Horwitz* On September 9, 2014, Andrew Langlois walked into his polling place disgusted with the candidates who were running for U.S. Senate in the New Hampshire Republican Primary., Rather than voting for one of the ten candi- dates who appeared on his ballot, Mr. Langlois instead decided to vote for "his recently-deceased dog, 'Akira,'" whom he selected as a write-in candi- date.2 Thereafter, Mr. Langlois whipped out his smartphone, snapped a photo of his completed ballot, and posted the photo to his Facebook page along with the caption: "Because all of the candidates SUCK, I did a write-in of Akira."3 Unfortunately for Mr. Langlois, the election did not go his way. To start, Akira failed to win the Republican Party's nomination-instead, that honor went to former Massachusetts Senator Scott Brown, who went on to lose the general election to incumbent New Hampshire Senator Jeanne Shaheen.4 Adding insult to injury, Mr. Langlois also received a call from the New Hampshire Attorney General's Office, which "explained that he was being investigated for posting his ballot on social media" in violation of a recently enacted New Hampshire law that prohibited "taking a digital image or photograph of [one's] marked ballot and distributing or sharing the image via social media or by any other means."5 New Hampshire, for its part, is not alone in prohibiting voters from photographing and sharing photographs of their marked ballots-which have since become known as "ballot selfies." In fact, according to a recent CBS report on the issue, "ballot selfies are against the law" in thirty-five states, and violators are frequently subject to being "punished with fines, invalidated ballots, or even jail time."6 * Daniel Horwitz is an election lawyer in Nashville, Tennessee, and the former Associate General Counsel of the Tennessee Democratic Party. Illegal voter "ballot selfies" flood social media (CBS This Morning broadcast Nov. 5, 2014), http://www.cbsnews.com/videos/illegal-voter-ballot-selfies- 248 SMU Science and Technology Law Review [Vol. XVIII Along with two other voters who had posted photos of their ballots on social media during New Hampshire's September 2014 primary election, Mr. Langlois took up the torch of New Hampshire's "live free or die" tradition and sued his state in federal court.7 Along with State Representative Leon Rideout and first-time candidate Brandon Ross-both of whom had publicly memorialized their own candidacies by taking ballot selfiess-Mr. Langlois argued that New Hampshire's ban on ballot photography abridged his rights to freedom of speech and freedom of expression in violation of the First Amendment to the U.S. Constitution.9 In an August 11, 2015, opinion, U.S. District Court Judge Paul Barbadoro agreed, holding that New Hampshire's ballot selfie ban was "invalid because it is a content-based restriction on speech that cannot survive strict scrutiny."1o A similar ruling from the U.S. District Court for the Southern District of Indiana quickly followed suit.11 Unexpectedly, Judge Barbadoro's ruling quickly set off a firestorm in the election law world. Within a week, U.C. Irvine Professor Rick Hasen had penned an article in Reuters entitled: Why the Selfie is a Threat to Democ- racy, in which he argued that Judge Barbadoro "made a huge mistake be- cause without the ballot selfie ban, we could see the reemergence of the buying and selling of votes-and even potential coercion from employers, union bosses and others."12 Of note, Professor Hasen was not alone in ex- flood-social-media. Notably, however, some states have taken the opposite ap- proach. For example, ballot selfies are expressly permitted in Arizona and Utah. See ARiz. REv. STAT. ANN. § 16-1018(4) (Supp. 2015) (West) ("A voter who makes available an image of the voter's own ballot by posting on the internet or in some other electronic medium is deemed to have consented to retransmittal of that image and that retransmittal does not constitute a violation of this section."); UTAH CODE ANN. § 20A-3-504(3) (West Supp. 2015) ("Sub- section (1) does not prohibit an individual from transferring a photograph of the individual's own ballot in a manner that allows the photograph to be viewed by the individual or another."). 7. To begin, "as a general matter, 'the First Amendment means that government has no power to re- strict expression because of its message, its ideas, its subject matter, or its content.'"15 Because ballot selfie prohibitions forbid individuals from shar- ing one type of image-a photograph of a marked election ballot-but not other images, there is little doubt that such laws represent a content-based restriction on speech.16 As a result, such laws must satisfy an onerous legal standard known as "strict scrutiny."17 To uphold a law under this standard, the government must prove that the challenged law is both narrowly tailored and the least-restrictive means available to further a compelling governmen- tal interest.8 Unfortunately for proponents of ballot selfie bans, however, the 13. Though one of the bedrock principles of American democracy is the First Amendment, which protects the freedom of speech, 1 and though the Supreme Court has, time and time again, recognized the importance of political speech in particular, 2 there are limits to what the First Amendment covers. 3 For instance, Congress and states can both limit the amount of money in- dividuals can contribute to political campaigns, and states can protect polling places from undue influence by prohibiting campaigning within a specified perimeter of voting booths.

    Selfie-Informed Voting: How the Ballot Selfie Contributes to Rational Ignorance “[A] picture of a valid voted ballot, unlike a simple expression of how someone voted, is unique in being able to prove how someone voted.”1 I. INTRODUCTION The First Amendment to the U.S. Constitution protects citizens from government encroachment on speech.2 The First Amendment also protects the right to form political parties.3 States are permitted, however, to regulate elections by enacting “reasonable regulations of parties, elections, and ballots.”4 Depending on the nature of the restriction, courts will either apply strict or intermediate scrutiny to determine the constitutionality of a state statute attempting to regulate elections.5 The Supreme Court has extended First Amendment protection to Internet speech.6 Facebook posts, blog posts, and tweets clearly fall into the category of protected speech, as they can convey opinions to people all over the country and the world.7 In our ever-increasingly technological world, courts have considered Facebook “likes” speech under the First Amendment, leading to the 1.     TAKING SELFIES WITH UNCLE SAM Rebecca M. Baibak* I. INTRODUCTION The right to vote is a fundamental principle in democratic society. To protect this key right, elections in the United States have employed a secret ballot for over one hundred years. Some believe it is time to move beyond the secret ballot and permit voters to show their civic pride by posting “ballot selfies” (photos and videos of marked ballots that are shared on social media). Proponents of ballot selfies imagine a situation such as the following: a young voter is participating in her first election. The stakes in the election are high and the race is close. The voter is proud of her new right and, in a desire to endorse her chosen candidate and encourage her friends and family to vote, she posts a photo of her ballot online. Others oppose ballot selfies and imagine a different situation for the young voter. This voter depends on a part-time job to support herself while she is in school. The day before the election, the voter’s boss informs her that the company she works for has “certain beliefs” that only one of the candidates represents. The boss tells the young woman that he and the rest of the staff think it would be a great idea to post photos of their ballots on the company’s Facebook page. Caught between the desire to vote for her preferred candidate and the need to please her boss to maintain her job the young voter succumbs her boss’s demand. The two stories illustrate the difficult situation courts face when determining the constitutionality of laws that ban ballot selfies.

Also challenged is a separate policy of the Board of Elections of the City of New York (the “City Board”) that prohibits photography at polling sites, subject to exceptions for members of the press who obtain proper credentials. N.Y. Elec. Law § 17-130(10), first enacted in 1890 as part of the Australian ballot movement, provides that “[a]ny person who . Introduction Three million, three hundred thousand working men and women (one third of the adult population) signed the petition in support of “The Charter” presented to the British Parliament in 1842. The “Leviathan Petition” was so large it could not fit through the door of the legislature to whom it was addressed.2 Second of the petitioner’s six points was the right to vote in secret, via a ballot. This was a well thought out demand - with detailed diagrams of the design of the polling place, and the process of balloting, included in publications of the “The Charter.” The aim of this institutional reform was clear – it was to foreclose the ability of powerful actors to intimidate or bribe voters and thereby corrupt elections. The introduction of the secret ballot was intended to make the concurrent demand for the extension of the franchise a meaningful exercise in political empowerment. Despite the political and physical weight of the petition of 1842 (which was six miles long and weighed 300 kilograms) it was another thirty years before the secret ballot was adopted in the UK through the Ballot Act of 1872.

Elections in the United States stand out among all other Western democracies not only for their recent controversies, but also for their decentralized system of voting technologies, electoral administrations, and electoral laws. This paper will compare national elections in Estonia, Finland, Spain, and the United Kingdom to expose the strengths and weaknesses of the United States voting system and to show how voter privacy is an integral ingredient to democratic elections. Each of the selected countries implement different structures of electoral authority, utilize different voting technologies, follow different procedures, and operate within different legal frameworks and political cultures. Unlike in European democracies, the experience of voting in the United States differs depending on which state the voter is from. Although the U.S.’s patchwork system of electoral practices obstructs the voting process from adequately and equally protecting voter privacy, the system fits the unique circumstances of the American political system.
