarded plastic could be minimal at best if the larger containers are filled from single-use plastic pouches. Also, we do not yet know if the larger contain- ers are recyclable, nor the cost and environmental impacts of making, transporting, installing and maintaining them. Even if replacing miniature toiletries does reduce waste somewhat – as other hotel chains join the movement and Cal- ifornia is moving to ban them – the move to bulk products will barely put a dent in the plastic waste that now clogs the planet’s rivers and oceans. It is another “feel good” initiative which help avoid the move to more serious actions that can actually make a difference. Banning plastic straws is another such example. While outlawing plastic straws makes for excellent public relations copy, it has virtually no impact on the global accumulation of plastic garbage.

Blige. Jackson said “Power Book II” will pick up soon after “Power” ends. He said in the new version “we’ll see the after- math of what happens in the season six finale.” Jackson is also planning other “Power” prequels including “Raising Kanan,” based on his popular character Kanan who was killed in season five. “It will show the influences from the ‘90s, where Kanan was growing up and how the activities in the neighborhood groomed him into who he was in ‘Power,’” he said. Along with “Power” spinoffs, Jackson wants to develop a project on Starz focused on the Black Mafia Family. The story would delve into the backstory of Demetrius “Big Meech” Fle- nory, who started the drug trafficking and money laundering organization in Detroit before intersecting it with the hip-hop music scene. The plethora of shows is a part of Jackson’s plan to take over Starz. “As (Starz) becomes a household necessity like HBO, you’ll see faces that look like ours consistently on it,” he said. “It’ll become more of a diverse leading cast than what you would find on HBO. PARENTS FIGHTING AGAINST MANDATORY VACCINATIONS DENIED U.S. District Court for the Eastern District

Six parents of children with disabilities who attend schools in New York sought an injunction against the repeal of the reli- gious exemption for mandatory vaccinations and were denied in the Eastern District Federal Court on Aug. 19. The parents maintained that the public health law that requires mandatory vaccinations is preempted by the Individuals with Disabilities Education Act (IDEA). For more than 50 years, the law mandating vaccinations for all students who attend schools in New York, whether public, private or parochial, allowed for a religious exemption for par- ents who held genuine religious beliefs that were contrary to the practices. In the 2018-2019 school year, there were measles outbreaks in the state primarily concentrated in com- munities with high rates of religious exemptions. As a result, on June 13, a repeal of the religious exemption was enacted, and schools are prohibited from allowing unvaccinated chil- dren to attend. In this case, the parents alleged that their children were deprived of “access to special education and related servic- es mandated by their individualized education program (or IEP)” and that the repeal interfered with their work sched- ules by requiring them to stay home to care for their chil- dren. Additionally, the parents also contended that their children will regress behaviorally and academically as a result of the gap in services following the repeal. One of the core purposes of the IDEA is to ensure that chil- dren with disabilities are provided with free appropriate public education. Essential to that purpose are IEPs and, if a parent disagrees with the school’s IEP decisions, the act “establishes various procedural safeguards that guarantee parents both an opportunity for meaningful input into all decisions affecting their child’s education and the right to seek review of any deci- sions they think inappropriate.” Relying on those very safe- guards, the parents in this case argued that the repeal of the reli- gious exemption “creates an impermissible condition precedent for students” to receive agreed-upon services under the IDEA. In her decision, Hon. Allyne Ross noted that the parents never explained why they are unable to vaccinate their children. In par- ticular, she pointed out that a medical exemption still exists and if applicable, those students could continue in the school of their choice in the fall. Justice Ross concluded that IDEA does not pre- empt the state health mandate as there is “no conflict between federal requirements for providing special education to students with disabilities and a neutral state law that mandates compliance with immunization requirements for all students.” Finally, Justice Ross also determined that the parents were not entitled to a stay-put order under IDEA, which they had requested as an alternative to the injunction, because the fami- lies’ failure to comply with the state law, “a unilateral action taken by the parents of children with disabilities,” does not con- stitute a change in placement sufficient to trigger stay-put relief. — V.D. et al v. In an alleged oral agreement, Martin Greenfield Clothiers, Ltd., a Brooklyn-based manufacturer of men’s tailored clothing, was to be the exclusive manufacturer of certain custom suits for Group, a retail clothier. In their amended complaint, Greenfield Clothiers sought to recover damages for breach of contract and under the theory of prom- issory estoppel, the legal principle that holds that a promise is enforceable by law. Brooks Brothers moved to have the amended complaint dismissed, the Supreme Court granted that motion and Greenfield Clothiers subsequently appealed. Hon. Reinaldo Rivera, Hon. Jeffrey Cohen, Hon. Joseph Maltese and Hon. Valerie Brathwaite Nelson agreed with the lower court’s dismissal of the breach of contract claim, explaining that the alleged oral agreement was unenforceable as violative of the statute of frauds. Additionally, the justices conferred that the promissory estoppel cause of action was correctly dismissed as it was impermissibly predicated on allegations that Brooks Brothers violated the same promise it made under the oral agreement.
