NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980 ESSEX COUNTY COUNCIL PUBLIC PATH DIVERSION ORDER FOOTPATHS 2, 32, 35 AND 36 BERDEN AND FOOTPATHS 56 AND 59 CLAVERING IN THE DISTRICT OF UTTLESFORD On 10 April 2019, Essex County Council confirmed the above order made under section 119 of the Highways Act 1980. The approximate central postcode subject to the following public path changes is CM23 1AW The effect of the order as confirmed, as shown on the order map will divert: 1) a part length of Footpath 32 commencing from a point at its junction with Dewes Green Road at grid ref; 54604,23008, proceeding north east on the eastern side of Berden Priory Farm access track, across the field to the hedge boundary, then turning west to join the aforementioned access track, to an alternative route commencing from the same point at the junction with Dewes Green Road proceeding north east along the farm access track to re-join the existing path at Berden Priory Farmyard. 2) a part length of Footpath 32 commencing from a point at the southern end of Berden Priory Farmyard at grid ref: 54609,23022, proceeding north east through the farmyard then east through the scrub north of the sunken pond to the gravel access track at the northern entrance to The Priory, to an alternative route commencing from the aforementioned point at the southern end of the farmyard, proceeding north through the farmyard to the access gate then continuing south east at the field edge to join the unaffected path north of The Priory. 3) a part length of Footpath 2 commencing from the field edge boundary north of The Priory at grid ref: 54621,23029, proceeding north west across the field and through the hedge gap, then turning west at the field edge to its junction with Berden Priory Farm access track, to an alternative route commencing from the northern farmyard access gate (grid ref: 54611,23033), proceeding north east along the access track to the next path junction at the field edge. 4) a part length of Footpath 2 and Footpath 59 commencing from the path junction north east of Berden Priory Farm at grid ref: 54615,23043, proceeding initially west along the track between the fields for 25 metres then turning north east across the field corner, through the hedge gap, across another field to its northern end at the hedge boundary gap, to an alternative route commencing from the aforementioned point at the path junction proceeding northerly at the field edge west of the hedge to the northern end of the field, continuing east along the headland to the aforementioned hedge gap. 5) a part length of Footpath 35 commencing from a point along the access track to The Priory at grid ref: 54619,23019, proceeding east adjacent to the fence to the junction with Footpaths 36 and 37 Berden in the meadow, to an alternative route commencing from the aforementioned point along The Priory access track, proceeding north along the gravel driveway east of the barns then north east along the gravel/grass track to the northern driveway entrance of The Priory. 6) a part length of Footpath 2 commencing from the northern driveway entrance to The Priory, proceeding south east on the north side of the fence passing the telegraph pole to the hedge gap and path junction at grid ref: 54632,23023, to an alternative route commencing from the aforementioned northern entrance to The Priory, proceeding easterly along the gravel/grass access track to the junction with Footpath 38 Berden at grid ref: 54635,23028 7) a part length of Footpath 2 and Footpath 56 commencing from the junction with Footpath 38 Berden along the northern access Track to The Priory, proceeding north east across the field, through the hedge gap then continuing northerly across two crop fields to the footbridge at grid ref: 54648,23075, to an alternative route commencing from a point at its junction with Footpath 38 Berden on the northern access track to The Priory at the large hedgerow (grid ref: 54658,23028), proceeding north west at the field edge east of the hedgerow to the far end field corner where it turns east at the field edge to the aforementioned footbridge. 8) a part length of Footpath 36 commencing from a point at its junction with Bonnetting Lane (grid ref: 54673,23028), proceeding south west across the field to the footbridge, continuing west across the bridge through the scrub and across another field to the footpath junction in the meadow at grid ref: 54632,23018, to an alternative route commencing from the aforementioned point at Bonnetting Lane, proceeding westerly then south at the field edge on the south of the hedgerow to connect with Byway 56 Berden. A copy of the order as confirmed and the order map have been placed and may be seen free of charge at Uttlesford District Council Offices, London Road, Saffron Walden, CB11 4ER and at Chelmsford Public Library, Market Road CM1 1QH during normal working hours. Copies are available on request from the Chelmsford Library at a charge. The alternative routes come into force on 09 May 2019, and the old routes shall be stopped up with effect from 16 May 2019, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 02 May 2019 make an application to the High Court.
