BRIEFING #12/2019 A HUNDRED YEARS OF INJUSTICE On 14th October, Spain’s Supreme Court made public its verdict convicting nine political and civil society pro-independence leaders of sedition and sentencing them to a total of 99 years and 6 months of prison and to a similar ban from holding public office1. It is worth remembering that, as pointed out in a communiqué by Agora Judicial- a professional association of judges- “Those found guilty worked together in the calling and the organisation of a referendum on self-determination and that, in itself, is not a crime (...). Such was the decision of the [Spanish] Parliament in 2005 when it excluded from the Criminal Code the call of a referendum without legal base.” Similarly, magistrate and jurist Joaquim Bosch claims that “(…) the verdict attributes to the pro-independence public officials the authorship of sedition through a stream of behaviours linked to the call of the referendum and their calls to go to vote. That attribution of guilt also generates legal doubts, because holding illegal referendums is a conduct that was decriminalized. And encouraging citizens to vote cannot criminalize the summoners for the crimes that may occur subsequently. If it is not a crime to hold a referendum, even less so calling to participate in the consultation. For instance, those who call to take part in a peaceful demonstration cannot be responsible for the offenses that may occur in it. There is no causal link. However, the sentence considers several public officials responsible for sedition, while admitting that they did not participate in acts of passive resistance, nor did they encourage the sitting downs to hinder the actions of [police] agents”. -

Last year, I served on the AmeriMUNC Secretariat as the Charges D’Affaires and currently I am an Assistant Head Delegate of the AU Model United Nations competitive travel team. I have done MUN for seven years, competing at 24 conferences across the US and Canada, and I once chaired a conference in the Netherlands! I’m proud to say that AmeriMUNC will be my eighth time chairing. Outside of MUN, I am also the President of my sorority, Phi Mu. If you have any questions about greek life or collegiate MUN, I’d love to chat via email or at the conference. I’m personally very excited to be forming our own new nation, the Catalan Republic. Reagrupament continuarà sent guionista de la història de Catalunya. | 17-11-2012 | 10:52 V Assemblea Nacional Amb el missatge del president Joan Carretero, que ha llegit la vicepresidenta Rut Carandell, que Reagrupament ha de treballar per continuar sent el guionista de la història, s'ha clos aquest migdia de diumenge la V assemblea Nacional de la formació independentista, que s'ha iniciat puntualment a les 10 del matí, amb la presència de més 300 associats a la sala Marià Vila d'Abadal de l'Edifici El Sucre de Vic, amb el Cant de la Senyera, la benvinguda per part de Reagrupament Osona i la intervenció de l'alcalde de la ciutat, Josep-Maria Vila d'Abadal. La vicepresidenta ha afegit que a partir de la presa de posició hem tingut contactes amb CDC i que el president Artur Mas va trucar personalment el president Joan Carretero per agrair-li el suport de Reagrupament. L'actual president de l'Associació de Municipis Independentistes (AMI) ha agraït als reagrupats que per segona vegada, en menys d'un any i mig, hagin escollit la capital d'Osona per celebrar l'assemblea nacional. Vila d'Abadal ha destacat que "la mania del catalanisme de buscar l'encaix amb Espanya ens ha distret durant 130 anys" i ha encoratjat els associats a continuar endavant amb els objectius de transversalitat i regeneració democràtica. Per a l'alcalde vigatà el moviment nascut l'11S és un moviment social. "I això no pot decaure. No donem la torxa als polítics. Els partits faran tàctica política i nosaltres hem de ser ferms per un estat lliure i independent", ha afegit Rut Carandell, que ha estat l'encarregada, en absència del president, de fer l'informe anual, ha donat especial rellevància a la decisió presa per la Junta Directiva Nacional de donar suport, en les pròximes eleccions plebiscitàries, al president Mas. -

CATALONIA, YEAR 2016 Joaquín Tornos Mas Tenured Professor of Administrative Law Universitat de Barcelona On 15 March, the Instituto de Derecho Público presented its yearly Report on the Autonomous Communities in the Senate. The Report includes amongst others the assessment of the political and institutional activity carried out in Catalonia in 2016. Some highlights: As regards political activity, the following should be underlined. On 10 January Carles Puigdemont was appointed President of the Government of Catalonia by a vote of 70-63 thanks to two pro-independence parties, more specifically, to the 62 deputies of Junts pel Sí (Together for Yes) and eight deputies of CUP (Popular Unity Candidacy, two of which abstained from voting). After months of negotiating the new budgets proposed by the Government, however, CUP refused them over and over again and in June they had not still been adopted. In order to overcome the political crisis arising from this situation, a motion of no-confidence was presented against the Catalan President. On 27 September the motion of no-confidence did not succeed thanks to the votes of Junts pel Sí and CUP. CUP voted for the President in exchange for the Government’s promise to hold a referendum on the independence of Catalonia in 2017. However, they did not guarantee they would vote for the new budget as well. As a consequence, President Puigdemont was forced to launch, on 23 December, the National Referendum Pact and confirm he would hold a referendum in 2017, whether agreed with the national Government or unilateral (“the Catalan response to the national Government is ‘referendum or referendum’”). -

Política | | Actualitzat el 08/10/2019 a les 17:44 Cinc claus sobre qui és Juan Antonio Geraldes, candidat d'Errejón a Catalunya Politòleg de 31 anys, va ser número dos a la llista de Guanyem Sant Boi a les eleccions municipals del 26 de maig El candidat de Més País a Barcelona, Juan Antonio Geraldes Després de suar per aconseguir els avals quasi en temps de descompte, Íñigo Errejón té ja candidat per a Més País a Barcelona. El seu nom és Juan Antonio Geraldes, segons ha avançat El Periódico i ha confirmat NacióDigital, no és conegut pel gran públic i és politòleg. La seva tria, que preocupa especialment l'espai dels comuns, no està exempta de polèmica perquè fins fa pocs dies era militant de Comunistes de Catalunya, partit liderat per Joan Josep Nuet integrat a EUiA. A continuació, cinc claus de qui és Geraldes i per què la seva tria ha aixecat polseguera. 1. Nascut l'any 1988, Geraldes és politòleg i veí de Sant Boi de Llobregat. Ha estat vinculat a moviments estudiantils com el contrari al pla Bolonya. 2. Treballa com a consultor d'administracions públiques en el sector de les TIC i, per ara, no ha ostentat cap càrrec públic ni polític. 3. A les passades eleccions municipals del 26 de maig es va presentar com a número dos de la candidatura de Guanyem Sant Boi, formada per la CUP i Sobiranistes -partit liderat per Nuet, exlíder d'EUIA-, Som Aternativa i Moviment d'Esquerres, però no va obtenir representació. 4. De fet, va ser militant de Comunistes i ha participat en actes de Sobiranistes a Sant Boi. -

#DefendCataloniaSaveEU On the 9th of March 2021, the European Parliament waived the parliamentary immunity of three Catalan MEPs – Carles Puigdemont, Toni Comín, and Clara Ponsatí, a new example of Spain’s repressive actions against the Catalan people’s political and social representatives. Together with the case of Oriol Junqueras, elected MEP in detention in Spain sentenced to 13 years for organising a democratic referendum, Spain is incurring in the violation of the right to vote and right of political and public participation of more than two million European citizens. This took place after the Catalan people’s right to self-determination has been repeatedly violated by Spain, as well as their rights to freedom of expression, freedom of assembly and association, and political participation. In this sense, it is important to recall that organising a referendum without the central government’s consent is not an offense under Spanish law, as the United Nations Working Group on Arbitrary Detention pointed out in June 2019. Nine Catalan civil and political leaders have been in prison for more than three years, including six former members of the Catalan government, the former speaker of the Parliament of Catalonia, and two civil society leaders, sentenced to between 9 and 13 years on charges of sedition and others, crimes that have not been deemed as such by Courts in Germany, Scotland, or Belgium. In the case of Lluís Puig, former Catalan Minister of Culture in exile, for whom the Spanish justice issued an arrest warrant, the Belgian justice has recently affirmed that the Spanish Supreme Court does not have the authority to try former members of the Catalan government and raised concerns on the fact that Lluis Puig' presumption of innocence could be at risk in Spain. -
