noseweek BREAKING NEWS: FISHROT STINK WAFTS INTO SOUTH AFRICA Noseweek Issue #242, 1st December 2019 The so-called Fishrot Files just released by Wikileaks reveal how Samherji, Iceland's fishing conglomerate, colluded with key players in the Namibian fishing industry to gain preferential access to that country's lucrative fishing grounds and fishing quotas. Icelandic citizen Johannes Stephansson worked for Samherji in Namibia where his job was allegedly to gain profitable rights in that country’s fishing industry, however much bribe money it took. Stephansson claims that over a four year period he paid – allegedly on the instructions of his employer – millions of dollars in bribes to high-ranking political figures in Namibia. These were reflected as consultancy fees in Samherji’s financials. In 2016 he decided to call it a day and resigned, but not before downloading more than 40 gigabytes of documents from his employer’s computers. He delivered these to WikiLeaks who handed them to the Doha-based news channel, Al Jazeera. Their investigative unit subsequently uncovered a network of fraud, corruption and money laundering with tentacles extending from Southern Africa to Iceland, Cyprus, Dubai and the Marshall Islands. "It's a blueprint of how foreign companies are stripping Africa's resources for their own benefit and leaving nothing behind," Stefansson says in Al Jazeera’s hour-long documentary, Anatomy of a Bribe: A deep dive into an underworld of corruption, that was broadcast worldwide on the 1st of December. In the programme, a journalist, posing as a representative of wealthy Chinese investors, attempted to obtain fishing quotas for a proposed joint venture with the Namibian fishing company, Omualu. -

Media Monitoring on Urban Development in Namibia Media Monitoring on Urban Development in Namibia is a service provided by Development Workshop Namibia (DWN), a newly registered Namibian NGO with a focus on sustainable urban development and poverty reduction. DWN is part of a world-wide network of Development Workshop (DW) organisations with centres in Canada, Angola and France, and offices in Vietnam and Burkino Faso. It was founded in the 1970s by three architect students in the UK and has been funded by non- governmental organisations, private citizens, and national and international development organisations. In Namibia, DWN’s activities focus on urban related research, effective urban planning for the urban poor, solutions to informal settlements, water & sanitation, and projects specifically targeting disadvantaged segments of the urban youth. Through 40 years of engagement on urban issues mainly in Africa and Asia, the DW network of organisations has acquired significant institutional knowledge and capacity and is well integrated in regional and international networks. The Namibian media provide an important source of information on urban development processes in the country, highlighting current events, opportunities and challenges. The media further provide insight into the different views and perceptions of a variety of actors, be it from government, non- government, private sector, and individuals that reside in Namibia’s towns and settlements. It is therefore hoped that DWN’s Media Monitoring service will provide insights into those different views, with potential use for a variety of institutions and decision-makers that work in the urban environment in Namibia. The Media Monitoring service is currently provided on a monthly basis and monitors the following newspapers: The Namibian, Republikein, Namibian Sun, New Era, Windhoek Observer, Confidente, and Informante. -

Iceland’s involvement in bribes and corruption in Namibia’s fishing industry - Discourse analysis of the media Master's Thesis Culture, Communication and Globalisation September 15th 2020 Sól Margrét Bjarnadóttir Study no: 20180664 Keystrokes: 117.061 Supervisor: Oscar Garcia Augustin Abstract This thesis aims to examine the discourse in the Icelandic media coverage on the so-called Samherja case from the period on November 12, 2019, until July 12, 2020. The case concerns a significant document leak including over 30.000 documents on one of the biggest fishing companies of Iceland, Samherji, and their considered corrupt involvement in the fishing industry in Namibia. The theoretical framework consisted of perspectives in both international relations and media with a focus on poststructuralism, trust theories, theories on small state and then media theory of agenda-setting. The researcher used of mixed-method, including content analysis of media coverage and discourse analysis of those. Three media were analyses Stundin, Fréttablaðið and Morgunblaðið, which should give a holistic picture of the discourse in the media in general. The purpose was not to form a new theory from the data; rather, the focus is on the complex relations between social structure and discourse situation at any moment. From the perspective of constructivism and poststructuralism, we identify objects or themes that spin through the discourse and form a regime of truth. The analysis of data revealed four ideological standpoints that shaped the discourse: Corruption within, Exploitation of Namibian resources, Reputation of Iceland internationally, Mistrust and disputes in government. It could, therefore, be concluded from the analysis that corruption is considered a problem in the country. -

The Legal Dimension of Namibia's Foreign Relations*
The legal dimension of Namibia’s foreign relations* Sacky Shanghala** Introduction Domestic laws of states regulate the relations of citizens inter se (horizontally) and with the state (vertically), 1 whereas the relationship of states in their interactions is regulated by international law.2 Yet there are other activities that take place beyond the national boundaries – social activities (citizens intermarrying), cultural (peoples sharing common backgrounds across frontiers), and economic (trade across borders) – which states seek to regulate out of necessity. While some of the activities are good, there are also bad activities such as crime (drugs, terrorism and arms trade) which states seek to curb. States deal with these extraterritorial or cross-frontier activities individually, bilaterally or through multilateral arrangements. Namibia, on her own accord, joined the community of nations as an independent country on 23 April 1990,3 and as such, her interaction with other states is defined by the rules of international law and the policies of state driving interests of a particular state as it interacts with other states, i.e. foreign policy. New Fishrot Fiddles and Whistleblower Surfaces By FINSA reporter - 29 July 2020 0 Former fisheries minister, Bernhard Esau and his son-in-law, Tamson ‘Fitty” Hatuikulipi, Time passes slowly for the two former ministers and three government officers and their cohorts detained in Namibia while the Fishrot corruption scandal is being unravelled. It’s not so for those pursuing the truth, if anything the days fly by too quickly. Recent developments include unsuccessful bail hearings, money laundering by trusted finance companies that did not question the money they received, allegations of tax dodging, and the whistleblower who claims he will finish what he started. The “Fishrot” scandal involves an elaborate bribery and kickback scheme allegedly devised by former fisheries minister Berhard Esau, former justice minister, Sacky Shanghala and James Hatuikulipi to sell horse mackerel quotas. Those same quotas had been allocated to state-owned fishing company Fishcor but were sold onward to Icelandic company Samherji. The alleged scam seemingly drew in the Angolan fisheries ministry too. A joint venture between the Angolans and Fishcor saw Fishcor’s quota allegedly being sold off to Samherji. Investigators say the accused allegedly used front companies in Namibia, Angola and South Africa to siphon about R103 million in kickbacks to companies in the offshore tax havens of Dubai, Cyprus and Mauritius. The two main Fishrot cases are the State vs Berhard Esau and five others and the State vs Mike Nghipunya and five others. Two other Fishrot cases are the alleged bribe offering to an Anti-Corruption Commission (ACC) official and the other the alleged removal of files form the home of former justice minister Sacky Sanghala.
