Living Q & A: I want to apply to have my husband, in police custody, released on bail 外国人暮らしのQ&A「夫が警察に逮捕された。拘留中なので保釈を請求したい」

My husband was arrested for being in possession of illegal drugs. At first, I had the duty lawyer visit him. My husband is still in custody, and I hope to have him released on parole. But when I consulted a lawyer, I was told it would cost around 2 million yen. What should I do?

When an accused person under indictment (kiso / 起訴) by a public prosecutor (kensatsukan / 検察官) and in custody (kōryū / 拘留) is released on condition of payment of a bond, maintaining the efficacy of custody while having the enforcement of detention suspended, this is known as hoshaku (保釈), or bail. Release on bail can be applied for when the suspect (higisha / 被疑者) in a criminal case (keiji-jiken / 刑事事件) has been arrested, sent to the prosecutor, indicted and is being held in custody awaiting trial (saiban / 裁判). There is no system for applying for bail before the suspect has been indicted.

Persons able to apply for bail are the accused individual themselves or their lawyer (bengoshi / 弁護士), a legal representative (hōteidairinin / 法定代理人), a curator (hosanin / 保佐人), a spouse (haigūsha / 配偶者), or a direct blood relative or sibling of the accused. Hoshaku requires payment of a bond (hoshōkin / 保証金). The amount of the bond is determined by the court after consider- ation of such factors as the seriousness of the crime, the financial situation of the accused, and the living conditions of the accused. In many cases, the amount of the bond is between 1.5 million and 3 million yen. If bail is not revoked and the bond forfeited, the bond will be returned to the payer upon completion of court proceedings, regardless of whether the defendant is found guilty or innocent. If you are unable to gather sufficient funds for the bond yourself, you might consider consulting the Japan Bail Support Association (Nihon Hoshaku Shien Kyōkai / 日本保釈支援協会), an organization which makes temporary payment on behalf of those seeking bail. It's a good idea to discuss bail with the lawyer who will represent the defendant in court.

NAGOYA CALENDAR 2020.07 05 Nagoya in Wartime

This year marks the 75th anniversary of the end of the Second World War, in August 1945. Although the global conflict is considered to have begun in 1939 with events in Europe, for the Japanese people the summer of 1945 saw the close of the Second Sino-Japanese War (1937-1945) and the Pacific War (1941-1945). Some in Japan even refer to this period as the 15-Year War. In the seven and a half decades since, the generation who experienced the war has become fewer, and for younger generations the war is summed up in words such as Nanjing, Hiroshima and Nagasaki. But Nagoya and Aichi, like countless other places in Japan, have their own wartime stories to tell. Looking at the city that developed after the war, it is difficult to imagine what life must have been like in wartime Nagoya. This issue, we take a brief look at the war in Nagoya, from some museums where you can get a glimpse of everyday life in wartime Nagoya through a diverse variety of artifacts, to remnants of the former military presence, and the air raids that changed the face of the city.

Aichi-Nagoya War Archives 愛知・名古屋 戦争に関する資料館 Located on the first floor of the distinctive Aichi Prefectural Otsubashi Annex building, built in 1933 and donated to the Aichi Prefectural Government in 1957, this museum aims to pass the memory of the war as experienced by residents of Aichi to future generations through displays of war-related artifacts donated by residents. Exhibits include such items as clothing worn by military personnel and civilians, everyday (wartime) objects, publications and documents. The centerpiece is a cut-away replica of an E46 incendiary cluster bomb and a CG recreation of the firebombing raids on Nagoya illustrating how the bombs functioned and photos of the ensuing devastation. The museum also features a 250kg bomb casing unearthed during construction work at the Minami Police Station in 1997. The descriptions for many of the exhibits feature furigana, which make them more accessible to visitors able to read some Japanese. When: Open 10:00 - 16:00. Upon entering the first exhibit, visitors are struck by the large photographs of Nagoya Castle, Nagoya Station and other locations burning in air raid-induced fires, presented alongside actual incendiary bomb casings and other items. ■Foreign Artists Exhibition, FAE 35: Call for Artists. Applications accepted from 1st September 2020 第35回外国人芸術作品展 As stated in the July issue of the Nagoya Calendar, NIC has given the go-ahead for another Foreign Artists Exhibition (FAE) in November this year (November 3 - 8). Organizers CJIS, as usual, are looking for painters, printers, photographers, potters (especially potters), multi-media artists of all types, sculptors, and computer graphic artists to exhibit their artwork in this long-running, ever-popular event which has been held annually in the 4th floor Exhibition Room at NIC since 1986.

Interested individuals can download an Application form and updated Guidelines from the FAE webpage at https://bit.ly/315ldzF or email directly to [email protected] . As in other years, all FAE 34 artists will automatically receive the application form and guidelines by mail.

It must be emphasized that, due to the coronavirus pandemic and its aftermath, social distancing and other regulations will be in operation throughout the exhibition. Such regulations prohibit the consumption of food and drink inside the exhibition room. There can be no opening ceremony, "coffee corner", or closing party this year. FAE 35 will therefore be a greatly simplified event, compared to other years. The updated Guidelines will include comprehensive information for all artists concerning the regulations. Naturally, the status of FAE 35 will depend on the situation with the coronavirus, and the event may be subject to further changes or cancellation. Artists will of course be informed by email, immediately.
