I wish to acknowledge the staff at the National Library of Scotland for their assistance in organising an event in January, for the presentation of my findings. 4 | P a g e Abstract Scotland’s historic and contemporary representation of capital punishment remains relatively unexplored in existing scholarship. This study aims to determine how capital punishment was presented to Scots in eighteenth and nineteenth century press publications. This research explores the representation and function of execution broadsheets from the National Library of Scotland’s collection through thematic analysis. Furthermore, in applying a case study approach this study analyses the press representation of two notorious capital convicts in the early nineteenth century, namely William Burke and Mary McKinnon. In addition, through analytical research this study aims to understand how Scotland’s legacy of capital punishment is presented to contemporary audiences on Edinburgh walking tours. This study supports existing scholarship which suggests that execution broadsides are complex representations, containing contradictory discourses. However, in adding to existing scholarship, this study finds that the degree of complexity in representation is subject to variation depending on the identity and crime of the convict in focus. Henceforth, this study posits that several factors relating to the convicts’ identity and circumstances factored into representation, including: gender, nationality, age and offence. Findings demonstrate that whilst execution was generally reported on as an accepted consequence for committing crime, certain convicts were depicted more sympathetically and favourably than others. In addition, findings establish that stories of execution are found to contribute significantly to the content presented on Edinburgh walking tours. Sensationalism is marked as a recurring theme in historic and contemporary representations of capital punishment in Scotland, indicating that stories of execution in Scotland have consistently served to entertain as well as to inform audiences. This study finds that cultural and societal shifts have impacted representations of capital punishment and presents an argument that factors such as time, scale and culpability impact contemporary representations of capital punishment, ultimately distinguishing sites of execution from other dark tourist sites. 5 | P a g e Introduction Existing scholarship signifies the importance of cultural representations of capital punishment in shaping public opinion on the matter and in serving several didactic functions. Scotland practiced capital punishment as a method of justice up until 1963. However, existing literature is predominantly focused on representations of capital punishment in England, as opposed to Scotland. Scotland maintained a degree of autonomy and a distinct legal system throughout the eighteenth and nineteenth centuries; therefore experiences of capital punishment were very different to that of the rest of Britain. Thus, Scotland’s cultural representation of capital punishment has to be distinguished from the rest of Britain. This study aims to address this evident gap in scholarship. This research considers the medium of execution broadsides, single, one penny sheets distributed in the eighteenth and nineteenth centuries, as a key source in keeping sections of the Scottish population informed about the events of execution in the eighteenth and nineteenth centuries. This thesis contains thematic analysis of the 147 Scottish execution broadsides which have been preserved by the National Library of Scotland (NLS), as a means of insight into historic representations of capital punishment in Scotland. This study’s findings support existing scholarship which indicates that execution broadsides are complex writings which contain contradictory discourses. She has her hero bluntly acknowledge that “to examine the causes of life, we must first have recourse to death,” which is found only in “vaults and charnel houses” and amid the “unhallowed damps of the grave” (pp. 79, 82). Though without “superstition” himself, Victor is fully aware of the popular prejudice against the use of corpses; he works at night and in secret. Thus Shelley articulated what was an awkward yoking of knowledge and fear, humanity’s advance and its criminal underbelly, throughout the Enlightenment. Lisa Rosner’s The Anatomy Murders explores that yoking as exemplified by William Burke and William Hare, serial killers of 1828, whose string of murders were motivated by the constant demand, from the schools of anatomy and surgery in Edinburgh, for bodies to study.

Specifically focusing on the England in the eighteenth and early nineteenth centuries, stories of people who had been prematurely diagnosed as dead, prematurely set into their coffin for viewing, and prematurely committed to the grave have been well documented within medical texts, academic books, art, and newspapers articles from the time. These sorts of publications showcased societies awareness of people were being misdiagnosed as dead committed to the earth alive. In response, scholarly physicians began to identify the stages of death with the intent of properly diagnosing people, and only committing those who were absolutely dead to their final resting places.

Striking events, like for example the famous Burke and Hare Murders in 1828, have covered the city in a dark veil which has become an interesting theme in novels from all kinds of Scottish writers ever since. This is perhaps the reason why Edinburgh has produced world-famous writers like Robert Burns, Sir Walter Scott, Robert Louis Stevenson, and Sir Arthur Conan Doyle, who have been the city‟s pride for the last two hundred years. Therefore, when visiting the capital, tourists simply cannot fail to notice the several statues, museums, and street names dedicated to the famous Scottish writers who grew up there. It is therefore no wonder that the city is proclaimed to be the world‟s first UNESCO City of Literature, back in 2004.

  • The Hope Street Bodysnatchers
    The Hope Street Bodysnatchers Bodysnatching in Britain reached its heights in the 1820s. Medical colleges needed to teach practical anatomy, but until the Anatomy Act of 1832, only the bodies of executed criminals could legally be used for dissection, so demand far outstripped supply, leading to the growth of illicit trade in corpses, and even to the Burke and Hare murders of 1828. In Liverpool in 1824, Robert Armstrong and Thomas Stewart had been convicted of bodysnatching, and it’s notable that William Rathbone had proposed that the Liverpool Literary & Philosophical Society should pay their fines, and, after the 1826 case, petitioned for a change in the law. The Liverpool bodysnatching scandal of 1826 centred on a cellar at the back of 8 Hope Street, by the street-numbering of that time. Marie McQuade (2006) finds that Council lease registers conclusively place the building at the corner of the lane that would become the western end of Back Canning Street: that is, the present 47 Hope Street, on the north side of Back Canning Street. Here, the Rev. James MacGowan lived and worked, having set up a boys’ school – around 1822 – in a purpose-built schoolroom at the rear of the property, with its entrance on the lane. In January 1826, MacGowan began renting the large cellar beneath the schoolroom to fellow Scotsman John Henderson, as a cooperage for his fish-oil exporting business. Apart from the occasional unpleasant smell from the cellar, all seemed well for some months. In the early evening of Monday 9 October 1826, three large casks were delivered by cart from this cellar to the smack Latona in George’s Dock, for shipping to Edinburgh.
